HOW THEY ARE BUILT
Before the rules themselves, fix their shape in your head. A question often gives you a rule number and asks what it covers.
- THE NAME AND THE POWERThese are THE RAILWAY SERVANTS (DISCIPLINE AND APPEAL) RULES, 1968. The President made them under the PROVISO TO ARTICLE 309 of the Constitution. You will see them written as D&AR or RS(D&A) Rules.
- THE SEVEN PARTS
- Part I, General: Rules 1 to 3
- Part II, Suspension: Rules 4 and 5
- Part III, Penalties and Disciplinary Authorities: Rules 6 to 8
- Part IV, Procedure for imposing Penalties: Rules 9 to 16
- Part V, Appeals: Rules 17 to 24
- Part VI, Revision and Review: Rules 25 and 25A
- Part VII, Miscellaneous: Rules 26 to 31
- HOW THE PARTS ARE SIZEDSuspension gets two rules. The procedure for imposing penalties gets eight. Revision and Review have a Part of their own, after Appeals and not inside it.
- TWO COPIES, TWO DATESYou will meet two texts. The Board's copy is "Corrected upto 10.3.2003". The 61-page compendium lists amendments up to 18.07.2006. Where the two differ, learn both readings and treat the 2006 text as current.
- THE CONSTITUTION BEHIND THEMARTICLE 310(1) is the DOCTRINE OF PLEASURE. If you hold a civil post under the Union, you hold office during the PLEASURE OF THE PRESIDENT. It opens "except as expressly provided by this Constitution", and Article 311 is that express provision. ARTICLE 311 protects you. Clause (1): an authority SUBORDINATE to your appointing authority cannot dismiss or remove you. Clause (2): no dismissal, removal or reduction in rank WITHOUT AN INQUIRY. In that inquiry you are told the charges and given a reasonable opportunity of being heard. One training deck heads its list of major penalties "Art 311(2)". The same deck writes "Art 305, 309, 311" against the Rules. The Rules themselves name only Article 309. Article 305 is about saving existing laws and State monopolies, not about service. So do not write 305 in an answer on these Rules.
- THE HINDI HEADINGSIf you write the paper in Hindi, take rule headings from the authoritative Hindi text of the Rules. Every Hindi heading given with a rule is a close translation of the English heading.

WHAT COUNTS AS MISCONDUCT
The Rules punish misconduct, but they do not define it. The training deck groups it under three heads. They are the three duties you learnt in Rule 3(1) of the Conduct Rules, under the heading GENERAL: integrity, devotion to duty, and nothing unbecoming.
- INTEGRITYBribery and corruption cases, theft, forgery, and misappropriation of funds or railway revenue. Also sabotage, tampering with records, leaking secret information and suppressing material evidence.
- LACK OF DEVOTION TO DUTYUnauthorised absence, absconding from duty and sleeping on duty. Also delaying work on flimsy grounds, negligence, and poor quality or quantity of work.
- UNBECOMING OF A RAILWAY SERVANTAny act of yours that the disciplinary authority considers immoral.

THE PRINCIPLES OF NATURAL JUSTICE
The training deck puts natural justice in one line: a REASONABLE OPPORTUNITY must be given to the charged employee. Then it lists the principles.
- Nobody can be a judge in his own case
- Nobody should be condemned without being heard
- Every decision should be made in good faith
- The hearing must be impartial
- A reasonable opportunity should be given to defend the case
- The reasons for a decision should be made known to the accused
- The charges should be told in advance
- Justice should not only be done, it should also appear to have been done
