Item 48(A) and (B) — ENTERTAINMENT AND A WORKING LUNCHमद 48(A) और (B) — आतिथ्य और कार्य-भोज

Part (A) incurs expenditure on entertainment for meetings involving outsiders or organised labour. It also covers formal inter-departmental and other meetings and conferences.

• PHOD/CHOD: RS 20,000 PER YEAR, at Rs 30 per head; HOD: Rs 18,000 per year at Rs 30 per head
• DRM, ADRM, CWM, MDs of central hospitals and other SAG officers in field units: Rs 20,000 per year at Rs 30 per head
• JAG: Rs 7,500 per year, at Rs 30 per head
• (B) A WORKING LUNCH: at RS 175 PER HEAD PER MEETING, in the first two columns

• THE NOTES
  • Finance concurrence is not necessary up to the stipulated rate
  • The actual expenditure must be consistent with AUSTERITY standards
  • The number of such meetings, and of participants, is kept to the barest minimum
  • The zonal railways evolve the method of distribution and accountal
  • The overall annual ceiling is RS 35 LAKH for a zonal railway and RS 7 LAKH for a production unit
  • The GM may fix the limits for individual departments and divisions within those
  • After distribution, the balance out of those ceilings stays under the control of the AGM
  • The associated Accounts Officer monitors the progressive expenditure, to keep it within the ceiling
  • Luncheon parties, dinners and receptions are arranged ONLY with the GM's PERSONAL sanction and prior financial concurrence
  So Rs 30 a head buys tea and Rs 175 a working lunch, and you should keep the two rates apart.

भाग (A) बाहरी व्यक्तियों या संगठित श्रम वाली बैठकों के आतिथ्य पर व्यय करता है। इसमें औपचारिक अंतर-विभागीय तथा अन्य बैठकें और सम्मेलन भी आते हैं।

• (B) कार्य-भोज: पहले दो स्तंभों में प्रति बैठक प्रति व्यक्ति 175 रुपये

• नोट
  • निर्धारित दर तक वित्त सहमति आवश्यक नहीं
  • वास्तविक व्यय मितव्ययिता के मानकों के अनुरूप होना चाहिए
  • ऐसी बैठकों की, और सहभागियों की, संख्या कम से कम रखी जाती है
  • जोनल रेलवे वितरण और लेखा की रीति स्वयं बनाती हैं
  • कुल वार्षिक सीमा जोनल रेलवे के लिए 35 लाख रुपये और उत्पादन इकाई के लिए 7 लाख रुपये है
  • उसके भीतर महाप्रबंधक अलग-अलग विभागों और मंडलों की सीमाएँ तय कर सकते हैं
  • वितरण के बाद उन सीमाओं का शेष अपर महाप्रबंधक के नियंत्रण में रहता है
  • संबद्ध लेखा अधिकारी बढ़ते व्यय पर नजर रखते हैं, ताकि वह सीमा में रहे
  • भोज, रात्रिभोज और स्वागत समारोह केवल महाप्रबंधक की स्वयं की स्वीकृति और पूर्व वित्तीय सहमति से होते हैं
  अर्थात् 30 रुपये प्रति व्यक्ति चाय है और 175 रुपये कार्य-भोज, और दोनों दरें आप अलग रखिए।

Item 48(C) and (D) — THE HOSPITALITY FUND AND SAFETY SEMINARSमद 48(C) और (D) — आतिथ्य निधि और संरक्षा संगोष्ठी

Part (C) is the hospitality fund, for entertaining prospective clients for sales promotion, commercial publicity and public relations.

• CPRO, from the hospitality fund: as given in PARA 61 of this SOP
• PCCM: up to Rs 50,000 per annum
• DRM: up to Rs 50,000 per annum; CWM: up to Rs 25,000 per annum
• Sr DCM: up to Rs 2,500 per annum; Sr DOM: up to Rs 2,500 per annum
• Finance concurrence is necessary if the expenditure exceeds Rs 5,000

• PART (D) — SAFETY SEMINARS AND CAMPS
  • It covers safety seminars, camps, audits, workshops and meetings
  • It also covers NUKKAD NATAK, safety related bulk SMS and safety trainings
  • PCSO: FULL POWERS; DRM, ADRM, CWM or SAG: FULL POWERS
  • Dy CSO, Sr DSO or DSO in independent charge: Rs 10,000 on each occasion, subject to an annual ceiling of Rs 50,000
  • Finance concurrence is necessary ABOVE RS 15,000
  So safety has its own hospitality, and you should notice the street play counted as a safety cost.

भाग (C) आतिथ्य निधि है, जो बिक्री संवर्धन, वाणिज्यिक प्रचार और जनसंपर्क के लिए संभावित ग्राहकों के आतिथ्य में लगती है।

• व्यय 5,000 रुपये से अधिक हो, तो वित्त सहमति आवश्यक है

• भाग (D) — संरक्षा संगोष्ठी और शिविर
  • इसमें संरक्षा संगोष्ठी, शिविर, लेखापरीक्षा, कार्यशालाएँ और बैठकें आती हैं
  • इसमें नुक्कड़ नाटक, संरक्षा से जुड़े थोक एसएमएस और संरक्षा प्रशिक्षण भी हैं
  • पीसीएसओ: पूर्ण शक्तियाँ; मंडल रेल प्रबंधक, एडीआरएम, सीडब्ल्यूएम या एसएजी: पूर्ण शक्तियाँ
  • उप सीएसओ, वरिष्ठ डीएसओ या स्वतंत्र प्रभार वाले डीएसओ: हर अवसर पर 10,000 रुपये, 50,000 रुपये की वार्षिक सीमा के अधीन
  • 15,000 रुपये से ऊपर वित्त सहमति आवश्यक है
  अर्थात् संरक्षा का अपना आतिथ्य है, और नुक्कड़ नाटक संरक्षा का खर्च गिना जाता है — यह आप देखिए।

Item 49 — LEGAL EXPENSESमद 49 — विधिक व्यय

Part (A) pays pleaders' fees within the scales the High Court fixes, or which the Board separately approves.

• PHOD/HOD: FULL POWERS; DRM, ADRM, CWM or SAG: FULL POWERS; JAG: FULL POWERS
• Senior Scale: FULL POWERS up to Rs 1,000 in each case
• Junior Scale or an assistant officer: FULL POWERS up to Rs 500 in each case
• Sr LO or LO: Rs 15,000 in each case
• Finance concurrence is NOT necessary if the rates are as fixed by the High Court or the Railway Board

• PART (B) — INCIDENTAL LEGAL EXPENSES
  • Those are the expenses connected with suits filed in a court of law
  • PHOD/HOD: FULL POWERS up to Rs 25,000; DRM, ADRM, CWM or SAG: FULL POWERS up to Rs 25,000
  • JAG: FULL POWERS up to Rs 15,000; Senior Scale: up to Rs 5,000 in each case
  • Junior Scale or an assistant officer: up to Rs 3,000 in each case; Sr LO or LO: Rs 15,000 in each case
  • Finance concurrence is not required up to Rs 25,000 in each case
• PARTS (C) AND (D)
  • (C) Conveyance charges of pleaders engaged on a LUMP SUM FEE, when they journey outside their headquarters
  • Those journeys are in connection with court cases to which the railway is a party
  • PHOD/HOD: FULL POWERS; DRM, ADRM, CWM or SAG: FULL POWERS; the divisional column: NIL
  • Finance concurrence is necessary there
  • (D) Law charges on PATENTS: DRM, ADRM, CWM or SAG up to Rs 50,000 in each case
  • That power is specific to RDSO, and any other organisation may use it subject to certification by RDSO
  • Finance concurrence is not necessary up to Rs 50,000
  So a pleader's fee is free of finance only at the court's own scale, and you should check the scale first.

भाग (A) अधिवक्ताओं का शुल्क उन मानों में चुकाता है जो उच्च न्यायालय तय करे, या जिन्हें बोर्ड अलग से अनुमोदित करे।

• भाग (B) — आनुषंगिक विधिक व्यय
  • ये वे व्यय हैं जो विधि न्यायालय में दायर वादों से जुड़े हैं
  • पीएचओडी/एचओडी: 25,000 रुपये तक पूर्ण शक्तियाँ; मंडल रेल प्रबंधक, एडीआरएम, सीडब्ल्यूएम या एसएजी: 25,000 रुपये तक पूर्ण शक्तियाँ
  • जेएजी: 15,000 रुपये तक पूर्ण शक्तियाँ; वरिष्ठ स्केल: हर मामले में 5,000 रुपये तक
  • कनिष्ठ स्केल या सहायक अधिकारी: हर मामले में 3,000 रुपये तक; वरिष्ठ विधि अधिकारी या विधि अधिकारी: हर मामले में 15,000 रुपये
  • हर मामले में 25,000 रुपये तक वित्त सहमति आवश्यक नहीं
• भाग (C) और (D)
  • (C) एकमुश्त शुल्क पर लगे अधिवक्ताओं के वाहन प्रभार, जब वे अपने मुख्यालय से बाहर यात्रा करें
  • वे यात्राएँ उन न्यायालय मामलों से जुड़ी होती हैं जिनमें रेलवे पक्ष है
  • पीएचओडी/एचओडी: पूर्ण शक्तियाँ; मंडल रेल प्रबंधक, एडीआरएम, सीडब्ल्यूएम या एसएजी: पूर्ण शक्तियाँ; मंडल का स्तंभ: शून्य
  • वहाँ वित्त सहमति आवश्यक है
  • (D) पेटेंट पर विधि प्रभार: मंडल रेल प्रबंधक, एडीआरएम, सीडब्ल्यूएम या एसएजी हर मामले में 50,000 रुपये तक
  • यह शक्ति विशेष रूप से आरडीएसओ की है, और कोई अन्य संगठन इसे आरडीएसओ के प्रमाणन के अधीन प्रयोग कर सकता है
  • 50,000 रुपये तक वित्त सहमति आवश्यक नहीं
  अर्थात् अधिवक्ता का शुल्क न्यायालय के अपने मान पर ही वित्त से मुक्त है, और मान आप पहले देखिए।

Items 50 and 51 — CONSUMER FORUMS AND WITNESSESमद 50 और 51 — उपभोक्ता मंच और गवाह

Item 50 sanctions payment of an award or compensation passed by a District or State Consumer Forum. It also covers claims decreed by a court of law and by tribunals.

• PHOD/HOD: FULL POWERS; DRM, ADRM or CWM: FULL POWERS
• JAG: up to Rs 10,000 in each case; Senior Scale: up to Rs 5,000 in each case
• While according the sanction it is SPECIFICALLY INDICATED whether the amount should be recovered
• That recovery is from the employee responsible for the DEFICIENCY IN SERVICE
• The LAW OFFICER is consulted
• Particulars of a case involving expenditure of more than Rs 25,000 are reported to the Railway Board for information
• Finance concurrence is not necessary, and the amount is paid in accordance with the rule

• ITEM 51 — TRAVEL FOR OUTSIDERS AND MAGISTRATES
  • (A) Travelling allowance to outsiders SUMMONED TO GIVE EVIDENCE, in railway accidents and in legal or vigilance cases
  • PHOD/HOD: FULL POWERS
  • The authority is RULES 1693, 1695 and 1696 of the IREC Volume II of 1987
  • (B) Conveyance allowance to RAILWAY MAGISTRATES: PHOD/CHOD FULL POWERS; DRM or ADRM FULL POWERS; the divisional column NIL
  • Finance concurrence is not necessary
  • A railway magistrate is eligible for a conveyance allowance at specified rates
  • Those rates depend on the mode of transport employed, and on the distance of the magistrate's residence from the court
  So a consumer award may be recovered from the man behind it, and you should say so in the sanction.

मद 50 जिला या राज्य उपभोक्ता मंच के दिए अधिनिर्णय या मुआवजे का भुगतान स्वीकृत करती है। इसमें विधि न्यायालय और अधिकरणों से डिक्री हुए दावे भी आते हैं।

• स्वीकृति देते समय यह विशेष रूप से बताया जाता है कि राशि वसूल की जानी है या नहीं
• वह वसूली उस कर्मचारी से होती है जो सेवा की कमी के लिए जिम्मेदार हो
• विधि अधिकारी से परामर्श किया जाता है
• 25,000 रुपये से अधिक व्यय वाले मामले का विवरण सूचना के लिए रेलवे बोर्ड को भेजा जाता है
• वित्त सहमति आवश्यक नहीं, और राशि नियम के अनुसार चुकाई जाती है

• मद 51 — बाहरी गवाहों और मजिस्ट्रेटों की यात्रा
  • (A) गवाही देने के लिए बुलाए गए बाहरी व्यक्तियों को यात्रा भत्ता, रेल दुर्घटनाओं तथा विधिक या सतर्कता मामलों में
  • पीएचओडी/एचओडी: पूर्ण शक्तियाँ
  • प्राधिकार 1987 की आईआरईसी खंड II के नियम 1693, 1695 और 1696 हैं
  • (B) रेल मजिस्ट्रेटों को वाहन भत्ता: पीएचओडी/सीएचओडी पूर्ण शक्तियाँ; मंडल रेल प्रबंधक या एडीआरएम पूर्ण शक्तियाँ; मंडल का स्तंभ शून्य
  • वित्त सहमति आवश्यक नहीं है
  • रेल मजिस्ट्रेट निर्दिष्ट दरों पर वाहन भत्ते के पात्र हैं
  • वे दरें प्रयुक्त परिवहन के साधन पर, और मजिस्ट्रेट के निवास से न्यायालय की दूरी पर निर्भर करती हैं
  अर्थात् उपभोक्ता अधिनिर्णय उसके पीछे के व्यक्ति से वसूला जा सकता है, और यह स्वीकृति में आप लिखिए।
