• (i) In WORKS contracts, a tender WITHOUT the requisite earnest money is NEVER entertained and is SUMMARILY REJECTED
• (ii) In STORES contracts, the CONTROLLER OF STORES, with the FA&CAO, may RELAX earnest money and security deposit in specific public-interest cases

Relaxation covers unregistered firms unwilling to pay, and registered firms asked for security on items they are not registered for. EMD, now called bid security, is 2 PER CENT of the estimated cost of the work, for all works (GCC 2022, Advance Correction Slip 11 of 13.03.2026). So a works tender without EMD is rejected outright, and you should know only stores contracts may relax it.

• (ii) भंडार अनुबंधों में भंडार नियंत्रक, वित्त सलाहकार एवं मुख्य लेखा अधिकारी के साथ, जनहित के विशेष मामलों में बयाना राशि और प्रतिभूति जमा में छूट दे सकता है

छूट उन अपंजीकृत फर्मों पर है जो देने को तैयार न हों, और उन पंजीकृत फर्मों पर जिनसे अपंजीकृत मदों के लिए प्रतिभूति माँगी जाए। बयाना राशि, जिसे अब बोली प्रतिभूति कहते हैं, सभी कार्यों के लिए कार्य की अनुमानित लागत का 2 प्रतिशत है (जीसीसी 2022, अग्रिम सुधार पर्ची 11, 13.03.2026)। अर्थात् बयाना राशि के बिना निर्माण निविदा सीधे अस्वीकार होती है, और आप जानिए कि केवल भंडार अनुबंध इसमें छूट दे सकते हैं।

  • Before that: 2 PER CENT up to RS 1 CRORE; beyond, RS 2 LAKH plus 0.5 PER CENT of the excess, up to RS 1 CRORE
  • Start-ups recognised by DIPP, 100 per cent Government PSUs and MSEs are EXEMPT; labour co-operatives pay 50 PER CENT
  • Refunded to unsuccessful bidders, adjusted into SECURITY DEPOSIT for the successful one
  • FORFEITED if the bidder withdraws or amends, or the successful bidder does not sign or give the PG in time
• PERFORMANCE GUARANTEE
  • 5 PER CENT of the original contract value for works (GCC 2022, Para 16(4)); for service contracts also 5 per cent, since 24.05.2024
  • For works it is due within 21 DAYS of the LOA, or up to 60 days with 12 per cent penal interest
  • No finance concurrence is needed to RELEASE it; the Accounts Officer keeps bank guarantees in custody

  • It guarantees faithful execution, and is forfeited on termination for the contractor's default
  The 3 PER CENT PG was a relief for tenders issued up to 31.12.2021 (Board's letter dated 20.11.2020). So the PG is 5 per cent and the bid security 2 per cent, and you should know the 3 per cent PG was a pandemic relief.

• प्रतिभूति जमा
  • 25 लाख से 50 करोड़ रुपये तक मूल्य का 5 प्रतिशत, अधिकतम 50 लाख रुपये; 50 करोड़ रुपये से ऊपर 1 करोड़ रुपये
  • यह निष्ठापूर्ण निष्पादन की गारंटी है, और ठेकेदार की चूक पर समाप्ति होने पर जब्त होती है
  3 प्रतिशत निष्पादन गारंटी 31.12.2021 तक जारी निविदाओं के लिए राहत थी (बोर्ड का 20.11.2020 का पत्र)। अर्थात् निष्पादन गारंटी 5 प्रतिशत और बोली प्रतिभूति 2 प्रतिशत है, और आप जानिए कि 3 प्रतिशत की गारंटी महामारी की राहत थी।
