Item 10 — EXTENSION OF THE DATE OF COMPLETIONमद 10 — पूर्णता तिथि का विस्तार

The item is extension to the date of completion of a contract for works or supplies.

• PHOD/HOD: FULL POWERS within their current powers of SIGNING contract agreements under item 6
• DRM, ADRM or CWM (in SAG): FULL POWERS within those same signing powers
• SG, JAG or Senior Scale with independent charge: FULL POWERS within those same signing powers

• THE NOTES
  • Finance concurrence is NOT necessary
  • The extension is governed by CLAUSE 17 of the GCC
  • For a service contract it is governed by the GCC of service contracts
  • The authority is PARA 1266 and PARA 1267 of the Engineering Code, with PARA 445 of the Stores Code Volume I
  So from here on the measure is the SIGNING power, and you should carry item 6 with you.

यह मद कार्यों या आपूर्ति की संविदा की पूर्णता तिथि बढ़ाना है।

• पीएचओडी/एचओडी: मद 6 के अंतर्गत करार पर हस्ताक्षर की अपनी प्रचलित शक्तियों के भीतर पूर्ण शक्तियाँ

  अर्थात् यहाँ से माप हस्ताक्षर की शक्ति है, और मद 6 आप साथ लेकर चलिए।

Item 11(A) and (B) — ADVANCES TO CONTRACTORSमद 11(A) और (B) — ठेकेदारों को अग्रिम

The item covers the mobilisation advance and the advance against new plant and machinery.

• Mobilisation advance, PHOD: FULL POWERS as per the terms of the accepted tender
• DRM or CWM (in SAG): FULL POWERS as per the terms of the accepted tender
• Divisional and headquarters officers: NIL
• Advance against new plant and machinery: the same three entries, on the same terms

• THE NOTES
  • Finance concurrence is NOT necessary
  • The grant of advances is restricted to works that are capital intensive and specialised in nature
  • It is further restricted to HIGH VALUE tenders of RS 25 CRORE and above
  • Suitable provisions go into the special conditions of the tender, following item 48 of the GM's delegation
  • The conditions and the method of recovery of interest follow ACS 46 and ACS 54 to PARA 1264 of the Engineering Code
  So an advance is not for every contract, and you should attach Rs 25 crore to it.

यह मद संचालन अग्रिम और नए संयंत्र तथा मशीनरी के विरुद्ध अग्रिम को शामिल करती है।

• संचालन अग्रिम, पीएचओडी: स्वीकृत निविदा की शर्तों के अनुसार पूर्ण शक्तियाँ
• मंडल रेल प्रबंधक या एसएजी के सीडब्ल्यूएम: स्वीकृत निविदा की शर्तों के अनुसार पूर्ण शक्तियाँ
• मंडल और मुख्यालय अधिकारी: शून्य
• नए संयंत्र और मशीनरी के विरुद्ध अग्रिम: वही तीन प्रविष्टियाँ, उन्हीं शर्तों पर

• नोट
  • वित्त सहमति आवश्यक नहीं है
  • अग्रिम देना उन्हीं कार्यों तक सीमित है जो पूँजी प्रधान और विशेषीकृत प्रकृति के हों
  • यह 25 करोड़ रुपये और उससे ऊपर की उच्च मूल्य निविदाओं तक और सीमित है
  • उपयुक्त प्रावधान निविदा की विशेष शर्तों में जाते हैं, महाप्रबंधक के प्रत्यायोजन की मद 48 के अनुसार
  • शर्तें और ब्याज की वसूली की रीति इंजीनियरिंग संहिता के पैरा 1264 के एसीएस 46 और एसीएस 54 से चलती हैं
  अर्थात् अग्रिम हर संविदा के लिए नहीं है, और उसके साथ आप 25 करोड़ रुपये जोड़िए।

Item 11(C) — GUARANTEE, EARNEST MONEY AND DEPOSITमद 11(C) — निष्पादन गारंटी, बयाना और प्रतिभूति जमा

The item releases what the contractor has lodged, in two parts.

• (i) Release of the performance guarantee: FULL POWERS within their current powers of signing agreements under item 6
• That reads the same in all three columns, down to Senior Scale with independent charge
• It is released after SATISFACTORY COMPLETION of the work, duly deducting dues if any
• No finance vetting or concurrence is required
• (ii) Refund of earnest money and the security deposit of contractors: FULL POWERS in all three columns, within those signing powers
• These are released after the MAINTENANCE PERIOD expires, duly deducting dues if any
• Here too no finance vetting or concurrence is required

So you should pair the guarantee with completion, and the deposit with the maintenance period.यह मद ठेकेदार की जमा की गई राशि लौटाती है, दो भागों में।

• (i) निष्पादन गारंटी की वापसी: मद 6 के अंतर्गत करार पर हस्ताक्षर की प्रचलित शक्तियों के भीतर पूर्ण शक्तियाँ
• यह तीनों स्तंभों में एक जैसा पढ़ा जाता है, स्वतंत्र प्रभार वाले वरिष्ठ स्केल तक
• यह कार्य के संतोषजनक पूरा होने के बाद लौटाई जाती है, देय राशि काटकर
• इसमें वित्त की जाँच या सहमति आवश्यक नहीं
• (ii) ठेकेदारों की बयाना राशि और प्रतिभूति जमा की वापसी: उन्हीं हस्ताक्षर शक्तियों के भीतर तीनों स्तंभों में पूर्ण शक्तियाँ
• ये अनुरक्षण अवधि बीतने के बाद लौटाई जाती हैं, देय राशि काटकर
• यहाँ भी वित्त की जाँच या सहमति आवश्यक नहीं

अर्थात् गारंटी को आप पूर्णता से, और जमा को अनुरक्षण अवधि से जोड़िए।

Item 11(D) — LIQUIDATED DAMAGES AND TOKEN PENALTYमद 11(D) — परिनिर्धारित क्षति और सांकेतिक दंड

The item has three sub-items, all resting on Clause 17B of the GCC.

• (i) Determination of the amount of liquidated damages recoverable from a contractor failing to fulfil a works contract
• (ii) Levy of a token penalty recoverable from a contractor while granting an extension under Clause 17B
• (iii) Waiver of liquidated damages or of the token penalty recovered from contractors
• In each, all three columns hold FULL POWERS within their current powers of signing agreements under item 6

• THE NOTES
  • Finance concurrence is NOT necessary
  • The TOKEN PENALTY shall be QUANTIFIED
  • The authority is PARA 1267 of the Engineering Code with Clause 17B of the GCC
  So the same officer levies and waives, and you should notice finance stands outside it.

इस मद में तीन उप-मदें हैं, और तीनों जीसीसी के खंड 17बी पर टिकी हैं।

• (i) संविदा पूरी न करने वाले ठेकेदार से वसूली योग्य परिनिर्धारित क्षति की राशि तय करना
• (ii) खंड 17बी में अवधि बढ़ाते समय ठेकेदार से वसूली योग्य सांकेतिक दंड लगाना
• (iii) ठेकेदारों से वसूली गई परिनिर्धारित क्षति या सांकेतिक दंड की छूट
• हर एक में तीनों स्तंभों को मद 6 के अंतर्गत हस्ताक्षर की प्रचलित शक्तियों के भीतर पूर्ण शक्तियाँ हैं

• नोट
  • वित्त सहमति आवश्यक नहीं है
  • सांकेतिक दंड की राशि निश्चित की जाएगी
  • प्राधिकार इंजीनियरिंग संहिता का पैरा 1267 और जीसीसी का खंड 17बी है
  अर्थात् लगाने वाला और छोड़ने वाला एक ही अधिकारी है, और वित्त इससे बाहर है — यह आप देखिए।

Item 11(E) — FORFEITURE OF EARNEST MONEY AND SECURITY DEPOSITमद 11(E) — बयाना और प्रतिभूति जमा की जब्ती

The item is forfeiture of the earnest money and security deposit, and encashment of the performance guarantee for works.

• PHOD/HOD: FULL POWERS within their current powers of signing agreements under item 6
• DRM, ADRM or CWM (in SAG): FULL POWERS within those signing powers
• SG, JAG or Senior Scale with independent charge: FULL POWERS within those signing powers
• For contracts accepted by the GM and higher authority, the PHOD exercises these powers

• WHAT THE SOURCE SAYS TWICE
  • The REMARKS against this item say finance concurrence IS necessary
  • The NOTES printed below the item say finance concurrence is NOT necessary, and both readings stand in the same schedule
• THE REST OF THE NOTES
  • The contract signing authority forfeits the security deposit and advises associate accounts IN WRITING
  • The amount is credited to EARNINGS in the same month, with a copy of the advice to the contractor
  • Encashment of the performance guarantee is advised in writing too, realised from the bank and credited to earnings in the same month
  • The authority is PARA 1243 and PARA 1244 of the Engineering Code
  So where the schedule says two things, you should carry both and say which is which.

यह मद बयाना राशि तथा प्रतिभूति जमा की जब्ती, और कार्यों की निष्पादन गारंटी भुनाने की है।

• पीएचओडी/एचओडी: मद 6 के अंतर्गत हस्ताक्षर की प्रचलित शक्तियों के भीतर पूर्ण शक्तियाँ

  • इस मद के सामने टिप्पणी कहती है कि वित्त सहमति आवश्यक है
  • मद के नीचे छपे नोट कहते हैं कि वित्त सहमति आवश्यक नहीं, और दोनों पाठ एक ही अनुसूची में खड़े हैं
• शेष नोट
  • संविदा पर हस्ताक्षर करने वाला प्राधिकारी प्रतिभूति जमा जब्त करता है और सहयोगी लेखा को लिखित में सूचित करता है
  • राशि उसी माह आय में जमा होती है, और सूचना की एक प्रति ठेकेदार को जाती है
  • निष्पादन गारंटी भुनाने की सूचना भी लिखित में जाती है, राशि बैंक से वसूलकर उसी माह आय में जमा होती है
  • प्राधिकार इंजीनियरिंग संहिता का पैरा 1243 और पैरा 1244 है
  अर्थात् जहाँ अनुसूची दो बातें कहे, वहाँ दोनों लेकर आप बताइए कि कौन-सी कहाँ से है।

Item 12 — CANCELLING OR TERMINATING A CONTRACTमद 12 — संविदा रद्द या समाप्त करना

The item is to cancel or terminate contracts in accordance with the conditions of the contract.

• PHOD/HOD: FULL POWERS within their current powers of signing agreements under item 6
• DRM, ADRM or CWM (in SAG): FULL POWERS within those signing powers
• SG, JAG or Senior Scale with independent charge: FULL POWERS within those signing powers

• THE NOTES
  • No finance concurrence is required for determination of a contract under CLAUSE 62 of the GCC
  • Finance concurrence IS necessary for determination under CLAUSE 61 of the GCC
  • The cancellation or termination is conveyed to the contractor under the signature of an authority NOT LOWER in rank than the contract signing authority
  • The authority is PARA 1270 of the Engineering Code
  So you should separate the two clauses: 62 without finance, 61 with it.

यह मद संविदा की शर्तों के अनुसार संविदा रद्द या समाप्त करने की है।

• पीएचओडी/एचओडी: मद 6 के अंतर्गत हस्ताक्षर की प्रचलित शक्तियों के भीतर पूर्ण शक्तियाँ

  • जीसीसी के खंड 61 में समाप्ति पर वित्त सहमति आवश्यक है
  • रद्द या समाप्त करना ठेकेदार को उस प्राधिकारी के हस्ताक्षर से बताया जाता है जो संविदा पर हस्ताक्षर करने वाले से नीचे का न हो
  • प्राधिकार इंजीनियरिंग संहिता का पैरा 1270 है
  अर्थात् दोनों खंड आप अलग रखिए: 62 बिना वित्त, 61 वित्त के साथ।

Item 13 — REVOCATION OF TERMINATIONमद 13 — समाप्ति की वापसी

The item answers whether a terminated contract can be brought back, in two situations.

• (A) After the 48 HOURS notice but before the final termination notice under Clause 62 of the GCC
• There the contract is ALIVE till the notice of termination is issued, so it needs no revival during that period
• The notice may be WITHDRAWN if the contractor demonstrates an earnest intention to restart the work
• That satisfaction is the AGREEMENT SIGNING AUTHORITY's to record
• (B) After the final termination notice has been issued
• Once the formal notice has gone, revival of the contract is possible ONLY AS A SINGLE TENDER
• That holds even if the revival is on the same terms and conditions

So you should answer by the notice: before it, withdraw; after it, only a single tender.यह मद बताती है कि समाप्त की गई संविदा लौट सकती है या नहीं, दो स्थितियों में।

• (A) जीसीसी के खंड 62 में 48 घंटे की सूचना के बाद, पर अंतिम समाप्ति सूचना से पहले
• वहाँ संविदा समाप्ति की सूचना जारी होने तक जीवित रहती है, इसलिए उस अवधि में उसे पुनर्जीवित करने की जरूरत नहीं
• सूचना वापस ली जा सकती है यदि ठेकेदार कार्य फिर शुरू करने की सच्ची मंशा दिखा दे
• यह संतुष्टि करार पर हस्ताक्षर करने वाले प्राधिकारी को दर्ज करनी है
• (B) अंतिम समाप्ति सूचना जारी होने के बाद
• औपचारिक सूचना चली जाने पर संविदा का पुनर्जीवन केवल एकल निविदा के रूप में संभव है
• यह तब भी लागू है जब पुनर्जीवन उन्हीं निबंधनों और शर्तों पर हो

अर्थात् उत्तर आप सूचना से दीजिए: उससे पहले वापसी, उसके बाद केवल एकल निविदा।
