Item 5(F) and (G) — REJECTED MATERIAL AND GROUND RENTमद 5(F) और (G) — अस्वीकृत सामग्री और भूमि किराया

The schedule runs from item 5(D) straight to item 5(F); no item 5(E) is printed in this section. Part (F) extends the time for removal of rejected materials, and waives the ground rent charges on them.

• PCMM and CMM: FULL POWERS; Dy CMM: up to RS 1 LAKH; SMM: Rs 50,000
• Depot officers: up to Rs 50,000
• A CERTIFICATE is recorded that the railway has suffered no loss on account of the waiver
• Finance concurrence is not necessary for that

• PART (G) — REFUND OF GROUND RENT
  • It refunds the ground rent on rejected supplies
  • PCMM, CMM and Dy CMM: FULL POWERS; SMM and AMM: Rs 50,000 each
  • Depot officers: up to Rs 50,000
  • PRIOR finance concurrence is necessary if the ground rent recovered exceeds RS 500
  So the waiver rests on a no-loss certificate, and you should send a refund above Rs 500 to finance.

Item 5(H) to (J) — THE SECURITY DEPOSIT AND THE ORDER ITSELFमद 5(H) से (J) — प्रतिभूति जमा और स्वयं आदेश

Part (H) refunds the security deposit, and the deposit for the value of raw materials issued for fabrication.

• PCMM: FULL POWERS; CMM, Dy CMM, SMM and AMM: FULL POWERS for contracts within their powers of acceptance
• Field Stores Officers and their accepting authorities: up to their power of acceptance
• The refund is subject to the contract being SATISFACTORILY COMPLETED
• (I) FORFEITURE of the security deposit, in accordance with the conditions of the contract
• The same columns carry full powers, each for contracts within his own powers of acceptance
• The authority is item 15(ii) of PARA 132-S
• (J) CANCELLATION OF ORDERS: full powers again, each within his own powers of acceptance
• The authority there is item 5 of PARA 132-S
• (K) Acceptance of claims settled by arbitration of a contract dispute is referred to PART A of this SOP

So a refund waits on completion and a forfeiture on the contract's words, and you should read the contract before either.भाग (H) प्रतिभूति जमा लौटाता है, और गढ़ाई के लिए दिए गए कच्चे माल के मूल्य की जमा भी।

• (K) संविदा विवाद के मध्यस्थता से निपटे दावों की स्वीकृति इस एसओपी के भाग A को भेजी गई है

अर्थात् वापसी पूर्णता पर और जब्ती संविदा के शब्दों पर टिकी है, और दोनों से पहले संविदा आप पढ़िए।

Note x — AN ARBITRATOR'S AWARD GOES UPWARDनोट x — मध्यस्थ का अधिनिर्णय ऊपर जाता है

The note follows item 5(K) after the award is accepted.

• Particulars of the arbitrator's awards accepted are put up to the GM in the form of a STATEMENT
• That statement is made for each half year, ending 30 SEPTEMBER and 31 MARCH
• Some cases go further, to the RAILWAY BOARD itself
• One is where the award exceeds by MORE THAN RS 10 LAKH the amount the administration considered due before the proceedings began
• Another is where deficiencies came to light in the general conditions of contract
• So is a deficiency in the procedure the Railway Board has laid down

So an award is reported twice over, and you should know which of the two reports you are making.यह नोट अधिनिर्णय स्वीकार होने के बाद मद 5(K) के पीछे चलता है।

• स्वीकार किए गए मध्यस्थ अधिनिर्णयों का विवरण महाप्रबंधक के समक्ष एक विवरणी के रूप में रखा जाता है
• वह विवरणी हर छमाही की बनती है, जो 30 सितंबर और 31 मार्च को समाप्त होती है

अर्थात् अधिनिर्णय की सूचना दो बार जाती है, और आप कौन-सी सूचना दे रहे हैं यह आप जानिए।

Item 5(L) — WAIVER OF RISK PURCHASE AND ARBITRATION CLAUSESमद 5(L) — जोखिम खरीद और मध्यस्थता उपबंधों की छूट

Part (L) waives the operation of the clauses on risk purchases, liquidated damages and arbitration. It is a POST-CONTRACT waiver of clauses in the IRS conditions of contract.

• PCMM: FULL POWERS, subject to the remarks; CMM: full powers for contracts subject to the remarks
• Dy CMM, SMM, AMM and the Other Officers column: NIL
• The powers exist to avoid DISPROPORTIONATE ADMINISTRATIVE EXPENDITURE in small recoveries
• Up to a contract value of RS 15 LAKH the PCMM may waive those clauses WITHOUT finance concurrence
• Above Rs 15 lakh the PCMM or CMM may waive a risk purchase by imposing GENERAL DAMAGES at 10% of the outstanding value, without finance concurrence
• Above Rs 15 lakh he may waive it WITHOUT imposing general damages, with finance concurrence
• These powers are exercised by officers of the Stores and Engineering departments dealing with track fitting procurement
• Action such as forfeiture of the security deposit and deregistration is taken on the merit of each case

So a waiver is the cheaper of two courses and not a pardon, and you should say which of the two Rs 15 lakh readings applies.भाग (L) जोखिम खरीद, परिनिर्धारित क्षति और मध्यस्थता के उपबंधों का संचालन छोड़ता है। यह आईआरएस संविदा शर्तों के उपबंधों की संविदा-उपरांत छूट है।

• 15 लाख रुपये से ऊपर वे उसे बिना सामान्य क्षति लगाए, वित्त सहमति के साथ, छोड़ सकते हैं
• ये शक्तियाँ ट्रैक फिटिंग की खरीद देखने वाले भंडार और इंजीनियरी विभाग के अधिकारी प्रयोग करते हैं
• प्रतिभूति जमा की जब्ती और पंजीकरण रद्द करने जैसी कार्रवाई हर मामले के गुण पर की जाती है

अर्थात् छूट क्षमा नहीं, दो में सस्ता रास्ता है, और 15 लाख रुपये के दोनों पाठों में कौन लगता है यह आप कहिए।
