Part (A) sanctions proposals for outsourcing, and the schedule then lists nineteen activities.

• PHOD: FULL POWERS; DRM or CWM: FULL POWERS; divisional and headquarters officers: NIL
• Upkeep and maintenance of rolling stock — coaches, wagons, locomotives, EMU, DEMU, trainset, MEMU, tower cars, power car, SPART, ART and ARMV
• Upkeep and maintenance of stations, mechanised cleaning included; of running rooms and crew lobbies
• Rag picking and garbage disposal; the On Board Housekeeping Scheme; the Clean Train Station scheme
• Upkeep of coaching depots, loco sheds, car sheds, workshops, railway canteens, installations, premises and buildings
• Upkeep of crew lobbies including CTR data entry; of offices, rest houses, training institutes, hospitals, colonies and major installations
• Manning of waiting halls and retiring rooms, operation of the PA system and passenger information systems, and face-to-face enquiry
• Supply of subsidised food in running rooms; housekeeping including cooking in the camp coaches of track machines
• Manning and upkeep of non-core electric traction assets such as sub-stations, PSI and OHE
• Non-traction assets like pump houses, lifts and escalators are in the same entry
• Provision of AC coach attendants and AC coach mechanics; manning of the power car; box boy and sand filling in locomotives
• Maintenance activities of various assets of the technical departments, and upkeep of non-core assets
• Any other activity planned to be outsourced as the PHOD or CHOD decides

  • (B) Security guards for non-core activities: CSC FULL POWERS
  • (C) Safety related track maintenance works with the technical approval of the PCE: PCE FULL POWERS; DRM FULL POWERS

  • (E) Outsourcing of data entry operators: PHOD FULL POWERS; DRM or SAG FULL POWERS
  So the list is long but the powers are short, and you should read part (A) as PHOD and DRM alone.

Item 37 — THE CONDITIONS ON AN OUTSOURCING PROPOSALमद 37 — बाह्यस्रोतीकरण प्रस्ताव की शर्तें

The notes under item 37 say what the proposal must contain, and they are the heart of this item.

• Outsourcing stays within the framework of the policy guidelines issued by the Railway Board or headquarters
• It is resorted to ONLY where there is an overall shortage of staff after redeployment of surplus staff
• It is DISCONTINUED once the staff are made available
• A ZERO-BASED REVIEW of the manpower requirement is done against the yardsticks and the sanctioned and actual strength
• The possibility of deploying surplus or medically decategorised staff of the division or unit is explored
• The proposed gainful deployment of the staff to be surrendered is brought out, with the resultant savings
• A critical review and reduction in the AAC of stores is done to the extent outsourced
• The requirement is brought out in a statement jointly signed by the branch officers of the executive and personnel departments
• The proposal is concurred in by associate finance and approved by the PHOD, DRM or CWM as applicable
• The personnel officer signing it ensures there is no violation of the CONTRACT LABOUR (REGULATION AND ABOLITION) ACT, 1970
• The requirement of labour is kept to the minimum, since minimum wages are being ensured, and is NOT as per railway yardsticks
• An estimate is processed for the vetting of associate finance, charging the expenditure to REVENUE
• It rests on last accepted rates, rate analysis or the prevailing minimum wages, with mandatory payments such as ESI, EPF and GST
• It is NOT based on the mean pay of railway employees, and no separate detailed estimate is needed
• In exigencies the quotation process may be used sparingly for works less than Rs 10 lakh, and acceptance follows item 5(F)
• The powers for the detailed estimate, tenders, agreements, performance guarantee, security deposit, penalties, variations and termination are those under Works Matters
• Security proposals need associate finance concurrence and the sanction of the CSC
• Divisions are authorised to formulate an approved list of security agencies, and the CSC circulates the guidelines
• The efficacy of an outsourcing contract is reviewed at MID-TERM of its currency and quarterly thereafter
• The results go to the accepting authority for a decision to continue, and a special condition allows PRE-CLOSURE with due notice
• This delegation does not cover activities delegated elsewhere, such as repairs of plant and machinery, AMCs, hiring of vehicles, medical services or consultancy
• Work traditionally done on contract in a division or workshop, and works under the plan heads and regular zonal and maintenance works, are outside it
• Necessary funds are ensured throughout the contract period, and the list of activities is INDICATIVE

So outsourcing follows a shortage, and you should put the zero-based review before the tender.मद 37 के नोट बताते हैं कि प्रस्ताव में क्या होना चाहिए, और यही इस मद का हृदय है।

• बाह्यस्रोतीकरण रेलवे बोर्ड या मुख्यालय के नीति दिशानिर्देशों के ढाँचे में रहता है

• कर्मचारी उपलब्ध हो जाने पर यह बंद कर दिया जाता है
• मानदंडों तथा स्वीकृत और वास्तविक संख्या के सामने जनशक्ति आवश्यकता की शून्य-आधारित समीक्षा होती है
• मंडल या इकाई के अधिशेष अथवा चिकित्सकीय रूप से अवर्गीकृत कर्मचारियों को लगाने की संभावना देखी जाती है
• समर्पित किए जाने वाले कर्मचारियों की लाभकारी तैनाती, और उससे हुई बचत, बताई जाती है
• जितना बाह्यस्रोत पर गया, उतनी भंडार की एएसी की समीक्षा और कटौती की जाती है
• आवश्यकता कार्यपालक और कार्मिक विभागों के शाखा अधिकारियों के संयुक्त हस्ताक्षर वाले विवरण में बताई जाती है
• प्रस्ताव पर सहयोगी वित्त की सहमति और, जैसा लागू हो, पीएचओडी, मंडल रेल प्रबंधक या सीडब्ल्यूएम का अनुमोदन होता है
• हस्ताक्षर करने वाला कार्मिक अधिकारी सुनिश्चित करता है कि संविदा श्रम (विनियमन और उत्सादन) अधिनियम, 1970 का उल्लंघन न हो
• श्रम की आवश्यकता न्यूनतम रखी जाती है, क्योंकि न्यूनतम मजदूरी सुनिश्चित होती है, और यह रेल मानदंडों से नहीं तय होती

• बाह्यस्रोत संविदा की उपयोगिता उसकी अवधि के मध्य में और उसके बाद हर तिमाही देखी जाती है
• परिणाम स्वीकृति प्राधिकारी के पास जारी रखने के निर्णय के लिए जाते हैं, और एक विशेष शर्त उचित सूचना पर पूर्व-समापन देती है
• यह प्रत्यायोजन उन गतिविधियों को नहीं समेटता जिनका प्रत्यायोजन अन्यत्र है, जैसे संयंत्र और मशीनरी की मरम्मत, एएमसी, वाहन किराया, चिकित्सा सेवाएँ या परामर्श

अर्थात् बाह्यस्रोतीकरण कमी के बाद आता है, और निविदा से पहले शून्य-आधारित समीक्षा आप रखिए।

Item 38 — REPAIRS AND AMC OF MACHINERY AND PLANTमद 38 — मशीनरी और संयंत्र की मरम्मत तथा एएमसी

The item covers repairs and AMC of machinery and plant, material handling vehicles included, with the cost of spares incidental to the repair. It leaves out motor trolleys and motor vehicles.

• (a) Expenditure on DIAGNOSIS OF FAULT: PHOD and DRM each FULL POWER with associate finance concurrence
• SG, JAG or Senior Scale (IC): up to Rs 25,000 per case, with an overall annual limit of Rs 1 lakh only
• For (a), finance concurrence is necessary above Rs 15,000
• (b) REPAIR other than on single tender basis: PHOD FULL POWERS; DRM FULL POWERS
• SG, JAG or Senior Scale (IC): Rs 5 lakh per case with finance concurrence
• (c) Repair on SINGLE TENDER with the OEM or its authorised dealer: PHOD and DRM full power with associate finance concurrence
• SG, JAG or Senior Scale (IC): Rs 50,000 per case with finance concurrence, subject to an annual limit of Rs 5 lakh
• (d) AMC other than on single tender basis: PHOD and DRM full power with associate finance concurrence
• SG, JAG or Senior Scale (IC): Rs 5 lakh per case with finance concurrence
• (e) AMC on SINGLE TENDER with the OEM or its authorised dealer: PHOD and DRM full power with associate finance concurrence
• Unit in-charges in JAG or SG: Rs 2 lakh per case, with an annual ceiling of Rs 30 lakh, with finance concurrence

• THE REMARKS
  • An AMC is resorted to ONLY when the maintenance cannot be done through departmental staff or resources
  • The approving or sanctioning authority has to satisfy himself on that
  • The processing of cases is dealt with as per WORKS CONTRACT matters
  So you should read the five rows as one pattern: diagnosis, repair, and AMC, each in two ways.

यह मद मशीनरी और संयंत्र की मरम्मत तथा एएमसी को शामिल करती है, सामग्री ढुलाई वाहन भी, मरम्मत से जुड़े कलपुरजों की लागत सहित। मोटर ट्रॉली और मोटर वाहन इसमें नहीं आते।

• एसजी, जेएजी या वरिष्ठ स्केल (स्वतंत्र प्रभार): वित्त सहमति के साथ प्रति मामला 5 लाख रुपये
• (c) ओईएम या उसके अधिकृत विक्रेता से एकल निविदा पर मरम्मत: पीएचओडी और मंडल रेल प्रबंधक को सहयोगी वित्त सहमति के साथ पूर्ण शक्ति
• एसजी, जेएजी या वरिष्ठ स्केल (स्वतंत्र प्रभार): वित्त सहमति के साथ प्रति मामला 50,000 रुपये, 5 लाख रुपये की वार्षिक सीमा के अधीन
• (d) एकल निविदा से भिन्न एएमसी: पीएचओडी और मंडल रेल प्रबंधक को सहयोगी वित्त सहमति के साथ पूर्ण शक्ति
• एसजी, जेएजी या वरिष्ठ स्केल (स्वतंत्र प्रभार): वित्त सहमति के साथ प्रति मामला 5 लाख रुपये
• (e) ओईएम या उसके अधिकृत विक्रेता से एकल निविदा पर एएमसी: पीएचओडी और मंडल रेल प्रबंधक को सहयोगी वित्त सहमति के साथ पूर्ण शक्ति
• जेएजी या एसजी के इकाई प्रभारी: वित्त सहमति के साथ प्रति मामला 2 लाख रुपये, 30 लाख रुपये की वार्षिक सीमा के साथ

• टिप्पणी
  • एएमसी केवल तब की जाती है जब अनुरक्षण विभागीय कर्मचारियों या साधनों से न हो सके
  • अनुमोदन या स्वीकृति देने वाले प्राधिकारी को इस पर स्वयं संतुष्ट होना है
  • मामलों की प्रक्रिया कार्य संविदा मामलों के अनुसार चलती है
  अर्थात् पाँचों पंक्तियाँ एक ही ढाँचा हैं: पहचान, मरम्मत और एएमसी, हर एक दो तरह से — यह आप पढ़िए।

Item 39 — REPAIRS AND AMC OF OTHER EQUIPMENTमद 39 — अन्य उपकरणों की मरम्मत तथा एएमसी

The item covers repairs and AMC of equipment other than T&P and M&P — rolling stock, S&T, electrical and engineering equipment.

• (a) Expenditure on DIAGNOSIS OF FAULT: PHOD and DRM each full power with associate finance concurrence
• SG, JAG or Senior Scale (IC): up to Rs 25,000 per case, with an overall annual limit of Rs 1 lakh only
• For (a), finance concurrence is necessary above Rs 15,000; for the others, finance concurrence is necessary
• (b) REPAIR other than on single tender basis: all three columns FULL POWERS
• Those powers are as per their own powers for OPEN TENDERS or QUOTATIONS of works matters
• (c) Repair on single tender with the OEM or its authorised dealer: PHOD and DRM full power with associate finance concurrence
• SG, JAG or Senior Scale (IC): Rs 50,000 per case, subject to an annual limit of Rs 5 lakh
• (d) AMC other than on single tender basis: the first two columns full powers as per their open tender or quotation powers
• SG, JAG or Senior Scale (IC): Rs 5 lakh per case with finance concurrence
• (e) AMC on single tender with the OEM or its authorised dealer: PHOD and DRM full power with associate finance concurrence
• Unit in-charges in JAG or SG: Rs 2 lakh per case with an annual ceiling of Rs 30 lakh, with finance concurrence
• Here too an AMC is resorted to only when the maintenance cannot be done through departmental staff or resources

So item 39 is item 38 for other equipment, and you should note where it reads open tender powers instead.यह मद टीएंडपी और एमएंडपी से भिन्न उपकरणों की मरम्मत तथा एएमसी है — रोलिंग स्टॉक, एसएंडटी, विद्युत और इंजीनियरिंग उपकरण।
