Para 1101 — RESPONSIBILITY FOR LOSSESपैरा 1101 — हानियों का उत्तरदायित्व

Every public officer watches public expenditure and funds as a person of ORDINARY PRUDENCE would watch his own money. Every railway servant must clearly realise he is PERSONALLY RESPONSIBLE for two kinds of loss.

• Any loss to Government through his OWN fraud or negligence
• Any loss from ANOTHER servant's fraud or negligence, to the extent his own action or negligence contributed

So you answer for your own lapses, and for another's where you helped them happen.हर लोक अधिकारी सरकारी व्यय और निधियों पर वैसी चौकसी रखता है जैसी सामान्य विवेक वाला व्यक्ति अपने धन पर रखे। हर रेल कर्मचारी को स्पष्ट समझना चाहिए कि वह दो प्रकार की हानि के लिए स्वयं उत्तरदायी है।

• उसकी अपनी धोखाधड़ी या लापरवाही से सरकार को हुई कोई हानि
• किसी अन्य कर्मचारी की धोखाधड़ी या लापरवाही से हुई हानि, उस सीमा तक जहाँ उसकी अपनी कार्रवाई या लापरवाही ने योगदान दिया

अर्थात् आप अपनी चूक के लिए उत्तरदायी हैं, और दूसरे की चूक के लिए भी जहाँ आपने उसमें मदद की।

Para 1107 — LAXITY OF CONTROLपैरा 1107 — नियंत्रण में ढिलाई

A subordinate's delinquency may cause a loss, made easier by LAX SUPERVISION. Then the SUPERIOR OFFICER is also called strictly to account, and his PERSONAL LIABILITY carefully examined. Paras 1108 to 1110 — RECOVERIES OF LOSSESपैरा 1108 से 1110 — हानियों की वसूली

• Para 1108PECUNIARY LIABILITY is always considered, alongside other forms of disciplinary action. Its degree looks at the case AND at the servant's FINANCIAL CIRCUMSTANCES. The penalty should not be such as to IMPAIR HIS FUTURE EFFICIENCY.
• Para 1109
  • Where the loss came through FRAUD, every effort is made to recover the WHOLE AMOUNT from the guilty
  • A supervising officer whose laxity helped the fraud may be penalised directly or indirectly
  • Directly: making good in money a sufficient PROPORTION of the loss
  • Indirectly: REDUCTION OR STOPPAGE of his increments
• Para 1110Property lost, damaged or destroyed through CARELESSNESS may be recovered IN FULL, up to the servant's CAPACITY TO PAY. So recovery weighs what the servant can pay, and you should know fraud aims at the whole amount.

  • जिस पर्यवेक्षी अधिकारी की ढिलाई ने धोखाधड़ी में मदद की, उसे प्रत्यक्ष या परोक्ष दंड मिल सकता है
  • प्रत्यक्ष: हानि का पर्याप्त अनुपात धन से भरवाकर
  • परोक्ष: उसकी वेतनवृद्धियों में कमी या रोक से
• पैरा 1110लापरवाही से खोई, क्षतिग्रस्त या नष्ट संपत्ति पूरी वसूली जा सकती है, कर्मचारी की भुगतान क्षमता तक। अर्थात् वसूली कर्मचारी की भुगतान क्षमता देखती है, और आप जानिए कि धोखाधड़ी में लक्ष्य पूरी राशि है।

Paras 1111 and 1112 — WITHHOLDING OF PENSION AND PROVIDENT FUND BONUSपैरा 1111 और 1112 — पेंशन और भविष्य निधि बोनस रोकना

• Para 1111The Code gives this as one reason to avoid delay: in a long investigation, the servant may qualify for PENSION. A pension once SANCTIONED cannot be reduced or withheld for misconduct before retirement.
  • A servant under inquiry must not be allowed to RETIRE ON PENSION inadvertently while it continues
  • The same care applies to State Railway PROVIDENT FUND benefits
  • The investigating authority at once informs the Accounts Officer and the administrative authority
  • The administrative authority sees that pension is not sanctioned, nor the PF BONUS withdrawn
  • This holds until his culpability is decided, or the sanctioning authority decides not to wait
  NOTE: Rule 2308 of the Establishment Code, Volume II, and the decision under its Rule 2534, also apply.
• Para 1112That guilty persons have RETIRED and escaped punishment does not justify ABSOLVING others still in service. So you watch pension and PF bonus from the day an inquiry starts.

• पैरा 1111संहिता देरी से बचने का एक कारण यह बताती है: लंबी जाँच में कर्मचारी पेंशन का पात्र हो सकता है। एक बार स्वीकृत पेंशन सेवानिवृत्ति से पहले के कदाचार के लिए घटाई या रोकी नहीं जा सकती।
  • जाँच के अधीन कर्मचारी को उसके चलते असावधानी से पेंशन पर सेवानिवृत्त नहीं होने देना चाहिए
  • यही सावधानी राज्य रेल भविष्य निधि के लाभों पर लागू है
  • जाँच करने वाला प्राधिकारी तुरंत लेखा अधिकारी और प्रशासनिक प्राधिकारी को सूचित करता है
  • प्रशासनिक प्राधिकारी देखता है कि पेंशन स्वीकृत न हो, न भविष्य निधि बोनस निकाला जाए
  • यह तब तक रहता है जब तक उसका दोष तय न हो, या स्वीकृति प्राधिकारी प्रतीक्षा न करने का निर्णय न ले
  नोट: स्थापना संहिता, खंड II का नियम 2308, और उसके नियम 2534 के अंतर्गत निर्णय भी लागू होते हैं।
• पैरा 1112दोषी व्यक्ति सेवानिवृत्त होकर दंड से बच गए, यह सेवा में बने अन्य दोषियों को छोड़ देने का औचित्य नहीं है। अर्थात् जाँच शुरू होने के दिन से आप पेंशन और भविष्य निधि बोनस पर नजर रखिए।
