TO WHOM AND BY WHEN (RULES 19 AND 20)किसके पास और कब तक (नियम 19 और 20)
Rule 19 — APPELLATE AUTHORITIES
Rule 19 answers one question: who hears your appeal? Look first in the Schedules. Only where they are silent do the fallbacks apply.
- 19(1) — THE SCHEDULES FIRST, THEN FOUR FALLBACKSYou appeal to the authority the SCHEDULES name. So does a person who has left railway service. Where none is named:
- (i) Penalty imposed by a REVISING authority under Rule 25: to the authority it is immediately subordinate to
- (ii) Penalty ENHANCED in appeal or revision: to the authority immediately above the one that enhanced it
- (iii) Order under Rule 18(iv) about a RULE: to your appointing authority or the rule-maker, whichever is higher. About an AGREEMENT: to your appointing authority
- (iv) Order under Rule 18(v): to the PRESIDENT if only the President can dismiss you. Otherwise, to the authority immediately above the one that made the order
- 19(2) — TWO OVERRIDES
- (i) An order in a COMMON PROCEEDING under Rule 13: to the authority immediately above the one acting as disciplinary authority
- (ii) The maker of the order later BECOMES the appellate authority: to the authority immediately above that person
- 19(3) — UNION OFFICE-BEARERSYou may be an office-bearer of an association, federation or union in the JOINT CONSULTATION AND COMPULSORY ARBITRATION SCHEME. A penalty for your work in that role, imposed by anyone other than the President, may be appealed to the PRESIDENT. This holds even where sub-rules (1) and (2) give no appeal to the President.
- THE SCHEDULE II RULE OF THUMBSchedule II, Note 1, makes the appellate authority the one in the NEXT COLUMN. For the Railway Board's column, it is the President. The deck lists "DA becoming appellate authority" as a point to learn, which is 19(2)(ii).

- THE RULEAn appeal under this Part is entertained only if it is preferred within FORTY-FIVE DAYS. Count them from the date a copy of the order is delivered to the appellant.
- THE PROVISOThe appellate authority may still entertain a LATE appeal if satisfied that you had SUFFICIENT CAUSE for the delay.
- DO NOT MIX THE NUMBERSThe same forty-five days appears in Rule 24(2) and (3), for a revision application after your appeal is decided. Rule 27, POWER TO RELAX TIME LIMIT AND TO CONDONE DELAY, is the general power to extend time. And this is Rule 20, not Rule 18 or Rule 21.

Rule 21 — FORM AND CONTENTS AND SUBMISSION OF APPEAL
An appeal sent through a lawyer or a union is returned to you. So write it yourself, sign it yourself, and keep it polite.
- 21(1) — SEPARATELY AND IN YOUR OWN NAMEEvery appellant appeals SEPARATELY and IN HIS OWN NAME. An appeal forwarded through, or countersigned by, a LEGAL PRACTITIONER, an assisting railway servant or a union official is NOT ENTERTAINED. It is returned, with a direction to submit it under your own signature only.
- 21(2) — TO WHOM, AND WHAT IT CONTAINSYou present it to the APPELLATE AUTHORITY, and send a COPY to the authority that made the order. It must:
- Contain all the material statements and arguments you rely on
- Contain NO DISRESPECTFUL OR IMPROPER LANGUAGE
- Be COMPLETE IN ITSELF
- 21(3) — THE FILE MOVES ON ITS OWNOn receiving your copy, the authority that made the order forwards it with its COMMENTS and the RELEVANT RECORDS. It does so without avoidable delay, and WITHOUT WAITING for any direction from the appellate authority.
- WHAT THE DECK ADDSBefore sending the case up, the disciplinary authority gives a brief history of the case and para-wise remarks on your appeal. It links the original D&AR case file with all relevant documents, your service sheet, and your confidential reports if they are maintained.

THE APPEAL ITSELF (RULES 21 TO 23)अपील स्वयं (नियम 21 से 23)
Rule 22 — CONSIDERATION OF APPEAL
What the appellate authority must look at depends on what you appealed against: a suspension, a penalty, or anything else.
- 22(1) — AN APPEAL AGAINST SUSPENSIONIt considers whether, in the light of Rule 5 and the circumstances, the suspension is JUSTIFIED. Then it CONFIRMS or REVOKES it.
- 22(2) — AN APPEAL AGAINST A PENALTY OR ITS ENHANCEMENTIt considers three questions:
- (a) Was the PROCEDURE followed? If not, did the failure violate the Constitution or cause a FAILURE OF JUSTICE?
- (b) Are the disciplinary authority's FINDINGS warranted by the EVIDENCE on record?
- (c) Is the penalty ADEQUATE, INADEQUATE OR SEVERE?
- (i) CONFIRMING, ENHANCING, REDUCING or SETTING ASIDE the penalty
- (ii) REMITTING the case, with directions, to the authority that imposed or enhanced it, or to any other authority
- THE PROVISOS — ENHANCING IN APPEAL
- (i) The COMMISSION is consulted wherever necessary
- (ii) A penalty in (v) to (ix) is proposed and NO Rule 9 inquiry was held: it holds or directs that inquiry first, subject to Rule 14
- (iii) A penalty in (v) to (ix) is proposed and a Rule 9 inquiry WAS held: it makes such orders as it thinks fit
- (iv) Penalty (iv) is proposed under Rule 11(2), with no Rule 9 inquiry held: it holds or directs that inquiry first, subject to Rule 14
- (v) In every other case, no enhanced penalty without a reasonable chance to represent, as far as may be under Rule 11
- 22(3) — AN APPEAL AGAINST ANY OTHER ORDERFor any other order in Rule 18, it considers all the circumstances and makes orders that are JUST AND EQUITABLE.
- WHAT THE DECK ADDSThe deck gives the same three checks. Proper procedure followed or not? Orders backed by evidence on record or not? Punishment in keeping with the gravity of the offence or not? The order then maintains, amends, reduces or enhances the penalty. It must be a SPEAKING ORDER: WHO, WHAT FOR, HOW, WHICH, WHY.

Rule 23 — IMPLEMENTATION OF ORDERS IN APPEAL
The appellate authority decides. The authority whose order you appealed against CARRIES IT OUT.
- THE RULEThe authority which made the order appealed against gives effect to the orders passed by the appellate authority.
- WHAT THIS MEANS FOR YOUIf your penalty is reduced in appeal, the office that punished you issues the order that reduces it. The speaking orders deck adds a related point. After its final order, the disciplinary authority is FUNCTUS OFFICIO, which the deck writes as "officio-functus". It cannot act further in the matter unless the appellate or revising authority authorises it.

Rule 24 — SPECIAL PROVISIONS FOR NON-GAZETTED STAFF
If you are non-gazetted, Rule 24 gives you two extra doors: a personal hearing in appeal, and one more revision after it.
- 24(1) — A PERSONAL HEARINGThe penalty may be dismissal, removal, compulsory retirement, reduction or withholding of increment. Then the appellate authority MAY, at its discretion, give you a PERSONAL HEARING before deciding the appeal. At that hearing either of these may accompany you:
- Another railway servant of the same Railway Administration, or of the Board's office, attached or subordinate office where you work or worked
- An official of a RECOGNISED Railway Trade Union of your administration, who is NOT A LEGAL PRACTITIONER
- 24(2) — GROUP 'C': REVISION BY THE GENERAL MANAGERYou are Group 'C' and were dismissed, removed or compulsorily retired. After your appeal is decided, you may apply WITHIN 45 DAYS to the GENERAL MANAGER for revision. You may ask the GM to refer the case first to the RAILWAY RATES TRIBUNAL for advice. On that request the GM must refer it to the Chairman, with all the relevant papers. The GM then decides under Rule 25.
- 24(3) — GROUP 'D': REVISION BY THE DRMA Group 'D' servant in the same position applies WITHIN 45 DAYS to the DIVISIONAL RAILWAY MANAGER. Where no DRM controls the servant, the application goes to the SENIOR-MOST ADMINISTRATIVE GRADE OFFICER in control. That officer decides under Rule 25.
- THE PROVISOS TO BOTH
- Group 'C': not where the General Manager or the Railway Board is the appellate authority
- Group 'D': not where the DRM, the senior-most officer or any higher authority is the appellate authority
- Once an application is decided under this rule, NO FURTHER REVISION lies under Rule 25
