Rule 26 — SERVICE OF ORDERS, NOTICES ETCनियम 26 — आदेशों, सूचनाओं आदि की तामील

Rule 26 fixes how the papers in your case reach you.

• THE RULEEvery order, notice and other process under these Rules is served on you IN PERSON, or communicated to you by REGISTERED POST. This matters because your time limits run from delivery. Rule 20 counts your 45 days for appeal from the day a copy of the order is delivered to you.

नियम 26 तय करता है कि आपके मामले के कागज आप तक कैसे पहुँचते हैं।

• नियमइन नियमों के अंतर्गत हर आदेश, सूचना और अन्य प्रक्रिया आप पर व्यक्तिगत रूप से तामील की जाती है, या रजिस्टर्ड डाक से आपको भेजी जाती है। यह इसलिए महत्वपूर्ण है कि आपकी समय-सीमाएँ सुपुर्दगी से चलती हैं। नियम 20 अपील के आपके 45 दिन उस दिन से गिनता है जिस दिन आदेश की प्रति आपको दी जाती है।

Rule 26A — SERVICE OF ORDERS, NOTICES ETC. ON BEHALF OF THE RAILWAY BOARD OR PRESIDENTनियम 26क — रेलवे बोर्ड या राष्ट्रपति की ओर से आदेशों, सूचनाओं आदि की तामील

An order you receive "by the Railway Board" or "in the name of the President" is signed by an officer. Rule 26A names which officers may sign it.

• THE RULEThese officers in the Ministry of Railways may sign for the Railway Board or the President. They may sign any notice, process or order under these Rules:
  • (i) Secretary, Railway Board; Joint Secretary; Deputy Secretary
  • (ii) Executive Director; Director; Joint Director
  Both copies of the Rules print this rule.

आपको मिले "रेलवे बोर्ड द्वारा" या "राष्ट्रपति के नाम से" दिए गए आदेश पर कोई अधिकारी हस्ताक्षर करता है। नियम 26क बताता है कि कौन से अधिकारी उस पर हस्ताक्षर कर सकते हैं।

• नियमरेल मंत्रालय के ये अधिकारी रेलवे बोर्ड या राष्ट्रपति की ओर से इन नियमों के अंतर्गत कोई भी सूचना, प्रक्रिया या आदेश हस्ताक्षरित कर सकते हैं:
  • (i) सचिव, रेलवे बोर्ड; संयुक्त सचिव; उप सचिव

THREE GENERAL RULES (RULES 27 TO 29)तीन सामान्य नियम (नियम 27 से 29)

Rule 27 — POWER TO RELAX TIME LIMIT AND TO CONDONE DELAYनियम 27 — समय सीमा में छूट देने और देरी को माफ करने की शक्ति

Almost every step in these Rules has a time limit. Rule 27 is the safety valve for all of them.

• THE RULEExcept where the Rules expressly say otherwise, the authority competent to make an order may EXTEND any time limit or CONDONE any delay. It needs GOOD AND SUFFICIENT REASONS, or SUFFICIENT CAUSE shown. If you miss a time limit, this is the rule under which the delay can be condoned. Standard Form SF-11(b) carries a footnote of the same kind. It lets the competent authority stretch the seven-day inspection period up to ten days.

इन नियमों के लगभग हर कदम की समय-सीमा है। नियम 27 उन सबके लिए राहत का रास्ता है।

Rule 28 — SUPPLY OF COPY OF COMMISSION'S ADVICEनियम 28 — आयोग की सलाह की प्रति देना

Wherever the Commission is consulted, you get to see what it said.

• THE RULEThe authority making the order gives you, with a copy of the order:
  • A copy of the COMMISSION'S ADVICE
  • Where the advice was NOT ACCEPTED, a BRIEF STATEMENT OF THE REASONS for not accepting it
  Rule 12, COMMUNICATION OF ORDERS, says the same for the disciplinary authority's order.

• नियमआदेश देने वाला प्राधिकारी आदेश की प्रति के साथ आपको देता है:

Rule 29 — REPEAL AND SAVINGनियम 29 — निरसन और व्यावृत्ति

New rules replaced old ones in 1968. Rule 29 decides what happened to cases already running, and to rights you had already earned.

• 29(1) — THE REPEALThe Discipline and Appeal Rules in force from 1 AUGUST 1961 are repealed, with the orders under them, so far as they are inconsistent with these Rules. They covered railway servants other than those in the Railway Protection Force. The PROVISO saves two things:
  • (a) Anything already done, ordered or acted on under the old rules stays valid
  • (b) A proceeding pending at commencement continues and is decided under these Rules, as far as may be
• 29(2) TO (4) — APPEALS AND REVISIONS
  • (2) No right of appeal you had already earned is taken away
  • (3) An appeal pending at commencement is decided under these Rules
  • (4) An appeal, revision or review against an older order is made under these Rules
  The PROVISO to (4) says nothing in these Rules reduces a period of limitation that the old rules gave.

1968 में नए नियमों ने पुराने नियमों की जगह ली। नियम 29 तय करता है कि पहले से चल रहे मामलों और आपके पहले से बने अधिकारों का क्या हुआ।

• 29(1) — निरसन1 अगस्त 1961 से लागू अनुशासन और अपील नियम, और उनके अंतर्गत दिए गए आदेश, जहाँ तक इन नियमों से असंगत हैं, निरस्त किए जाते हैं। वे रेलवे सुरक्षा बल के कर्मचारियों को छोड़कर अन्य रेल सेवकों के लिए थे। परंतुक दो बातें बचाता है:
  • (क) पुराने नियमों के अंतर्गत पहले से किया गया काम, दिया गया आदेश या की गई कार्रवाई वैध रहती है
  • (ख) प्रारंभ के समय लंबित कार्यवाही, जहाँ तक हो सके, इन नियमों के अनुसार चलती और निपटाई जाती है
• 29(2) से (4) — अपील और पुनरीक्षण
  • (2) आपका पहले से बना अपील का कोई अधिकार नहीं छिनता
  • (3) प्रारंभ के समय लंबित अपील इन नियमों के अनुसार निपटाई जाती है
  • (4) पुराने आदेश के विरुद्ध अपील, पुनरीक्षण या पुनर्विलोकन इन नियमों के अंतर्गत किया जाता है
  (4) का परंतुक कहता है कि इन नियमों की कोई बात पुराने नियमों में दी गई परिसीमा अवधि को कम नहीं करती।

Rule 30 — REMOVAL OF DOUBTSनियम 30 — संदेहों का निवारण

If the meaning of a rule is in doubt, you need to know who settles it. Only one authority does.

• THE RULEAny doubt about the interpretation of these Rules is referred to the PRESIDENT, THROUGH THE RAILWAY BOARD. The President decides it.

यदि किसी नियम के अर्थ पर संदेह हो, तो आपको जानना चाहिए कि उसे कौन सुलझाता है। केवल एक प्राधिकारी।

• नियमइन नियमों की व्याख्या पर कोई भी संदेह रेलवे बोर्ड के माध्यम से राष्ट्रपति को भेजा जाता है। राष्ट्रपति उसका निर्णय करते हैं।

Rule 31 — RIGHT TO SUBMIT PETITIONS TO THE PRESIDENTनियम 31 — राष्ट्रपति को याचिका देने का अधिकार

Appeal, revision and review all run inside these Rules. The petition to the President sits outside them, and the Rules do not take it away.

• THE RULENothing in these Rules deprives you of your right to submit a PETITION TO THE PRESIDENT. You submit it under the instructions in APPENDIX II to the INDIAN RAILWAY ESTABLISHMENT CODE, VOLUME I (Fifth Edition, 1985).

अपील, पुनरीक्षण और पुनर्विलोकन सब इन नियमों के भीतर चलते हैं। राष्ट्रपति को याचिका इनके बाहर है, और नियम उसे छीनते नहीं।

• नियमइन नियमों की कोई बात आपसे राष्ट्रपति को याचिका देने का अधिकार नहीं छीनती। आप उसे भारतीय रेल स्थापना संहिता, खंड I (पाँचवाँ संस्करण, 1985) के परिशिष्ट II के अनुदेशों के अनुसार देते हैं।
