Item 3.2(F) — UN-GUARANTEED DELIVERY TERMSमद 3.2(F) — बिना गारंटी की सुपुर्दगी शर्तें

The item accepts un-guaranteed delivery terms and other unusual conditions. It is subject to PARA 419-S and PARA 420-S.

• PCMM and CMM: up to the limit of their POWERS OF PURCHASE
• Dy CMM, SMM, AMM and the Other Officers column: NIL
• The power is exercised in consultation with FINANCE and the LAW OFFICER
• The authority is the Board's letter of 10.6.1964

So an unusual condition stops at the CMM, and you should take the law officer with you.यह मद बिना गारंटी की सुपुर्दगी शर्तें और अन्य असामान्य शर्तें स्वीकार करती है। यह पैरा 419-S और पैरा 420-S के अधीन है।

Item 3.2(G) — A SHORTER GUARANTEE PERIODमद 3.2(G) — छोटी गारंटी अवधि

The item accepts a contract whose guarantee period is shorter than the standard one. The standard is 18 MONTHS from the date of commissioning, or 24 MONTHS from the date of supply, whichever is earlier.

• PCMM, CMM, Dy CMM, SMM and AMM: up to the limit of their powers of purchase
• Field Stores Officers: up to the limit of their powers of purchase
• The power is subject to obtaining the ACCEPTANCE OF THE INDENTING OFFICER for the shorter guarantee period
• Item 3.2(I), which accepts deviations from the IRS conditions, EXCLUDES this item

So the indenting officer must agree to lose the months, and you should get that agreement in hand.यह मद उस संविदा को स्वीकार करती है जिसकी गारंटी अवधि मानक से छोटी हो। मानक है चालू होने की तिथि से 18 माह, या आपूर्ति की तिथि से 24 माह, जो पहले हो।

• पीसीएमएम, सीएमएम, डिप्टी सीएमएम, एसएमएम और एएमएम: अपनी क्रय शक्तियों की सीमा तक

Item 3.2(H) — THE FORCE MAJEURE CLAUSEमद 3.2(H) — दैवी घटना का उपबंध

Part (H)(i) accepts a NON-STANDARD force majeure clause.

• PCMM and CMM: up to the limit of their powers of purchase
• Dy CMM, SMM, AMM and the Other Officers column: NIL
• That power should be used SPARINGLY, with finance concurrence
• It carries safeguards such as a BANK GUARANTEE, against failure of supply, defective supply and short receipt
• A non-standard clause may not be accepted below the level of Dy CMM, and it goes to the Law Officer and Finance

• PART (H)(ii) — THE STANDARD CLAUSE
  • It is the railway's or the DGS&D's own standard force majeure clause
  • PCMM, CMM, Dy CMM and SMM: up to the limit of their powers of purchase
  • Field Stores Officers: up to the limit of their powers of purchase
  • The standard clause may be accepted by the competent authority for purchase, but NOT LOWER THAN SR SCALE
  • There consultation with the Law Officer and Finance is NOT necessary
  • As far as possible a force majeure clause is not included in a contract below Rs 5,000
  • That is especially so when the order is not placed on a reputed firm or manufacturer
  So the standard clause is free of the law officer and the non-standard one is not, and you should say which clause you are on.

भाग (H)(i) गैर-मानक दैवी घटना उपबंध स्वीकार करता है।

• भाग (H)(ii) — मानक उपबंध
  • यह रेल का या डीजीएसएंडडी का अपना मानक दैवी घटना उपबंध है
  • पीसीएमएम, सीएमएम, डिप्टी सीएमएम और एसएमएम: अपनी क्रय शक्तियों की सीमा तक
  • क्षेत्रीय भंडार अधिकारी: अपनी क्रय शक्तियों की सीमा तक
  • मानक उपबंध खरीद का सक्षम प्राधिकारी स्वीकार कर सकता है, पर वरिष्ठ श्रेणी से नीचे नहीं
  • वहाँ विधि अधिकारी और वित्त से परामर्श आवश्यक नहीं
  • यथासंभव 5,000 रुपये से कम की संविदा में दैवी घटना उपबंध नहीं रखा जाता
  • विशेषकर तब, जब आदेश किसी प्रतिष्ठित फर्म या निर्माता पर न दिया गया हो
  अर्थात् मानक उपबंध विधि अधिकारी से मुक्त है और गैर-मानक नहीं, और आप किस उपबंध पर हैं यह आप कहिए।

Item 3.2(I) — DEVIATIONS FROM THE IRS CONDITIONSमद 3.2(I) — आईआरएस शर्तों से विचलन

The item accepts deviations from the IRS conditions of contract without prior finance concurrence. It excludes item (g), the shorter guarantee period.

• (i) In a DIRECT ACCEPTANCE case the officer goes one level higher than his direct powers of acceptance
• He may not go below the level of JA Grade
• PCMM and CMM: up to the DIRECT ACCEPTANCE POWER OF THE Dy CMM
• Dy CMM: up to the direct acceptance power of the SMM; SMM: NIL
• (ii) In a TENDER COMMITTEE case: PCMM, CMM and Dy CMM carry their NORMAL power of acceptance of the tender
• SMM: Nil
• Field Stores Officers and their accepting authorities exercise the same powers as their headquarters counterparts
• They do so up to their own powers of acceptance, in both (i) and (ii)

So a deviation is judged one step above the ordinary, and you should notice the floor at JA Grade.यह मद बिना पूर्व वित्त सहमति आईआरएस संविदा शर्तों से विचलन स्वीकार करती है। इसमें मद (g), अर्थात् छोटी गारंटी अवधि, नहीं आती।

• डिप्टी सीएमएम: एसएमएम की सीधी स्वीकृति शक्ति तक; एसएमएम: शून्य
• (ii) निविदा समिति के मामले में पीसीएमएम, सीएमएम और डिप्टी सीएमएम निविदा स्वीकार करने की अपनी सामान्य शक्ति रखते हैं
• एसएमएम: शून्य
• क्षेत्रीय भंडार अधिकारी और उनके स्वीकार प्राधिकारी अपने मुख्यालय समकक्षों जैसी ही शक्तियाँ रखते हैं
• वे उन्हें (i) और (ii) दोनों में अपनी स्वीकृति की शक्तियों तक प्रयोग करते हैं

अर्थात् विचलन सामान्य से एक कदम ऊपर परखा जाता है, और जेए ग्रेड की तली आप देखिए।
