WHAT A SPEAKING ORDER ISसकारण आदेश क्या है
A final order in a D&AR case must speak for itself. You should be able to read it and know why it went the way it did. The deck by J.S. Nirmal, SPO-II, puts it in four parts.
  • It is CLEAR, PRECISE AND UNAMBIGUOUS
  • It is COMPLETE IN ITSELF, understood from its own words with no clarification later
  • It CONTAINS THE REASONS for the conclusion reached
  • How much reasoning it needs depends on the FACTS OF EACH CASE
  • WHY LATER EXPLANATIONS DO NOT COUNTThe deck quotes the Supreme Court. A public order made under a statutory authority cannot be read in the light of what the officer later says he meant. It is read objectively, from the language of the order itself.
  • WHAT IS NOT A SPEAKING ORDERThe deck gives two examples. "After careful consideration I have come to the conclusion" is not a speaking order. The second example says the officer has gone through the charges and the explanation. It then says the officer "is definitely of the opinion" the employee is unfit to be retained, and orders removal. Both are ARBITRARY, because neither gives a reason tied to the case.
  • THE FIVE QUESTIONSThe D&AR training deck adds a checklist. A speaking order answers:
    • WHO has been charge-sheeted
    • WHAT FOR the employee was charge-sheeted
    • HOW the charges are proved or not proved
    • WHICH penalty has been imposed
    • WHY it has been imposed, that is, the violation

WHERE A REASONED ORDER IS NEEDED
The deck lists the points in a case where the authority must show its reasons. At each one it uses its judgement.
  • Recording reasons for DISPENSING WITH AN INQUIRY
  • ACTION ON THE INQUIRY REPORT, and whether the charges are proved or not
  • DISAGREEING with the inquiry officer, and the HEARING that goes with it
  • AGREEING with the inquiry officer
  • COMPOSITE ORDERS, where others are consulted
  • The QUANTUM of punishment
  • A notice of removal under RULE 14(ii)
  • The final speaking order of the disciplinary authority
The deck also prints "Impractical v. Impracticable" as a heading, with no text under it. Rule 14(ii) itself uses the words NOT REASONABLY PRACTICABLE.
  • DISAGREEING WITH THE INQUIRY OFFICERRule 10(2)(a) sends you the disciplinary authority's TENTATIVE REASONS for disagreeing, with the report. You get fifteen days to represent before it records its findings.
  • AGREEING WITH THE INQUIRY OFFICERThe deck's case law says the Supreme Court has held this. Where the disciplinary authority CONCURS with the inquiry officer's findings, it need not give SEPARATE REASONS. The reasoned-decisions note names the case, TARA CHAND v. MUNICIPAL CORPORATION, and adds the limit: where the authority disagrees, it must state its reasons. You will find it under REASONED DECISIONS — WHY THE LAW REQUIRES REASONS.

WHY REASONS ARE REQUIRED
The deck gives seven reasons. Learn them in order.
  • (i) Reasons are the LINK between the material and the conclusion. They show a RATIONAL NEXUS between the facts considered and the conclusion reached
  • (ii) Without reasons, the power can become a WEAPON FOR ABUSE in dishonest hands. With reasons, extraneous or irrelevant considerations show up and can be corrected
  • (iii) Reasons bring CLARITY and EXCLUDE ARBITRARINESS. You can see why the decision went against you
  • (iv) They show the decision was reached ACCORDING TO LAW, on merits, and not on policy or expediency
  • (v) They let you make an EFFECTIVE APPEAL, revision, review or memorial. They also help the departmental authorities decide those objectively
  • (vi) Tribunals, High Courts and the Supreme Court under ARTICLE 136 can test the decision. Without reasons they would have to go through the entire record
  • (vii) Reasons SUBSTITUTE OBJECTIVITY FOR SUBJECTIVITY. A silent decision, the "inscrutable face of the sphinx", makes judicial review almost impossible
The deck adds a line worth keeping. A speaking order at its best is a reasonable one, and at its worst a plausible one. It also says that failure to give reasons amounts to a DENIAL OF JUSTICE.

A REMOVAL WITHOUT INQUIRY UNDER RULE 14(ii)नियम 14(ii) के अंतर्गत बिना जाँच सेवा से हटाना
The deck shows how a Rule 14(ii) case is written up. It gives a model notice and a specimen order, both about a driver who disrupted train running. Read them for what you would need to write in such an order.
  • THE MODEL NOTICE OF REMOVALIt names the driver and records the facts. The driver stayed absent and deliberately failed in duty despite repeated calls. The driver mobilised staff to paralyse train running, and spread panic by threats. The notice then records why no inquiry can be held: staff were too intimidated to give evidence. It concludes that an inquiry is NOT REASONABLY PRACTICABLE in this disturbed situation.
  • WHAT THE NOTICE SAYS ABOUT APPEALUnder Rules 18 and 19 the removed employee may appeal to the authority named. Two conditions are written in:
    • The appeal is made within 45 DAYS of the day a copy is delivered
    • It is in the employee's OWN NAME, presented to the right authority, with no disrespectful or improper language
  • THE SPECIMEN SPEAKING ORDERIt sets out the facts in detail. A train was detained, other drivers were instigated to refuse call books, and the section saw about 13 hours of detention. The authority says it is satisfied an inquiry is not reasonably practicable, since no co-worker will give evidence. It then imposes the penalty under Rule 14(ii). It tells the employee to hand over railway property and vacate the quarter within ONE MONTH. It ends by saying an appeal lies within 45 days.
  • WHAT TO TAKE FROM THEMBoth documents give the FACTS, then the REASON an inquiry cannot be held, then the ORDER. That is the shape of a speaking order under Rule 14(ii).

THE PAPERS SENT WITH THE FINAL ORDER
The deck lists three papers that go to you with the final order.
  • A copy of the INQUIRY REPORT, where an inquiry was held and the report was not already supplied
  • Where the authority DISAGREED with the inquiry officer, a statement of its findings with BRIEF REASONS for disagreeing
  • Where the PUBLIC SERVICE COMMISSION was consulted, a copy of its advice, and brief reasons wherever that advice was not accepted
Rule 12, COMMUNICATION OF ORDERS, and Rule 28, SUPPLY OF COPY OF COMMISSION'S ADVICE, say the same about the Commission's advice.

WHEN A PENALTY ORDER TAKES EFFECT
Know which date applies to your own order. The deck sets out four points on dates.
  • An order of REMOVAL or DISMISSAL takes effect from the date the officer ACTUALLY RECEIVES it. Other penalty orders take effect when they are SENT OUT
  • An order may carry a PROSPECTIVE date of effect written into it
  • A SUSPENSION order takes effect from the date it is communicated. Actual knowledge is not needed if the servant is not working in the office
  • Dismissal or removal CANNOT be RETROSPECTIVE. If an order says so, the two parts are severable: dismissal stands from the order's date, and only the backdating fails
  • THE AUTHORITY IS THEN FUNCTUS OFFICIOAfter its final order, the disciplinary authority becomes functus officio, printed in the deck as "officio-functus". It cannot act further unless the appellate or revising authority authorises it.

DEPARTMENTAL REMEDIES AND A HEARING IN APPEAL
Before a tribunal or a court, you have remedies inside the department. The deck calls them QUICK AND EFFICACIOUS. Appeal, revision and review are CREATURES OF STATUTE: they exist only because the Rules create them.
  • IS THERE A RIGHT TO A PERSONAL HEARING IN APPEALThe normal rule is NO. The deck quotes the principle that natural justice does not give a personal hearing at every stage.
  • THE GOVERNMENT OF INDIA'S INSTRUCTIONYour appeal may be against a MAJOR penalty, and you may SPECIFICALLY REQUEST a personal hearing. Then the appellate authority may allow it at its DISCRETION, after considering all the circumstances. Defence assistance is also admissible at that stage.
  • GANESH SANTA RAM SIRUR v. STATE BANK OF INDIACivil Appeal No. 7058 of 2002, decided by the Supreme Court on 17.11.2004. No personal hearing was given while the appeal was considered. The Supreme Court did NOT quash the order.
  • RAM CHANDER v. UNION OF INDIA, AIR 1986 SC 1173The general principle is that an order that simply AFFIRMS needs no reasons. But the rules may require the appellate authority to "CONSIDER" the appeal. That means objective consideration with application of mind, which implies GIVING REASONS for the decision. Rule 22(2) uses the word "consider".
  • FOR NON-GAZETTED STAFFRule 24(1), SPECIAL PROVISIONS FOR NON-GAZETTED STAFF, lets the appellate authority give a personal hearing. It covers dismissal, removal, compulsory retirement, reduction and withholding of increment.
