Item 5(A)(i) — OPEN TENDERS AND THE TWO PACKET SYSTEMमद 5(A)(i) — खुली निविदाएँ और दो पैकेट प्रणाली

Item 5 covers a works contract for approved and sanctioned works, supplies related to sanctioned works, and zonal contracts. Part (A) is the CALLING of tenders.

• Open tenders: PHOD or HOD FULL POWERS
• DRM, ADRM or CWM (in SAG): FULL POWERS; JAG: FULL POWERS
• A JAG officer's power to call tenders is restricted to the value of tenders accepted at SAG level

• THE TWO PACKET SYSTEM
  • Where a works tender needs techno-economic evaluation, two packets are the norm as far as possible
  • For works tenders valuing more than RS 10 CRORE the two packet system is MANDATORY
  • Within the acceptance powers of SAG, DRM, ADRM or CWM and above Rs 10 crore, a single packet may still be used
  • An executive not below SAG records the reasons in writing, with associate finance, that it is advantageous
  • Beyond those acceptance powers and above Rs 10 crore, an executive not below HAG decides in consultation with the FA&CAO
  • For tenders up to Rs 10 crore the tender inviting authority decides, with associate finance's concurrence
  • All zonal contracts should be OPEN tenders, and for service contracts the GCC for Services is followed
  So you should remember Rs 10 crore as the line where two packets stop being a choice.

मद 5 अनुमोदित और स्वीकृत कार्यों की कार्य संविदा, स्वीकृत कार्यों से जुड़ी आपूर्ति, तथा जोनल संविदाओं को शामिल करती है। भाग (A) निविदाएँ बुलाना है।

• खुली निविदाएँ: पीएचओडी या एचओडी पूर्ण शक्तियाँ
• मंडल रेल प्रबंधक, एडीआरएम या एसएजी के सीडब्ल्यूएम: पूर्ण शक्तियाँ; जेएजी: पूर्ण शक्तियाँ
• जेएजी अधिकारी की निविदा बुलाने की शक्ति एसएजी स्तर पर स्वीकार होने वाली निविदाओं के मूल्य तक सीमित है

• दो पैकेट प्रणाली
  • जिस कार्य निविदा में तकनीकी-आर्थिक मूल्यांकन चाहिए, वहाँ यथासंभव दो पैकेट ही नियम है
  • 10 करोड़ रुपये से अधिक मूल्य की कार्य निविदाओं में दो पैकेट प्रणाली अनिवार्य है
  • एसएजी, मंडल रेल प्रबंधक, एडीआरएम या सीडब्ल्यूएम की स्वीकृति शक्तियों के भीतर और 10 करोड़ रुपये से ऊपर, एक पैकेट फिर भी चल सकता है
  • एसएजी से नीचे का न हो ऐसा कार्यपालक, सहयोगी वित्त के साथ, लिखित कारण दर्ज करता है कि यह लाभकर है
  • उन स्वीकृति शक्तियों से बाहर और 10 करोड़ रुपये से ऊपर, एचएजी से नीचे का न हो ऐसा कार्यपालक वित्त सलाहकार एवं मुख्य लेखाधिकारी से परामर्श करके तय करता है
  • 10 करोड़ रुपये तक की निविदाओं में निविदा बुलाने वाला प्राधिकारी, सहयोगी वित्त की सहमति से, तय करता है
  • सभी जोनल संविदाएँ खुली निविदा से होनी चाहिए, और सेवा संविदाओं में सेवाओं की जीसीसी लागू होती है
  अर्थात् 10 करोड़ रुपये वह रेखा है जहाँ दो पैकेट विकल्प नहीं रहते, यह आप याद रखिए।

Item 5(A)(i) — NOTICE PERIOD AND ELIGIBILITY CRITERIAमद 5(A)(i) — सूचना अवधि और पात्रता मानदंड

The same item's notes govern how long the notice runs and who may relax the eligibility.

• Sufficient notice must be given, and for LARGE works not less than A MONTH
• That period is departed from only in the most exceptional circumstances, and then in consultation with the PFA
• E-tenders up to and including Rs 1 crore: reduced to 21 DAYS by CAO, PHOD, CHOD, DRM or CWM (in SAG) without finance concurrence
• The same tenders: reduced to 14 DAYS with the concurrence of associate finance
• E-tenders above Rs 1 crore and up to Rs 2 crore: reduced to 14 DAYS by CAO, DRM or CWM (in SAG) with associate finance

• ELIGIBILITY AND PRE-VETTING
  • Eligibility criteria need NOT be stipulated for open tenders up to RS 50 LAKH each
  • Relaxation above Rs 50 lakh in open line: the GM's PERSONAL approval with the PFA's concurrence
  • In the construction organisation: CAO/C's personal approval with FA&CAO/C's personal concurrence
  • For inserting eligibility criteria in specialised tenders the PHOD's decision is FINAL
  • The minimum eligibility criteria follow Railway Board guidelines; a change needs associate finance and the GM's or CAO/Con's approval
  • Pre-vetting of tender schedules is not necessary, except in rare urgent cases where tenders are called without a sanctioned detailed estimate
  • It is also not necessary for zonal works and open line revenue works up to Rs 5 lakh, for which detailed estimates need not be framed
  • In urgency, open tenders may be called before the detailed estimate is sanctioned with the DRM's, PHOD's or CHOD's approval
  • In that case the LETTER OF ACCEPTANCE issues only after the detailed estimate is sanctioned
  So you should hold one month, 21 days and 14 days, and the Rs 50 lakh eligibility line.

इसी मद के नोट तय करते हैं कि सूचना कितने दिन चलेगी और पात्रता में ढील कौन दे सकता है।

• पर्याप्त सूचना देनी होगी, और बड़े कार्यों में एक माह से कम नहीं
• उस अवधि से हटना सबसे असाधारण परिस्थितियों में ही होता है, और तब भी पीएफए से परामर्श करके
• 1 करोड़ रुपये तक की ई-निविदाएँ: सीएओ, पीएचओडी, सीएचओडी, मंडल रेल प्रबंधक या एसएजी के सीडब्ल्यूएम बिना वित्त सहमति 21 दिन तक घटा सकते हैं
• वही निविदाएँ: सहयोगी वित्त की सहमति से 14 दिन तक
• 1 करोड़ रुपये से ऊपर और 2 करोड़ रुपये तक की ई-निविदाएँ: सीएओ, मंडल रेल प्रबंधक या एसएजी के सीडब्ल्यूएम सहयोगी वित्त के साथ 14 दिन तक

• पात्रता और पूर्व-जाँच
  • हर एक 50 लाख रुपये तक की खुली निविदाओं में पात्रता मानदंड रखना आवश्यक नहीं
  • खुली लाइन में 50 लाख रुपये से ऊपर ढील: महाप्रबंधक का स्वयं का अनुमोदन और पीएफए की सहमति
  • निर्माण संगठन में: सीएओ/सी का स्वयं का अनुमोदन और वित्त सलाहकार एवं मुख्य लेखाधिकारी(निर्माण) की स्वयं की सहमति
  • विशेषीकृत निविदाओं में पात्रता मानदंड जोड़ने पर पीएचओडी का निर्णय अंतिम है
  • न्यूनतम पात्रता मानदंड रेलवे बोर्ड के दिशानिर्देशों से आते हैं; बदलाव पर सहयोगी वित्त और महाप्रबंधक या सीएओ/निर्माण का अनुमोदन चाहिए
  • निविदा अनुसूचियों की पूर्व-जाँच आवश्यक नहीं, सिवाय उन विरल अत्यावश्यक मामलों के जहाँ विस्तृत अनुमान स्वीकृत होने से पहले निविदाएँ बुलाई जाती हैं
  • जोनल कार्यों और खुली लाइन के 5 लाख रुपये तक के राजस्व कार्यों में भी आवश्यक नहीं, क्योंकि उनके विस्तृत अनुमान बनाने की जरूरत नहीं
  • अत्यावश्यकता में मंडल रेल प्रबंधक, पीएचओडी या सीएचओडी के अनुमोदन से विस्तृत अनुमान की स्वीकृति से पहले खुली निविदाएँ बुलाई जा सकती हैं
  • ऐसे मामले में स्वीकृति पत्र विस्तृत अनुमान स्वीकृत होने के बाद ही जारी होता है
  अर्थात् आप एक माह, 21 दिन और 14 दिन, तथा पात्रता की 50 लाख रुपये की रेखा याद रखिए।

Item 5(A)(ii) — LIMITED TENDERS FROM THE APPROVED LISTमद 5(A)(ii) — अनुमोदित सूची से सीमित निविदाएँ

The item is limited tenders from the approved list for works contracts.

• PHOD/CHOD: more than Rs 1.5 crore and up to RS 7.5 CRORE
• HOD: more than Rs 37.5 lakh and up to Rs 1.5 crore
• DRM, ADRM or CWM (in SAG): more than Rs 37.5 lakh and up to Rs 1.5 crore
• JAG and JAG(SG): up to RS 37.5 LAKH

• THE NOTES
  • At least 10 NAMES should be on the approved list of contractors
  • The tender notice period should not be less than 14 DAYS
  • Pre-vetting of schedules is not necessary, on the same terms as open tenders
  • The schedules are prepared on the rates, quantities and scope in the sanctioned estimate
  So you should read the approved list as ten names, and the notice as fourteen days.

यह मद कार्य संविदाओं के लिए अनुमोदित सूची से सीमित निविदाएँ बुलाना है।

• पीएचओडी/सीएचओडी: 1.5 करोड़ रुपये से अधिक और 7.5 करोड़ रुपये तक
• एचओडी: 37.5 लाख रुपये से अधिक और 1.5 करोड़ रुपये तक
• मंडल रेल प्रबंधक, एडीआरएम या एसएजी के सीडब्ल्यूएम: 37.5 लाख रुपये से अधिक और 1.5 करोड़ रुपये तक
• जेएजी और जेएजी(एसजी): 37.5 लाख रुपये तक

• नोट
  • ठेकेदारों की अनुमोदित सूची में कम से कम 10 नाम होने चाहिए
  • निविदा सूचना अवधि 14 दिन से कम नहीं होनी चाहिए
  • अनुसूचियों की पूर्व-जाँच आवश्यक नहीं, वही शर्तें जो खुली निविदाओं में हैं
  • अनुसूचियाँ स्वीकृत अनुमान की दरों, मात्राओं और कार्य के विस्तार पर बनती हैं
  अर्थात् अनुमोदित सूची को आप दस नाम, और सूचना को चौदह दिन पढ़िए।

Item 5(A)(iii) — SPECIAL LIMITED TENDERSमद 5(A)(iii) — विशेष सीमित निविदाएँ

The item covers works of a specialised nature and works of an urgent nature.

• Works of a specialised nature: PHOD or CAO/C FULL POWERS
• Works of an urgent nature: CAO/C FULL POWERS
• DRM, ADRM or CWM (in SAG): up to RS 10 LAKH for either kind
• Divisional and headquarters officers: NIL

• THE NOTES
  • Associate finance concurrence is necessary
  • CAO/C with the FA&CAO/C's concurrence may invite special limited tenders for ALL types of work on the merit of the case
  • They are invited from specialised and reputed contractors, organisations or agencies
  • The tenderers should preferably be MORE THAN SIX, but NOT LESS THAN FOUR
  • The tender notice period should not be less than 14 DAYS
  So you should carry six and four together, because the paper asks for the minimum.

यह मद विशेषीकृत प्रकृति के कार्यों और अत्यावश्यक प्रकृति के कार्यों को शामिल करती है।

• विशेषीकृत प्रकृति के कार्य: पीएचओडी या सीएओ/सी पूर्ण शक्तियाँ
• अत्यावश्यक प्रकृति के कार्य: सीएओ/सी पूर्ण शक्तियाँ
• मंडल रेल प्रबंधक, एडीआरएम या एसएजी के सीडब्ल्यूएम: दोनों प्रकार में 10 लाख रुपये तक
• मंडल और मुख्यालय अधिकारी: शून्य

• नोट
  • सहयोगी वित्त की सहमति आवश्यक है
  • सीएओ/सी, वित्त सलाहकार एवं मुख्य लेखाधिकारी(निर्माण) की सहमति से, मामले के गुण पर सभी प्रकार के कार्यों के लिए विशेष सीमित निविदाएँ बुला सकते हैं
  • ये विशेषीकृत और प्रतिष्ठित ठेकेदारों, संगठनों या एजेंसियों से बुलाई जाती हैं
  • निविदादाता छह से अधिक हों तो अच्छा, पर चार से कम नहीं
  • निविदा सूचना अवधि 14 दिन से कम नहीं होनी चाहिए
  अर्थात् छह और चार को आप साथ रखिए, क्योंकि प्रश्न न्यूनतम पूछता है।
