Item 3.2(J) — A QUOTATION SUBJECT TO VARIATIONमद 3.2(J) — परिवर्तन के अधीन कोटेशन

The item accepts quotations subject to variations in prices, rates of exchange, customs duty and the like. It covers indigenous and imported stores alike.

• PCMM, CMM, Dy CMM, SMM and AMM: up to the limit of their POWERS OF PURCHASE
• Field Stores Officers and their accepting authorities: up to their power of acceptance

• WHAT MAY VARY IN INDIGENOUS STORES
  • Steel prices, as the main steel producers promulgate them from time to time
  • Prices of non-ferrous metals, and excise duty
  • Wage escalation, and the special price adjustment of the BEMA or IEMA Group
  • The powers of the Dy CMM and lower officers here do NOT apply to a case of WAGE ESCALATION
• WHAT MAY VARY IN IMPORTED STORES
  • The FOB cost of proprietary articles
  • The cost of raw materials that are subject to sharp price fluctuations
  • Exchange rates, and import duties, and the same BEMA or IEMA special price adjustment
  • The powers of the SMM and AMM do NOT apply to those special price adjustment clauses
  • The STANDARD VARIATION CLAUSE the Board specifies is adopted, and finance concurrence is necessary
  So the officer's grade is barred from two kinds of variation, and you should check the kind before the figure.

यह मद उन कोटेशनों को स्वीकार करती है जो कीमतों, विनिमय दरों, सीमा शुल्क आदि में परिवर्तन के अधीन हों। इसमें स्वदेशी और आयातित भंडार दोनों आते हैं।

  • बोर्ड का बताया मानक परिवर्तन उपबंध अपनाया जाता है, और वित्त सहमति आवश्यक है
  अर्थात् अधिकारी का ग्रेड दो प्रकार के परिवर्तनों से रोका गया है, और आँकड़े से पहले प्रकार आप देखिए।

Item 3.2(J) — A STATUTORY VARIATION IN THE ORDERमद 3.2(J) — आदेश में वैधानिक परिवर्तन

The note carries the item into the purchase order that already holds a statutory variation clause.

• A modification of such an order, involving the statutory levies, may be approved with finance concurrence
• The TENDER ACCEPTING AUTHORITY approves it in general
• Where that accepting authority is the AGM or the GM, the PCMM approves it instead
• The change in the statutory levies must have occurred WITHIN THE ORIGINAL CURRENCY of the contract

So a statutory change is met inside the contract's own life, and you should check that life first.यह नोट मद को उस क्रय आदेश तक ले जाता है जिसमें पहले से वैधानिक परिवर्तन उपबंध हो।

• ऐसे आदेश में वैधानिक उद्ग्रहणों से जुड़ा संशोधन वित्त सहमति के साथ अनुमोदित हो सकता है
• सामान्यतः उसे निविदा स्वीकार करने वाला प्राधिकारी अनुमोदित करता है
• जहाँ वह स्वीकार प्राधिकारी अपर महाप्रबंधक या महाप्रबंधक हों, वहाँ उसे पीसीएमएम अनुमोदित करते हैं
• वैधानिक उद्ग्रहणों में वह परिवर्तन संविदा की मूल अवधि के भीतर हुआ होना चाहिए

अर्थात् वैधानिक परिवर्तन संविदा की अपनी आयु के भीतर निपटता है, और वह आयु पहले आप देखिए।

Item 3.2(K) — ADVANCE PAYMENT ON A PROFORMA INVOICEमद 3.2(K) — प्रोफार्मा बीजक पर अग्रिम भुगतान

Part (K)(i) pays 100 per cent in advance to IISCO, SAIL, RINL and TISCO on a proforma invoice.

• PCMM, CMM and Dy CMM: up to the limit of their powers of purchase; SMM and AMM: NIL
• (ii) 100 per cent to IOC, BPC, HPC, Balmer Lawrie and other oil lubricant PSUs, WITH finance concurrence
• PCMM: RS 10 CRORE; CMM: Rs 5 crore; Dy CMM: RS 45 LAKH; the rest: Nil
• (iii) 100% advance payment against a proforma invoice in two cases
• (a) A DIRECT ACCEPTANCE case with finance concurrence: PCMM up to RS 25 LAKH; CMM up to Rs 15 lakh
• (b) A TENDER COMMITTEE case without finance concurrence: PCMM up to his powers of acceptance
• If the tender committee has NOT recommended it, finance concurrence is required
• For PAC items only, on the PERSONAL SANCTION of the DRM or CWM: up to the Depot or Divisional Stores Officer's powers of purchase

So the steel mills and the oil companies are on different footings, and you should name the company before the figure.भाग (K)(i) इस्को, सेल, आरआईएनएल और टिस्को को प्रोफार्मा बीजक पर 100 प्रतिशत अग्रिम देता है।

• (iii) प्रोफार्मा बीजक पर 100% अग्रिम भुगतान दो मामलों में
• (a) वित्त सहमति सहित सीधी स्वीकृति का मामला: पीसीएमएम 25 लाख रुपये तक; सीएमएम 15 लाख रुपये तक
• (b) बिना वित्त सहमति निविदा समिति का मामला: पीसीएमएम अपनी स्वीकृति की शक्तियों तक
• यदि निविदा समिति ने उसकी सिफारिश न की हो, तो वित्त सहमति आवश्यक है
• केवल PAC मदों में, मंडल रेल प्रबंधक या सीडब्ल्यूएम की व्यक्तिगत स्वीकृति पर: डिपो या मंडलीय भंडार अधिकारी की क्रय शक्तियों तक

अर्थात् इस्पात संयंत्र और तेल कंपनियाँ अलग-अलग आधार पर हैं, और आँकड़े से पहले कंपनी आप बताइए।

Note xii — THE CONDITIONS ON A 100% ADVANCEनोट xii — 100% अग्रिम की शर्तें

The note sets six conditions for the 100 per cent advance under item 3.2(K)(iii).

• A supplier not in the list of reputed firms the AGM approves must be of good reputation
• He may instead have a good record of past performance with the railways
• He should be prepared to honour the guarantee and warranty clauses
• That matters where material taken in good faith is later found to be of sub-standard quality
• He should be prepared to replace any material damaged in transit from his premises to the consignee's
• That applies where the order carries free transport after delivery is taken at the firm's premises
• The specification should allow ON-THE-SPOT consignee inspection, without elaborate post-delivery testing
• Material of a reputed brand or of a well-established manufacturer is preferred, certified to ISI or another standard
• Even for a supplier on the approved list, his CURRENT PERFORMANCE is verified before the advance is processed

So the advance rests on the supplier and not on the price, and you should verify his performance afresh.यह नोट मद 3.2(K)(iii) के 100 प्रतिशत अग्रिम पर छह शर्तें रखता है।

• जो आपूर्तिकर्ता अपर महाप्रबंधक की अनुमोदित प्रतिष्ठित फर्मों की सूची में न हो, वह अच्छी प्रतिष्ठा वाला होना चाहिए
• अथवा रेलों के साथ उसका पिछला निष्पादन अच्छा रहा हो
• उसे गारंटी और वारंटी के उपबंध निभाने को तैयार रहना चाहिए
• यह वहाँ मायने रखता है जहाँ सद्भाव में ली गई सामग्री बाद में घटिया निकले
• उसे अपने परिसर से परेषिती के परिसर तक मार्ग में क्षतिग्रस्त सामग्री बदलने को तैयार रहना चाहिए
• यह वहाँ लगता है जहाँ आदेश में फर्म के परिसर पर सुपुर्दगी के बाद मुफ्त परिवहन की शर्त हो
• विनिर्देश ऐसा हो कि मौके पर ही परेषिती निरीक्षण हो सके, बिना लंबी सुपुर्दगी-उपरांत जाँच के
• प्रतिष्ठित नाम या स्थापित निर्माता की सामग्री को वरीयता है, जो आईएसआई या अन्य मानक से प्रमाणित हो
• अनुमोदित सूची के आपूर्तिकर्ता का भी वर्तमान निष्पादन अग्रिम की कार्रवाई से पहले जाँचा जाता है

अर्थात् अग्रिम दाम पर नहीं, आपूर्तिकर्ता पर टिका है, और उसका निष्पादन नए सिरे से आप जाँचिए।

Item 3.2(L) to (O) — PAYMENT AGAINST AN INSPECTION CERTIFICATEमद 3.2(L) से (O) — निरीक्षण प्रमाणपत्र पर भुगतान

Part (L) pays 100 per cent in advance to a public sector undertaking, on an inspection certificate or bank guarantee and proof of dispatch.

• PCMM, CMM and Dy CMM: up to the limit of their powers of purchase
• Field Stores Officers: up to their power of acceptance; finance concurrence is required for Rs 25,000 and above
• (M) The same 100 per cent, for plant and machinery spares, proprietary items and special tools
• That is from Government or non-Government agencies, and the figure is RS 50,000 for the PCMM, CMM and Dy CMM alike
• (N) 98 PER CENT on an inspection certificate and proof of dispatch, for PSUs, other manufacturers and running contracts
• PCMM, CMM, Dy CMM and SMM: up to the limit of their powers of purchase; AMM: Nil
• (O) 95 PER CENT against an inspection certificate and a receipted delivery challan certified by a gazetted officer
• The balance 5 per cent is paid on receipt and acceptance, and the columns are those of part (N)
• Advance payments under (N) and (O) are allowed only to WELL-KNOWN FIRMS of commercial standing, in terms of PARA 2815-S

So the percentage falls as the proof gets weaker, and you should pair each figure with its document.भाग (L) सार्वजनिक क्षेत्र के उपक्रम को निरीक्षण प्रमाणपत्र या बैंक गारंटी और प्रेषण के प्रमाण पर 100 प्रतिशत अग्रिम देता है।

• पीसीएमएम, सीएमएम और डिप्टी सीएमएम: अपनी क्रय शक्तियों की सीमा तक
• क्षेत्रीय भंडार अधिकारी: अपनी स्वीकृति की शक्ति तक; 25,000 रुपये और उससे ऊपर वित्त सहमति चाहिए
• (M) वही 100 प्रतिशत, संयंत्र और मशीनरी के कल-पुर्जों, स्वामित्व वाली मदों और विशेष औजारों में
• वह सरकारी या गैर-सरकारी एजेंसियों से है, और पीसीएमएम, सीएमएम तथा डिप्टी सीएमएम तीनों का आँकड़ा 50,000 रुपये है
• (N) निरीक्षण प्रमाणपत्र और प्रेषण के प्रमाण पर 98 प्रतिशत, सार्वजनिक उपक्रमों, अन्य निर्माताओं और चालू संविदाओं में
• पीसीएमएम, सीएमएम, डिप्टी सीएमएम और एसएमएम: अपनी क्रय शक्तियों की सीमा तक; एएमएम: शून्य
• (O) निरीक्षण प्रमाणपत्र और राजपत्रित अधिकारी से प्रमाणित रसीदी सुपुर्दगी चालान पर 95 प्रतिशत
• शेष 5 प्रतिशत प्राप्ति और स्वीकृति पर चुकाया जाता है, और स्तंभ भाग (N) वाले ही हैं
• (N) और (O) के अग्रिम भुगतान केवल व्यापारिक प्रतिष्ठा वाली जानी-मानी फर्मों को, पैरा 2815-S के अनुसार, दिए जाते हैं

अर्थात् जैसे-जैसे प्रमाण कमजोर होता है प्रतिशत घटता है, और हर आँकड़े के साथ उसका दस्तावेज आप जोड़िए।

Item 3.2(P) and (Q) — CANCELLING A TENDER, AND A REFUNDमद 3.2(P) और (Q) — निविदा रद्द करना, और वापसी

Part (P) cancels tenders.

• PCMM, CMM, Dy CMM and SMM: up to the limit of their powers of purchase; AMM: NIL
• Field Stores Officers and their accepting authorities: up to their power of acceptance
• The authority is PARA 132-S
• Where it is decided to DROP the purchase after the tenders are opened, the appropriate tender committee's recommendation is obtained
• Where the value is within the direct acceptance limit, the case goes HIGHER
• It goes to an authority above the officer who authorised the invitation of tenders

• PART (Q) — REFUND OF THE COST OF TENDER FORMS
  • It refunds the cost of the tender forms sold to tenderers when the tender notice is WITHDRAWN
  • PCMM, CMM, Dy CMM and SMM: FULL POWERS; AMM: Nil
  • Field Stores Officers and their accepting authorities exercise the same powers as their headquarters counterparts
  • The refund does NOT apply to e-TENDERS, under the Board's letter of 31.07.2017
  So a dropped purchase goes one rung up, and you should not offer a refund on an e-tender.

भाग (P) निविदाएँ रद्द करता है।

• पीसीएमएम, सीएमएम, डिप्टी सीएमएम और एसएमएम: अपनी क्रय शक्तियों की सीमा तक; एएमएम: शून्य
• क्षेत्रीय भंडार अधिकारी और उनके स्वीकार प्राधिकारी: अपनी स्वीकृति की शक्ति तक
• प्राधिकार पैरा 132-S है
• जहाँ निविदाएँ खुलने के बाद खरीद छोड़ने का निर्णय हो, वहाँ उपयुक्त निविदा समिति की सिफारिश ली जाती है
• जहाँ मूल्य सीधी स्वीकृति की सीमा में हो, वहाँ मामला ऊपर जाता है
• वह निविदा बुलाने का प्राधिकार देने वाले अधिकारी से ऊपर के प्राधिकारी को जाता है

• भाग (Q) — निविदा प्रपत्रों की लागत की वापसी
  • यह निविदा सूचना वापस लेने पर निविदाकारों को बेचे गए प्रपत्रों की लागत लौटाता है
  • पीसीएमएम, सीएमएम, डिप्टी सीएमएम और एसएमएम: पूर्ण शक्तियाँ; एएमएम: शून्य
  • क्षेत्रीय भंडार अधिकारी और उनके स्वीकार प्राधिकारी अपने मुख्यालय समकक्षों जैसी ही शक्तियाँ रखते हैं
  • बोर्ड के 31.07.2017 के पत्र में यह वापसी ई-निविदा पर लागू नहीं है
  अर्थात् छोड़ी हुई खरीद एक सीढ़ी ऊपर जाती है, और ई-निविदा पर वापसी आप मत दीजिए।
