Item 40 — HIRE OF PLANT AND MACHINERY IN AN EMERGENCYमद 40 — आपात स्थिति में संयंत्र और मशीनरी का किराया

The item hires plant and machinery from outsiders or Government bodies in case of emergency.

• PHOD ONLY: FULL POWERS
• DRM or CWM (in SAG): FULL POWERS
• SG or JAG: up to RS 50,000

• THE NOTES
  • Finance concurrence is necessary for a transaction of MORE THAN Rs 50,000
  • The authority is PARA 1923-S
  So the divisional figure and the finance line are the same Rs 50,000, and you should say both.

यह मद आपात स्थिति में बाहरी पक्षों या सरकारी निकायों से संयंत्र और मशीनरी किराए पर लेती है।

• केवल पीएचओडी: पूर्ण शक्तियाँ
• मंडल रेल प्रबंधक या एसएजी के सीडब्ल्यूएम: पूर्ण शक्तियाँ
• एसजी या जेएजी: 50,000 रुपये तक

• नोट
  • 50,000 रुपये से अधिक के लेनदेन में वित्त सहमति आवश्यक है
  • प्राधिकार पैरा 1923-एस है
  अर्थात् मंडल का आँकड़ा और वित्त की रेखा, दोनों 50,000 रुपये हैं, और दोनों आप बताइए।

Item 41 — HIRING OF TRUCKS AND MINI TRUCKSमद 41 — ट्रक और मिनी ट्रक किराए पर लेना

The item hires trucks, mini trucks or the equivalent in the same segment, on a regular basis or case to case. It is for transport of material, and for day to day maintenance of track, track machines, bridges and electrical, mechanical and S&T assets. It also carries the supervisory staff of construction projects and workshops.

• PHODs for an extra divisional unit, the COC or construction: FULL POWERS with finance concurrence
• That is subject to a CERTIFICATE that no railway vehicle is available
• DRM, ADRM or CWM (in SAG): FULL POWERS with finance concurrence, subject to the same certificate
• Divisional and headquarters officers: the schedule prints a dash in this column

• THE NOTES
  • The DRM's approval is obtained only when ADRMs are NOT posted in the division
  • Proper record is maintained for watching the expenditure on hiring of trucks and mini trucks
  • There should be clear availability of funds under the proper allocation head
  • As far as possible a division assesses its requirement for the year and enters into a RATE CONTRACT
  • The authority is item 17 note 2 of the IRFC Volume I
  So the certificate comes before the hire, and you should write it in your answer.

यह मद उसी वर्ग के ट्रक, मिनी ट्रक या समतुल्य वाहन नियमित रूप से या मामले-दर-मामले किराए पर लेती है। यह सामग्री ढोने, और पटरी, ट्रैक मशीनों, पुलों तथा विद्युत, यांत्रिक और एसएंडटी संपत्तियों के दैनिक अनुरक्षण के लिए है। यह निर्माण परियोजनाओं तथा कारखानों के पर्यवेक्षी कर्मचारियों को भी ढोती है।

• मंडल से बाहर की इकाई, सीओसी या निर्माण के पीएचओडी: वित्त सहमति के साथ पूर्ण शक्तियाँ
• यह इस प्रमाणपत्र के अधीन है कि कोई रेल वाहन उपलब्ध नहीं
• मंडल रेल प्रबंधक, एडीआरएम या एसएजी के सीडब्ल्यूएम: उसी प्रमाणपत्र के अधीन, वित्त सहमति के साथ पूर्ण शक्तियाँ
• मंडल और मुख्यालय अधिकारी: इस स्तंभ में अनुसूची एक डैश छापती है

• नोट
  • मंडल रेल प्रबंधक का अनुमोदन केवल तब लिया जाता है जब मंडल में एडीआरएम तैनात न हों
  • ट्रक और मिनी ट्रक के किराए पर हुए व्यय पर नजर रखने के लिए उचित अभिलेख रखा जाता है
  • उचित आवंटन शीर्ष में निधि की स्पष्ट उपलब्धता होनी चाहिए
  • यथासंभव मंडल वर्ष की अपनी आवश्यकता आँककर दर संविदा कर ले
  • प्राधिकार आईआरएफसी खंड I की मद 17 का नोट 2 है
  अर्थात् प्रमाणपत्र किराए से पहले आता है, और उत्तर में उसे आप लिखिए।

Item 42 — LICENSING OF RAILWAY LAND FOR A SIDINGमद 42 — साइडिंग के लिए रेल भूमि की अनुज्ञप्ति

The item licenses railway land to give connectivity to private sidings and so increase railway earnings.

• PHOD/CHOD: the schedule prints nothing in this column
• DRM: FULL POWERS, with the recommendation of a three member STANDING COMMITTEE ON LAND MATTERS
• That committee comprises Sr DEN(Co), Sr DCM and Sr DFM
• Divisional and headquarters officers: nothing is printed

• THE NOTES
  • The related freight marketing and land and amenities circulars issued by the Railway Board apply along with it
  • The authority is the Board's letter of 18.10.2017
  So this power sits with the DRM alone, and you should name all three members of his committee.

यह मद निजी साइडिंग को संपर्क देने और इस तरह रेल आय बढ़ाने के लिए रेल भूमि की अनुज्ञप्ति देती है।

• पीएचओडी/सीएचओडी: इस स्तंभ में अनुसूची कुछ नहीं छापती
• मंडल रेल प्रबंधक: भूमि मामलों की तीन सदस्यीय स्थायी समिति की सिफारिश के साथ पूर्ण शक्तियाँ
• उस समिति में वरिष्ठ डीईएन(समन्वय), वरिष्ठ डीसीएम और वरिष्ठ डीएफएम हैं
• मंडल और मुख्यालय अधिकारी: कुछ नहीं छपा है

  • रेलवे बोर्ड के संबंधित माल विपणन तथा भूमि एवं सुविधा परिपत्र इसके साथ लागू होते हैं

Item 43 — TESTING CHARGESमद 43 — परीक्षण शुल्क

The item sanctions expenditure on testing charges of steel, concrete cubes, ballast, soil and drinking water. The testing is from Government institutions or Government approved laboratories.

• PHOD: FULL POWERS
• HOD: up to Rs 50,000 in each case
• DRM, CWM (in SAG) or SAG: up to Rs 50,000 in each case
• ADRM: Rs 35,000 in each case
• JAG, SG or Senior Scale in independent charge: Rs 25,000 in each case

• THE NOTES
  • The institutes are reputed ones like the IITs, NITs, the Shriram Institute for Industrial Research or MSME
  • Rates and finance concurrence are required for cases in EXCESS of Rs 25,000
  So you should notice the ADRM sits between the DRM and the JAG at Rs 35,000.

यह मद इस्पात, कंक्रीट के घनों, गिट्टी, मिट्टी और पीने के पानी के परीक्षण शुल्क पर व्यय स्वीकृत करती है। परीक्षण सरकारी संस्थानों या सरकार से अनुमोदित प्रयोगशालाओं से होता है।

• पीएचओडी: पूर्ण शक्तियाँ
• एचओडी: हर मामले में 50,000 रुपये तक
• मंडल रेल प्रबंधक, एसएजी के सीडब्ल्यूएम या एसएजी: हर मामले में 50,000 रुपये तक
• एडीआरएम: हर मामले में 35,000 रुपये
• स्वतंत्र प्रभार वाला जेएजी, एसजी या वरिष्ठ स्केल: हर मामले में 25,000 रुपये

• नोट
  • संस्थान प्रतिष्ठित होते हैं, जैसे आईआईटी, एनआईटी, श्रीराम औद्योगिक शोध संस्थान या एमएसएमई
  • 25,000 रुपये से अधिक के मामलों में दरें और वित्त सहमति आवश्यक हैं
  अर्थात् एडीआरएम 35,000 रुपये पर मंडल रेल प्रबंधक और जेएजी के बीच बैठते हैं — यह आप देखिए।

Item 44 — SERVICE CONTRACTSमद 44 — सेवा संविदाएँ

The item delegates powers in the case of service contracts, that is inviting and accepting tenders for them.

• PHOD/CHOD: FULL POWERS, as per the delegation of service contracts
• DRM: up to RS 100 CRORE in each case for LONG TERM contracts as per service contracts
• That follows the extant guidelines of service contracts; earlier DRMs had power only up to Rs 20 crore
• All other officers: powers as per the delegations in service contracts

• THE NOTES
  • A DRM can enter into a service contract for 3 MONTHS irrespective of the value of the contract
  • That is only in the case of TERMINATION of an existing service contract
  • It carries finance concurrence, by calling quotations from the approved list of vendors
  • The extant guidelines of the Railway Board are to be followed
  • The authority is the Board's letter of 18.10.2017
  So you should hold the two DRM figures apart: Rs 100 crore now, Rs 20 crore before.

यह मद सेवा संविदाओं के मामले में शक्तियाँ देती है, अर्थात् उनके लिए निविदा बुलाना और स्वीकार करना।

• पीएचओडी/सीएचओडी: सेवा संविदाओं के प्रत्यायोजन के अनुसार पूर्ण शक्तियाँ
• मंडल रेल प्रबंधक: सेवा संविदाओं के अनुसार दीर्घकालिक संविदाओं में हर मामले में 100 करोड़ रुपये तक
• यह सेवा संविदाओं के प्रचलित दिशानिर्देशों से चलता है; पहले मंडल रेल प्रबंधक को केवल 20 करोड़ रुपये तक शक्ति थी
• अन्य सभी अधिकारी: सेवा संविदाओं के प्रत्यायोजन के अनुसार शक्तियाँ

• नोट
  • मंडल रेल प्रबंधक संविदा के मूल्य पर ध्यान न देते हुए 3 माह की सेवा संविदा कर सकते हैं
  • यह केवल मौजूदा सेवा संविदा समाप्त होने की स्थिति में है
  • इसके साथ वित्त सहमति होती है, और वेंडरों की अनुमोदित सूची से कोटेशन बुलाए जाते हैं
  • रेलवे बोर्ड के प्रचलित दिशानिर्देश माने जाते हैं
  • प्राधिकार बोर्ड का 18.10.2017 का पत्र है
  अर्थात् मंडल रेल प्रबंधक के दो आँकड़े आप अलग रखिए: अब 100 करोड़ रुपये, पहले 20 करोड़ रुपये।

Item 45 — PROJECTS ON BOOT BASISमद 45 — बीओओटी आधार पर परियोजनाएँ

The item covers projects to be undertaken on BOOT basis, that is build, own, operate and transfer.

• PHOD/CHOD: as per the delegation of SERVICE CONTRACTS
• DRM or CWM (in SAG): FULL POWERS with finance concurrence
• Those powers stay within their powers of acceptance as per service contracts
• All other officers: powers as per the delegations in service contracts

• THE NOTES
  • The TECHNICAL APPROVAL of the PHOD or CHOD is to be taken
  • The extant guidelines of the Railway Board are to be followed
  • The authority is the Board's letter of 18.10.2017
  So a BOOT project is read through the service contract delegation, and you should say so.

यह मद बीओओटी आधार पर की जाने वाली परियोजनाओं की है, अर्थात् बनाओ, रखो, चलाओ और सौंपो।

• पीएचओडी/सीएचओडी: सेवा संविदाओं के प्रत्यायोजन के अनुसार
• मंडल रेल प्रबंधक या एसएजी के सीडब्ल्यूएम: वित्त सहमति के साथ पूर्ण शक्तियाँ
• वे शक्तियाँ सेवा संविदाओं के अनुसार उनकी स्वीकृति शक्तियों के भीतर रहती हैं
• अन्य सभी अधिकारी: सेवा संविदाओं के प्रत्यायोजन के अनुसार शक्तियाँ

• नोट
  • पीएचओडी या सीएचओडी की तकनीकी स्वीकृति लेनी है
  • रेलवे बोर्ड के प्रचलित दिशानिर्देश माने जाते हैं

  अर्थात् बीओओटी परियोजना सेवा संविदा के प्रत्यायोजन से पढ़ी जाती है, और यही आप कहिए।

Item 46 — AGREEMENTS WITH OTHER PUBLIC BODIESमद 46 — अन्य लोक निकायों के साथ करार

The item enters into contracts or a formal understanding in the prescribed forms for the performance or provision of agreed services. The other party is a department or statutory body of the Central or State Government, or a local body such as a municipality. The service is for the railway's own use.

• PHOD/HOD: FULL POWERS
• DRM, ADRM or CWM (in SAG): FULL POWERS
• JAG: up to Rs 20 lakh
• Senior Scale: up to Rs 5 lakh
• The fees and other amounts are paid as per the scale the respective authority prescribes

• THE NOTES
  • The FORMAT of the MOU is to be vetted by the LAW BRANCH
  • Finance concurrence is necessary, along with vetting of the draft MOU
  So two offices read the paper before it is signed, and you should name law and finance.

यह मद सहमत सेवाओं के निष्पादन या प्रावधान के लिए निर्धारित प्रपत्रों में संविदा या औपचारिक समझौता करती है। दूसरा पक्ष केंद्र या राज्य सरकार का विभाग अथवा सांविधिक निकाय, या नगरपालिका जैसा स्थानीय निकाय होता है। सेवा रेलवे के अपने उपयोग के लिए होती है।

• पीएचओडी/एचओडी: पूर्ण शक्तियाँ
• मंडल रेल प्रबंधक, एडीआरएम या एसएजी के सीडब्ल्यूएम: पूर्ण शक्तियाँ
• जेएजी: 20 लाख रुपये तक
• वरिष्ठ स्केल: 5 लाख रुपये तक
• शुल्क और अन्य राशि संबंधित प्राधिकारी के निर्धारित मान के अनुसार दी जाती है

• नोट
  • समझौता ज्ञापन का प्रारूप विधि शाखा से जँचवाना है
  • वित्त सहमति आवश्यक है, प्रारूप समझौता ज्ञापन की जाँच के साथ
  अर्थात् हस्ताक्षर से पहले दो कार्यालय कागज पढ़ते हैं, और आप विधि तथा वित्त बताइए।

Item 47 — WORKS IN WORKSHOPS FOR OUTSIDE BODIESमद 47 — बाहरी निकायों के लिए कारखाने में कार्य

The item covers works undertaken in workshops for Government departments and outside public bodies.

• PHOD/CHOD: FULL POWERS
• CWM (in SAG): RS 50 CRORE
• Divisional officers: NIL; JAG or Senior Scale in independent charge: Rs 5 lakh

• THE NOTES
  • The CWE and the CME must be kept duly informed
  • The stipulations of PARA 1417 of the WORKSHOP CODE are to be followed
  • The powers are as per the Board's letter of 27.09.2017, which is CS 51 of the Engineering Code
  So outside work is allowed in a railway workshop, and you should attach Para 1417 to it.

यह मद सरकारी विभागों और बाहरी लोक निकायों के लिए कारखानों में किए जाने वाले कार्य की है।

• पीएचओडी/सीएचओडी: पूर्ण शक्तियाँ
• एसएजी के सीडब्ल्यूएम: 50 करोड़ रुपये
• मंडल अधिकारी: शून्य; स्वतंत्र प्रभार वाला जेएजी या वरिष्ठ स्केल: 5 लाख रुपये

• नोट
  • सीडब्ल्यूई और सीएमई को विधिवत सूचित रखना अनिवार्य है
  • कारखाना संहिता के पैरा 1417 की शर्तें माननी हैं
  • शक्तियाँ बोर्ड के 27.09.2017 के पत्र के अनुसार हैं, जो इंजीनियरिंग संहिता का सीएस 51 है
  अर्थात् रेल कारखाने में बाहरी कार्य हो सकता है, और उसके साथ पैरा 1417 आप जोड़िए।

Item 48 — WORK ORDERS AGAINST A ZONAL CONTRACTमद 48 — जोनल संविदा के विरुद्ध कार्य आदेश

The item is the issue of work orders for execution of a contract work against a zonal contract, that is the work-order values.

• PHOD/CHOD, DRM and the divisional column: this copy of the schedule prints no figure against any of them
• NO finance concurrence is required
• The item shares the authority printed with item 47: the Board's letter of 27.09.2017, CS 51 of the Engineering Code

So for item 48 you should carry the one fact the schedule gives: finance does not concur.यह मद जोनल संविदा के विरुद्ध संविदा कार्य कराने के लिए कार्य आदेश जारी करना है, अर्थात् कार्य आदेश के मूल्य।

• पीएचओडी/सीएचओडी, मंडल रेल प्रबंधक और मंडल स्तंभ: अनुसूची की यह प्रति किसी के सामने कोई आँकड़ा नहीं छापती
• वित्त सहमति आवश्यक नहीं है
• यह मद मद 47 के साथ छपे प्राधिकार को साझा करती है: बोर्ड का 27.09.2017 का पत्र, इंजीनियरिंग संहिता का सीएस 51

अर्थात् मद 48 में अनुसूची जो एक तथ्य देती है वही आप रखिए: वित्त सहमति नहीं देता।
