Item 3.2(C) — WAIVER OF THE EARNEST MONEY DEPOSITमद 3.2(C) — बयाना राशि की छूट

The item waives the EMD a tenderer would otherwise have to put down.

• PCMM: up to the limit of HIS POWERS OF PURCHASE
• CMM and Dy CMM: up to the limit of their powers of purchase
• SMM and AMM: NIL
• Field Stores Officers and their accepting authorities: up to their power of acceptance
• The power is exercised where it is considered JUSTIFIED IN THE PUBLIC INTEREST
• It carries finance concurrence
• Finance concurrence is not required for cases of EXEMPTED CATEGORIES

So a waiver is a public interest decision and not a favour, and you should say on what ground it rests.यह मद वह बयाना राशि छोड़ती है जो निविदाकार को अन्यथा जमा करनी होती।

• पीसीएमएम: अपनी क्रय शक्तियों की सीमा तक
• सीएमएम और डिप्टी सीएमएम: अपनी क्रय शक्तियों की सीमा तक
• एसएमएम और एएमएम: शून्य
• क्षेत्रीय भंडार अधिकारी और उनके स्वीकार प्राधिकारी: अपनी स्वीकृति की शक्ति तक
• यह शक्ति वहाँ प्रयोग होती है जहाँ लोकहित में उचित समझी जाए
• इसके साथ वित्त सहमति लगती है
• छूट प्राप्त श्रेणियों के मामलों में वित्त सहमति की आवश्यकता नहीं

अर्थात् छूट कृपा नहीं, लोकहित का निर्णय है, और वह किस आधार पर टिकी है यह आप कहिए।

Item 3.2(D) — WAIVER OF THE SECURITY DEPOSITमद 3.2(D) — प्रतिभूति जमा की छूट

Part (D)(i) waives the security deposit, and the ladder here runs further down than the EMD's.

• PCMM, CMM, Dy CMM, SMM and AMM: up to the limit of their POWERS OF PURCHASE
• Field Stores Officers and their accepting authorities: up to their power of acceptance
• The relevant guidelines are in the Board's letters of 24.07.2007 and 19.02.08

• PART (D)(ii) — A SECURITY DEPOSIT FOR PAC ITEMS
  • A security deposit is NOT required to be submitted at all
  • That is for the sources in whose favour the user department has provided a PAC
  • Here the schedule gives no column figures, because the deposit itself does not arise
  So a PAC source is free of the deposit by the rule itself, and you should not look for a waiver there.

• भाग (D)(ii) — PAC मदों का प्रतिभूति जमा
  • प्रतिभूति जमा देने की आवश्यकता ही नहीं होती
  • यह उन स्रोतों के लिए है जिनके पक्ष में उपयोगकर्ता विभाग ने PAC दिया हो
  • यहाँ अनुसूची कोई स्तंभ आँकड़ा नहीं देती, क्योंकि जमा का प्रश्न ही नहीं उठता
  अर्थात् PAC वाला स्रोत नियम से ही जमा से मुक्त है, और वहाँ छूट आप मत ढूँढ़िए।

Item 3.2(E) — REFUND OR FORFEITURE OF THE EARNEST MONEYमद 3.2(E) — बयाना राशि की वापसी या जब्ती

The item refunds or forfeits the EMD without finance concurrence, in accordance with the conditions of the tender.

• PCMM: FULL POWERS, contracts entered under the GM's or AGM's powers included
• CMM, Dy CMM, SMM and AMM: up to the limit of their powers of purchase
• Field Stores Officers and their accepting authorities: up to their power of acceptance
• The authority is item 15(ii) of PARA 132-S
• The tender's own conditions are what decide between a refund and a forfeiture

So the PCMM may act even on the GM's contract, and you should read the tender's conditions first.यह मद निविदा की शर्तों के अनुसार, बिना वित्त सहमति, बयाना राशि लौटाती या जब्त करती है।

• पीसीएमएम: पूर्ण शक्तियाँ, महाप्रबंधक या अपर महाप्रबंधक की शक्तियों में हुई संविदाएँ सहित

• प्राधिकार पैरा 132-S की मद 15(ii) है
• वापसी और जब्ती में निर्णय निविदा की अपनी शर्तें करती हैं

अर्थात् पीसीएमएम महाप्रबंधक की संविदा पर भी काम कर सकते हैं, और पहले निविदा की शर्तें आप पढ़िए।
