Item 6 — SIGNING OF CONTRACT AGREEMENTSमद 6 — संविदा करारों पर हस्ताक्षर

The item is the signing of contract agreements, rider agreements included, for tenders accepted by the competent authority — works, service, BOOT and every other type.

• PHOD/CHOD: ONE STAGE BELOW the tender accepting authority
• DRM, ADRM or CWM (in SAG): ONE STAGE BELOW the tender accepting authority
• Divisional and headquarters officers: ONE STAGE BELOW the tender accepting authority
• In each column the stage is read from the extant delegation of powers for OPEN TENDERS, which today is ANNEXURE A
• The authority is PARA 1259 of the Engineering Code and PARA 410 of the Stores Code Volume I

• THE NOTES
  • Finance vetting is necessary
  • The powers are used only AFTER the contract, purchase or lease has been approved by the competent authority
  • Where no standard agreement exists, the contract or lease agreement is vetted by the LAW OFFICER
  • A rider agreement may be signed by the authority who signed the original agreement, if the competent authority approves
  So the signing authority is never the accepting authority, and you should say one stage below.

यह मद सक्षम प्राधिकारी द्वारा स्वीकृत निविदाओं के संविदा करारों पर हस्ताक्षर है, राइडर करार भी — कार्य, सेवा, बीओओटी और हर अन्य प्रकार।

  • ये शक्तियाँ संविदा, खरीद या पट्टे के सक्षम प्राधिकारी से अनुमोदित होने के बाद ही चलती हैं
  • जहाँ कोई मानक करार न हो, वहाँ संविदा या पट्टा करार विधि अधिकारी से जँचवाया जाता है
  • राइडर करार पर वही प्राधिकारी हस्ताक्षर कर सकता है जिसने मूल करार पर किए थे, यदि सक्षम प्राधिकारी अनुमोदन दे
  अर्थात् हस्ताक्षर करने वाला कभी स्वीकृति देने वाला नहीं होता, और आप कहिए — एक पायदान नीचे।

Item 7 — NEW SOR ITEMS IN A WORKS CONTRACTमद 7 — कार्य संविदा में नई एसओआर मदें

The item is the introduction of new schedule of rates items in a contract for works.

• PHOD/HOD: FULL POWERS
• DRM, ADRM or CWM (in SAG): FULL POWERS
• SG, JAG or Senior Scale with independent charge: FULL POWERS

• THE NOTES
  • The items proposed for inclusion should be RELEVANT to the main scope of the work
  • A revision to the contract value is proposed by way of a VARIATION STATEMENT
  • The variation itself is governed by the notes under item 9 of this Part A
  So the power is full at every level, and you should attach the condition of relevance to it.

यह मद कार्य संविदा में दर अनुसूची की नई मदें जोड़ना है।

• पीएचओडी/एचओडी: पूर्ण शक्तियाँ
• मंडल रेल प्रबंधक, एडीआरएम या एसएजी के सीडब्ल्यूएम: पूर्ण शक्तियाँ

Item 8 — NEW NON-SCHEDULE ITEMS IN A CONTRACTमद 8 — संविदा में नई गैर-अनुसूची मदें

The item is the introduction of new non-schedule items in a contract for works, in two parts.

• (A) WITHOUT finance concurrence, PHOD/HOD: up to Rs 5 lakh in a contract, or 10% of the original contract value, whichever is less
• DRM, ADRM or CWM (in SAG): the same Rs 5 lakh or 10%, whichever is less
• SG, JAG or Senior Scale with independent charge: the same Rs 5 lakh or 10%, whichever is less
• (B) WITH finance concurrence: FULL POWERS in all three columns

• THE NOTES
  • The rates sanctioned for such items should be comparable to rates for similar works executed in the area
  • Rates are derived from the LAST ACCEPTED RATES of SOR or NS items of similar conditions
  • Where a new item cannot be derived from them, MARKET RATES are taken
  • An NS rate accepted without finance concurrence CANNOT be quoted as a last accepted rate to justify a rate in a future tender
  • The variation is governed by the notes under item 9
  So you should carry both halves of the limit: Rs 5 lakh, or 10%, whichever is less.

यह मद कार्य संविदा में नई गैर-अनुसूची मदें जोड़ना है, दो भागों में।

• (A) बिना वित्त सहमति, पीएचओडी/एचओडी: एक संविदा में 5 लाख रुपये तक, या मूल संविदा मूल्य का 10%, जो कम हो
• मंडल रेल प्रबंधक, एडीआरएम या एसएजी के सीडब्ल्यूएम: वही 5 लाख रुपये या 10%, जो कम हो
• एसजी, जेएजी या स्वतंत्र प्रभार वाला वरिष्ठ स्केल: वही 5 लाख रुपये या 10%, जो कम हो
• (B) वित्त सहमति के साथ: तीनों स्तंभों में पूर्ण शक्तियाँ

• नोट
  • ऐसी मदों की स्वीकृत दरें उस क्षेत्र में हुए समान कार्यों की दरों से तुलनीय होनी चाहिए
  • दरें समान परिस्थितियों की एसओआर या एनएस मदों की अंतिम स्वीकृत दरों से निकाली जाती हैं
  • जहाँ नई मद उनसे न निकले, वहाँ बाजार दरें ली जाती हैं
  • बिना वित्त सहमति स्वीकार की गई एनएस दर भविष्य की निविदा में दर को उचित ठहराने के लिए अंतिम स्वीकृत दर के रूप में नहीं दी जा सकती
  • भिन्नता मद 9 के नोट से चलती है
  अर्थात् सीमा के दोनों हिस्से आप साथ रखिए: 5 लाख रुपये, या 10%, जो कम हो।

Item 9(A) — INCREASE IN QUANTITIESमद 9(A) — मात्राओं में वृद्धि

The item is variation in the quantities specified in a contract, and this half is the increase.

• PHOD/HOD: FULL POWERS; DRM, ADRM or CWM (in SAG): FULL POWERS
• SG, JAG or Senior Scale with independent charge: FULL POWERS
• Each column holds only if the revised monetary value of the amended contract stays within that officer's current TENDER ACCEPTANCE power

• THE 25 PER CENT LADDER
  • An individual NS item may be operated within plus or minus 25%, paid at the agreement rate, with NO finance concurrence
  • Where an increase beyond 25% is unavoidable, a FRESH TENDER is floated for that item
  • Where a fresh tender is not practicable, the quantity may go beyond 125% on the conditions below
  • A built-in rate reduction of 2% applies between 125% and 140%, and 4% between 140% and 150%
  • So it needs only the prior approval of the tender accepting authority, an officer not below JAG, without finance concurrence
  • Quantities beyond 125% and up to 140% are paid at 98% of the rate awarded for that item
  • Quantities beyond 140% and up to 150% are paid at 96% of that rate
  • Beyond 150% is PROHIBITED, allowed only in exceptional unavoidable circumstances with associate finance, and paid at 96%
  • A supplementary agreement or addendum is drawn after an officer not below JAG sanctions the variation, and associate finance vets it
  So you should learn the ladder as 98, 96 and 96, and the officer as JAG.

यह मद संविदा में तय मात्राओं की भिन्नता है, और यह आधा भाग वृद्धि का है।

• पीएचओडी/एचओडी: पूर्ण शक्तियाँ; मंडल रेल प्रबंधक, एडीआरएम या एसएजी के सीडब्ल्यूएम: पूर्ण शक्तियाँ

• 25 प्रतिशत की सीढ़ी
  • एक एनएस मद 25% कम या अधिक तक चलाई जा सकती है, करार की दर पर भुगतान, बिना वित्त सहमति
  • जहाँ 25% से अधिक वृद्धि अपरिहार्य हो, वहाँ उस मद के लिए नई निविदा बुलाई जाती है
  • जहाँ नई निविदा व्यावहारिक न हो, वहाँ नीचे की शर्तों पर मात्रा 125% से आगे जा सकती है
  • 125% और 140% के बीच 2%, तथा 140% और 150% के बीच 4% की अंतर्निहित दर कटौती लगती है
  • इसलिए इसमें केवल निविदा स्वीकृति प्राधिकारी, जो जेएजी से नीचे का न हो, का पूर्व अनुमोदन चाहिए, बिना वित्त सहमति
  • 125% से आगे और 140% तक की मात्राएँ उस मद की दी गई दर के 98% पर चुकाई जाती हैं
  • 140% से आगे और 150% तक की मात्राएँ उसी दर के 96% पर
  • 150% से आगे वर्जित है, केवल असाधारण अपरिहार्य परिस्थिति में सहयोगी वित्त के साथ, और भुगतान 96% पर
  • जेएजी से नीचे का न हो ऐसे अधिकारी की भिन्नता स्वीकृति के बाद पूरक करार या परिशिष्ट बनता है, और सहयोगी वित्त उसे जाँचता है
  अर्थात् सीढ़ी को आप 98, 96 और 96 से, तथा अधिकारी को जेएजी से याद रखिए।

Item 9(A) — THE REST OF THE VARIATION NOTESमद 9(A) — भिन्नता के शेष नोट

The same item carries six more notes, and they are the ones a paper likes.

• The formula applies to the INDIVIDUAL items of a contract, not to the overall contract value
• Execution beyond 150% of the overall agreement value is not permitted
• If it is found necessary, it goes by fresh tenders, or by negotiation with the existing contractor
• That negotiation carries the PFA's PERSONAL concurrence and the GM's PERSONAL sanction
• For a MINOR VALUE item the limit is 100%, not 25%
• A minor value item is one whose original agreement value is less than 1% of the total original agreement value
• No quantity variation limit applies to FOUNDATION items
• For SSR or SOR items the 25% applies to the schedule AS A WHOLE, not to each item
• For NS items it applies to the individual item, however the rate was quoted
• For tenders accepted by Board Members and Railway Ministers, the GM may accept variation up to 110% of the original agreement value
• In a ZONAL contract the variation should not exceed 25% of the contract value
• Competency to sanction goes by the overall agreemental value: the accepted value plus positive variation, minus negative variation
• The estimate provision, or a revised estimate, must be ensured, and the rules for excess over estimate followed

So you should hold 100% for a minor item, and nothing at all for a foundation item.इसी मद के छह और नोट हैं, और प्रश्नपत्र को यही भाते हैं।

• छोटे मूल्य की मद वह है जिसका मूल करार मूल्य कुल मूल करार मूल्य के 1% से कम हो
• नींव की मदों पर मात्रा भिन्नता की कोई सीमा नहीं लगती
• एसएसआर या एसओआर मदों में 25% पूरी अनुसूची पर लगता है, हर मद पर नहीं
• एनएस मदों में यह अलग-अलग मद पर लगता है, दर चाहे जिस रूप में दी गई हो
• बोर्ड सदस्यों और रेल मंत्री द्वारा स्वीकृत निविदाओं में महाप्रबंधक मूल करार मूल्य के 110% तक भिन्नता स्वीकार कर सकते हैं
• जोनल संविदा में भिन्नता संविदा मूल्य के 25% से अधिक नहीं होनी चाहिए
• स्वीकृति की सक्षमता कुल करार मूल्य से तय होती है: स्वीकृत मूल्य में धनात्मक भिन्नता जोड़कर, ऋणात्मक भिन्नता घटाकर
• अनुमान में प्रावधान, या संशोधित अनुमान, सुनिश्चित करना होगा, और अनुमान से अधिकता के नियम मानने होंगे

अर्थात् छोटी मद के लिए 100%, और नींव की मद के लिए कोई सीमा नहीं — यह आप रखिए।

Item 9(B) — DECREASE IN QUANTITIESमद 9(B) — मात्राओं में कमी

This half of item 9 is the decrease in quantities specified in a contract.

• PHOD/HOD: FULL POWERS, where the amended contract does not exceed their current tender acceptance power
• DRM, ADRM or CWM (in SAG): FULL POWERS in respect of contracts accepted by them
• SG, JAG or Senior Scale with independent charge: FULL POWERS in respect of contracts accepted by them

• THE NOTES
  • The contract signing authority may decrease an individual item up to 25% WITHOUT finance concurrence
  • Beyond 25% of an individual item, or 25% of the contract agreement value, an officer not below SA Grade approves
  • That approval follows a NO CLAIM CERTIFICATE from the contractor, with finance concurrence and detailed reasons for each decrease
  • It must be certified that the quantities reduced will NOT be required in the same work at a later stage
  • For a minor value item the limit is 100%, and foundation items carry no limit
  So on the way down you should remember two things: SA Grade, and the no claim certificate.

मद 9 का यह आधा भाग संविदा में तय मात्राओं की कमी है।

• नोट
  • संविदा पर हस्ताक्षर करने वाला प्राधिकारी किसी मद में 25% तक कमी बिना वित्त सहमति कर सकता है
  • किसी मद के 25% से आगे, या संविदा करार मूल्य के 25% से आगे, एसए ग्रेड से नीचे का न हो ऐसा अधिकारी अनुमोदन देता है
  • वह अनुमोदन ठेकेदार से दावा-रहित प्रमाणपत्र लेकर, वित्त सहमति और हर कमी के विस्तृत कारणों के साथ होता है
  • यह प्रमाणित करना होगा कि घटाई गई मात्राएँ उसी कार्य में आगे नहीं चाहिए होंगी
  • छोटे मूल्य की मद में सीमा 100% है, और नींव की मदों पर कोई सीमा नहीं
  अर्थात् नीचे जाते समय आप दो बातें याद रखिए: एसए ग्रेड, और दावा-रहित प्रमाणपत्र।
