THE FACTORIES ACT, 1948
The Act came into effect on 1.4.1949. Workers in a factory are regulated by it. If you work in a factory, it fixes what the OCCUPIER must do for you:
  • Health, safety, medical care and welfare
  • Hours of work, the minimum period of rest, and leave
  • Extra wages for work beyond the prescribed duty hours
The Delhi Labour Department calls it social legislation for the occupational safety, health and welfare of workers at work places.

WHERE THE ACT APPLIES ON THE RAILWAYS
The guide's Industrial Relations chapter says the Act applies:
  • To ALL RAILWAY WORKSHOPS and PRODUCTION UNITS
  • But NOT to loco sheds and C&W departments
If you work in a railway workshop, the Factories Act governs your hours, not the Hours of Work Rules.

WHEN A PLACE IS A FACTORY
The Act covers premises where, on any day of the preceding twelve months:
  • TEN OR MORE workers are employed in a manufacturing process carried on WITH the aid of power
  • Or TWENTY OR MORE workers are employed in a manufacturing process carried on WITHOUT the aid of power
A factory must be registered with the State Government, and a licence obtained. If you are asked the threshold, remember ten with power and twenty without.

OCCUPIER, WORKER AND MANUFACTURING PROCESS
  • OCCUPIER: the person who controls the affairs of the factory. On the Railways the occupier is appointed by the Ministry of Railways
  • WORKER: a person employed in a factory
  • MANUFACTURING PROCESS: making, repairing, packing, oiling, washing and cleaning
The guide's Industrial Relations chapter says the occupier on the Railways is appointed by the Central Government (Member of Railways). You may meet either answer.

INSPECTION AND ENFORCEMENT
Inspection is done by a FACTORY INSPECTOR appointed by the STATE GOVERNMENT. The Delhi Labour Department's page shows that machinery in Delhi:
  • Technical officers enforce the Act: Inspectors of Factories and Deputy Chief Inspectors of Factories
  • They work under the Chief Inspector of Factories, with overall control of the Labour Commissioner, Delhi
  • District Inspectors inspect, and issue Improvement Notices to defaulting managements
  • Legal action follows: the Inspectors file challans in the courts of Metropolitan Magistrates
  • The Deputy Chief Inspector supervises the Inspectors' work, district by district
If you are asked who inspects a factory, the answer is the Factory Inspector appointed by the State Government.

WHAT THE DELHI INSPECTORATE DOES UNDER THE ACT
  • (1) Approves factory building plans before construction or extension, under the Delhi Factories Rules, 1950
  • (2) Grants licences under those Rules, and acts against factories running without a licence
  • (3) Renews licences, through the Deputy Chief Inspectors of Factories
  • (4) Inspects on complaints, on serious or fatal accidents, and on its own to check compliance
The inspections check health, safety, welfare facilities, working hours, employment of young persons, and annual leave with wages. You can read this as one State's example, since the Rules named are the Delhi Factories Rules.

HOURS OF WORK IN A FACTORY
  • 48 HOURS in a week
  • 9 HOURS a day
  • No woman works in a factory between 7 PM and 6 AM
The guide's Industrial Relations chapter adds that overtime is paid at twice the ordinary rate of wages, and not more than 60 hours in a quarter. Compare this with your overtime under the Hours of Work Rules, which starts at one and a half times.
