Item 21 — COMPENSATION FOR TREES AND FOR DAMAGEमद 21 — पेड़ों और क्षति का मुआवजा

Part (A) is compensation for cutting trees of private parties that obstruct the view of railway signals or level crossings. It also covers damage to crops or other property in the course of executing railway works. Cutting or trimming of trees connected with protection of the OHE or safety of track is in it too.

• PHOD/CHOD: FULL POWERS
• DRM or CWM (in SAG): FULL POWERS
• JAG or SG: up to Rs 2 lakh in each case
• Senior Scale with independent charge: up to Rs 1 lakh
• The authority is SECTION 35 of the LAND ACQUISITION ACT, 1894
• Finance concurrence is necessary beyond RS 5,000 in each case

• PART (B) — ADVANCE TO THE FOREST DEPARTMENT
  • Advance payment to the Forest Department for cutting trees obstructing the view of signals or level crossings
  • PHOD/HOD: FULL POWERS; DRM ONLY: FULL POWERS; divisional and headquarters officers: NIL
  • The power in part (B) is exercised WITH finance concurrence
  So you should notice where finance enters: at Rs 5,000 in (A), and always in (B).

भाग (A) निजी पक्षों के उन पेड़ों को काटने का मुआवजा है जो रेल संकेतों या समपार की दृष्टि रोकते हैं। इसमें रेल कार्य करते समय फसलों या अन्य संपत्ति की क्षति भी आती है। ओएचई की रक्षा या पटरी की संरक्षा से जुड़े पेड़ों की कटाई या छँटाई भी इसमें है।

• पीएचओडी/सीएचओडी: पूर्ण शक्तियाँ
• मंडल रेल प्रबंधक या एसएजी के सीडब्ल्यूएम: पूर्ण शक्तियाँ
• जेएजी या एसजी: हर मामले में 2 लाख रुपये तक
• स्वतंत्र प्रभार वाला वरिष्ठ स्केल: 1 लाख रुपये तक
• प्राधिकार भूमि अर्जन अधिनियम, 1894 की धारा 35 है
• हर मामले में 5,000 रुपये से आगे वित्त सहमति आवश्यक है

• भाग (B) — वन विभाग को अग्रिम
  • संकेतों या समपार की दृष्टि रोकने वाले पेड़ काटने के लिए वन विभाग को अग्रिम भुगतान
  • पीएचओडी/एचओडी: पूर्ण शक्तियाँ; केवल मंडल रेल प्रबंधक: पूर्ण शक्तियाँ; मंडल और मुख्यालय अधिकारी: शून्य
  • भाग (B) की शक्ति वित्त सहमति के साथ चलती है
  अर्थात् वित्त कहाँ आता है, यह आप देखिए: (A) में 5,000 रुपये पर, और (B) में हर बार।

Item 22 — LEASE OF USUFRUCT TREES, FISHING AND GRASSमद 22 — फलदार पेड़, मछली पकड़ना और घास का पट्टा

The item leases three things that grow or live on railway land.

• (A) USUFRUCT TREES: PCE or the HOD of the Civil Engineering department FULL POWERS
• The same: DRM FULL POWERS; Sr DEN or DEN FULL POWERS
• AEN: up to Rs 2,500 at any one time or place
• (B) RIGHTS FOR FISHING in ditches within railway limits: PCE or HOD of Civil Engineering FULL POWERS
• The same: DRM FULL POWERS; Sr DEN, DEN or AEN FULL POWERS
• In part (B) every column reads BY PUBLIC AUCTION or on tender basis
• (C) CUTTING GRASS within railway limits: PCE or HOD of Civil Engineering FULL POWERS
• The same: DRM FULL POWERS; Sr DEN, DEN or AEN FULL POWERS

• THE NOTES
  • Finance concurrence is NOT necessary
  • The lease is effected through public auction or on tender basis
  • SSE or JE of P Way and Works: up to Rs 1,000 in each case by public auction
  • The reserve price and the sale price are reviewed ONCE IN SIX MONTHS by Sr DEN/Co-ordination, who issues guidelines for the future
  So you should carry the method with the power: public auction, or tender.

यह मद रेल भूमि पर उगने या रहने वाली तीन चीजों का पट्टा देती है।

• (A) फलदार पेड़: पीसीई या सिविल इंजीनियरिंग विभाग के एचओडी पूर्ण शक्तियाँ
• वही: मंडल रेल प्रबंधक पूर्ण शक्तियाँ; वरिष्ठ डीईएन या डीईएन पूर्ण शक्तियाँ
• एईएन: एक बार या एक जगह 2,500 रुपये तक
• (B) रेल सीमा की खाइयों में मछली पकड़ने का अधिकार: पीसीई या सिविल इंजीनियरिंग के एचओडी पूर्ण शक्तियाँ
• वही: मंडल रेल प्रबंधक पूर्ण शक्तियाँ; वरिष्ठ डीईएन, डीईएन या एईएन पूर्ण शक्तियाँ
• भाग (B) में हर स्तंभ कहता है — सार्वजनिक नीलामी से, या निविदा के आधार पर
• (C) रेल सीमा में घास काटना: पीसीई या सिविल इंजीनियरिंग के एचओडी पूर्ण शक्तियाँ
• वही: मंडल रेल प्रबंधक पूर्ण शक्तियाँ; वरिष्ठ डीईएन, डीईएन या एईएन पूर्ण शक्तियाँ

• नोट
  • वित्त सहमति आवश्यक नहीं है
  • पट्टा सार्वजनिक नीलामी या निविदा के आधार पर किया जाता है
  • पीवे एवं कार्य के एसएसई या जेई: सार्वजनिक नीलामी से हर मामले में 1,000 रुपये तक
  • आरक्षित मूल्य और विक्रय मूल्य की समीक्षा छह माह में एक बार वरिष्ठ डीईएन/समन्वय करते हैं, और आगे के लिए दिशानिर्देश देते हैं
  अर्थात् शक्ति के साथ रीति भी आप रखिए: सार्वजनिक नीलामी, या निविदा।

Item 23 — WRITE OFF OF GROUND RENTमद 23 — भू-भाटक का बट्टे खाते डालना

The item writes off ground rent when it is irrecoverable.

• PHOD: up to RS 10,000 when irrecoverable
• DRM: up to RS 5,000 when irrecoverable
• Divisional and headquarters officers: NIL

• THE NOTES
  • PRIOR finance concurrence is necessary
  • The authority is item 27 of the GM's delegation
  So the condition is not the amount alone, and you should say the word irrecoverable.

यह मद भू-भाटक को वसूली योग्य न रहने पर बट्टे खाते डालती है।

• पीएचओडी: वसूली योग्य न हो तो 10,000 रुपये तक
• मंडल रेल प्रबंधक: वसूली योग्य न हो तो 5,000 रुपये तक
• मंडल और मुख्यालय अधिकारी: शून्य

• नोट
  • पूर्व वित्त सहमति आवश्यक है
  • प्राधिकार महाप्रबंधक के प्रत्यायोजन की मद 27 है
  अर्थात् शर्त केवल राशि नहीं है, और आप 'वसूली योग्य नहीं' शब्द कहिए।

Item 24 — WRITE OFF FROM THE NUMERICAL RETURNSमद 24 — संख्यात्मक विवरणियों से बट्टे खाते डालना

The item writes off stores and tools and plant lost or detected during stock verification, that is where NO adjustment of value is necessary.

• PHOD: FULL POWERS
• DRM, ADRM or SAG: FULL POWERS
• Divisional and headquarters officers: NIL

• THE NOTES
  • Finance concurrence is NOT necessary
  • The authority is item 44 of the GM's delegation
  So the whole weight of this item is the numbers alone, and you should notice no value moves.

यह मद स्टॉक सत्यापन में खोए या पकड़े गए भंडार तथा औजार और संयंत्र को बट्टे खाते डालती है, अर्थात् जहाँ मूल्य का कोई समायोजन आवश्यक नहीं।

• पीएचओडी: पूर्ण शक्तियाँ
• मंडल रेल प्रबंधक, एडीआरएम या एसएजी: पूर्ण शक्तियाँ
• मंडल और मुख्यालय अधिकारी: शून्य

Item 25 — WRITE OFF OF BALLAST FOUND SHORTमद 25 — सत्यापन में कम मिली गिट्टी का बट्टे खाते डालना

The item writes off ballast found short during verification.

• PCE or CAO/CN: FULL POWERS
• DRM, ADRM and SAG: NIL; divisional and headquarters officers: NIL

• THE NOTES
  • PRIOR finance concurrence is necessary
  • Where the shortage is due to theft or other irregularities and is over RS 10,000 in value, a REPORT is sent to the GM
  • The authority is item 44 of the GM's delegation
  So ballast is written off at the top alone, and you should hold Rs 10,000 as the reporting line.

यह मद सत्यापन में कम मिली गिट्टी को बट्टे खाते डालती है।

• पीसीई या सीएओ/सीएन: पूर्ण शक्तियाँ
• मंडल रेल प्रबंधक, एडीआरएम और एसएजी: शून्य; मंडल और मुख्यालय अधिकारी: शून्य

• नोट
  • पूर्व वित्त सहमति आवश्यक है
  • जहाँ कमी चोरी या अन्य अनियमितता से हो और मूल्य 10,000 रुपये से अधिक हो, वहाँ महाप्रबंधक को रिपोर्ट भेजी जाती है
  • प्राधिकार महाप्रबंधक के प्रत्यायोजन की मद 44 है
  अर्थात् गिट्टी केवल ऊपर से बट्टे खाते जाती है, और 10,000 रुपये को आप रिपोर्ट की रेखा रखिए।

Item 26 — ADJUSTMENT AFTER THE COMPLETION REPORTमद 26 — समापन रिपोर्ट के बाद समायोजन

The item adjusts charges or credits relating to completed works after the completion report has been drawn, while the sanction is still awaited.

• PHOD: FULL POWERS
• DRM, ADRM or CWM: FULL POWERS
• Divisional and headquarters officers: NIL

• THE NOTES
  • Finance concurrence is necessary
  • The authority is PARA 1717 and PARA 1718 of the Engineering Code
  So the CR does not close the account for good, and you should name Paras 1717 and 1718.

यह मद पूरे हुए कार्यों के प्रभारों या जमा का समायोजन करती है, जब समापन रिपोर्ट बन चुकी हो और स्वीकृति की प्रतीक्षा हो।

• मंडल रेल प्रबंधक, एडीआरएम या सीडब्ल्यूएम: पूर्ण शक्तियाँ

  अर्थात् समापन रिपोर्ट लेखा सदा के लिए बंद नहीं करती, और आप पैरा 1717 तथा 1718 बताइए।
