Before you start on the sections, look at the shape of the Act. Part XVII of the Constitution was divided into four chapters. This Act is not divided at all. It runs straight from Section 1 to Section 9. Remember this. In the paper you may go hunting for the "parts" of the Act, and there are none.
The nine sections do fall into groups by the work they do. The grouping below is only to help you hold them in your head. It is not written in the Act, so never answer as if the Act itself says so.

THE OPENING (SECTIONS 1 AND 2)शुरुआत (धारा 1 और 2)
Section 1 — SHORT TITLE AND COMMENCEMENTधारा 1 — संक्षिप्त नाम और प्रारंभ
Every Act opens by telling you its own name and its own starting date. Read this one slowly, because the Act does not start on a single day.
- 1(1) — THE NAMEThe Act is called the OFFICIAL LANGUAGES ACT, 1963. See the word LANGUAGES. It is plural. Write "Official Language Act" and you lose an easy mark. Now be careful with the Rules made later, because a common memory aid gets this wrong. Their full name in Rule 1 is the OFFICIAL LANGUAGES (USE FOR OFFICIAL PURPOSES OF THE UNION) RULES, 1976. That is LANGUAGES, plural, just like the Act. Everybody shortens it to the OFFICIAL LANGUAGE RULES, 1976, and that short form is singular. Both names mean the same instrument, so give the long one if the paper asks for the full title.
- 1(2) — TWO DIFFERENT STARTING DATESSection 3 came into force on 26 JANUARY 1965. The rest of the Act came into force on such dates as the Central Government appointed by notification in the Official Gazette. Different dates could be appointed for different provisions. Now think for a moment about why the Act was passed in 1963 but Section 3 waited till 1965. The fifteen years given by Article 343(2) were ending on 26 January 1965. Section 3 had to begin on the very day that protection ended, so that English did not stop even for one day. Parliament passed the Act two years early and kept it ready. That is planning, not delay.

THE OPENING (SECTIONS 1 AND 2)शुरुआत (धारा 1 और 2)
Section 2 — DEFINITIONSधारा 2 — परिभाषाएँ
Only TWO words are defined in this whole Act. When an Act defines so few words, you can be sure each one carries weight. Both have been asked.
- 2(a) — APPOINTED DAYIn relation to Section 3, the appointed day means 26 JANUARY 1965. In relation to any other provision of the Act, it means the day on which THAT provision comes into force. So "appointed day" does not have one fixed meaning all through the Act. It changes with the section you are reading. Here you may get confused, because you learn one date and use it everywhere. Learn the rule, not the date.
- 2(b) — HINDIHindi means HINDI IN DEVANAGARI SCRIPT. See how short the definition is, and how much it settles. Hindi written in any other script is not Hindi for this Act. You have already met this idea in Article 343(1), where the official language of the Union is Hindi in Devanagari script. The Act is not saying anything new here. It is only carrying the Constitution's words forward, and that is why the two match word for word.
- 2(क) — नियत दिनधारा 3 के संबंध में नियत दिन का अर्थ है 26 जनवरी 1965। अधिनियम के किसी अन्य उपबंध के संबंध में इसका अर्थ है वह दिन जिस दिन वह उपबंध लागू होता है। तो "नियत दिन" का अर्थ पूरे अधिनियम में एक-सा नहीं है। जो धारा आप पढ़ रहे हैं, उसके साथ यह बदल जाता है। यहीं आप उलझ सकते हैं, क्योंकि आप एक तारीख रट लेते हैं और हर जगह लगा देते हैं। तारीख नहीं, नियम याद कीजिए।

THE HEART OF THE ACT (SECTION 3)अधिनियम का हृदय (धारा 3)
Section 3 — HOW ENGLISH CONTINUESधारा 3 — अंग्रेजी कैसे बनी रहती है
If you learn only one section of this Act, learn this one. It is the section that lets English continue after 26 January 1965, and nearly every question from the Act comes from here. Go through it slowly, sub-section by sub-section.
In the Act itself the heading of this Section reads — CONTINUATION OF ENGLISH LANGUAGE FOR OFFICIAL PURPOSES OF THE UNION AND FOR USE IN PARLIAMENT. The short heading above is ours, so you can find the Section at a glance. If the paper asks for the heading, write these words.
- 3(1) — ENGLISH MAY CONTINUE, IN ADDITION TO HINDIEven after the fifteen years of the Constitution were over, English may continue from the appointed day, IN ADDITION TO Hindi. It continues for two things.
- CLAUSE (a) covers all official purposes of the Union for which it was being used just before that day.
- CLAUSE (b) covers the transaction of business in Parliament.
- FIRST PROVISO — WRITING TO A STATE THAT HAS NOT ADOPTED HINDIENGLISH SHALL BE USED for communication between the Union and a State which has not adopted Hindi as its official language. See the word SHALL. In the main rule English MAY be used. Here it MUST be. This is the sharpest point in the whole section, so mark it now.
- SECOND PROVISO — A HINDI STATE WRITING TO A NON-HINDI STATETake a State which HAS adopted Hindi, writing to a State which has NOT. That Hindi communication SHALL BE ACCOMPANIED BY AN ENGLISH TRANSLATION. The receiving State must never be left with a letter it cannot read.
- THIRD PROVISO — THE FREEDOM OF A NON-HINDI STATEA State which has not adopted Hindi is not stopped from using Hindi. It may use it with the Union, with a Hindi State, or with any other State by agreement. And in that case English is NOT OBLIGATORY. Now see the thought behind all three together. Hindi is never forced on anybody, and nobody is ever stopped from using Hindi by choice. Protection, not compulsion.
- 3(2) — TRANSLATION UNTIL THE STAFF LEARN HINDISub-section (1) looked outward, at the Union and the States. This one looks inward, at the Union's own machinery, and it covers three situations. (i) Between one Ministry, Department or office of the Central Government and another. (ii) Between such an office and any corporation or company owned or controlled by the Central Government. (iii) Between one such corporation or company and another. In all three, where Hindi or English is used, a TRANSLATION in the other language SHALL ALSO BE PROVIDED. This lasts only until the staff concerned have acquired a WORKING KNOWLEDGE of Hindi. It is a helping provision, not a punishing one. The employee is given time to learn, and he is not blamed while he is learning.
- 3(3) — THE DOCUMENTS THAT MUST BE IN BOTH LANGUAGESA named list of documents must be issued in Hindi AND English, both together. This is the most examined provision in the whole Rajbhasha syllabus. Its list runs to fourteen items, and they are set out separately. Learn it there, group by group.
- 3(4) — POWER TO PRESCRIBE THE LANGUAGE OF UNION WORKThe Central Government may make rules under SECTION 8 for the language or languages to be used for the official purposes of the Union. That includes the working of any Ministry, Department, Section or Office. In making those rules, due consideration must be given to two things. The QUICK AND EFFICIENT DISPOSAL of official business, and the INTERESTS OF THE GENERAL PUBLIC. The sub-section also protects the employee, and that is the half the paper asks about. The rules SHALL ENSURE that a person having proficiency in EITHER Hindi OR English can function effectively. He is NOT to be PLACED AT A DISADVANTAGE for not having proficiency in BOTH. So an employee who knows only Hindi is safe, and an employee who knows only English is equally safe. The OFFICIAL LANGUAGE RULES, 1976 rest on this sub-section together with Section 8.
- 3(5) — HOW LONG THESE PROVISIONS LASTClause (a) of 3(1), and the whole of 3(2), 3(3) and 3(4), remain in force until two things happen in order. FIRST, the legislatures of ALL the States which have not adopted Hindi pass resolutions to discontinue English. SECOND, after considering those resolutions, EACH HOUSE of Parliament passes such a resolution too. Look at that list once more. It is clause (a) of 3(1) ONLY. Clause (b), business in Parliament, is not in it. Write "the whole of 3(1)" and you lose the mark. And see what the condition really means. If even ONE non-Hindi State declines, English continues. That is why English is still in our offices today.
- 3(1) — हिंदी के अतिरिक्त अंग्रेजी चलती रह सकती हैसंविधान की पंद्रह वर्ष की अवधि बीत जाने पर भी, नियत दिन से अंग्रेजी हिंदी के अतिरिक्त चलती रह सकती है। यह दो कामों के लिए चलती है।
- खंड (क) — संघ के वे सभी राजकीय प्रयोजन जिनके लिए वह उस दिन से ठीक पहले प्रयोग में आ रही थी।
- खंड (ख) — संसद में कार्य का संचालन।
- पहला परंतुक — उस राज्य को पत्र जिसने हिंदी नहीं अपनाईसंघ और उस राज्य के बीच पत्राचार के लिए, जिसने हिंदी को अपनी राजभाषा नहीं अपनाया है, अंग्रेजी का प्रयोग किया जाएगा। "जाएगा" शब्द देखिए। मुख्य नियम में अंग्रेजी का प्रयोग किया जा सकता है। यहाँ करना ही होगा। पूरी धारा में यही सबसे तीखा बिंदु है, इसे अभी निशान लगा लीजिए।
- दूसरा परंतुक — हिंदी राज्य से अहिंदी राज्य को पत्रएक राज्य ने हिंदी अपनाई है और दूसरे ने नहीं। इन दोनों के बीच हिंदी चले, तो उस हिंदी पत्र के साथ अंग्रेजी अनुवाद होगा। पाने वाले राज्य के पास ऐसा पत्र कभी न रह जाए जिसे वह पढ़ ही न सके।
- तीसरा परंतुक — अहिंदीभाषी राज्य की स्वतंत्रताजिस राज्य ने हिंदी नहीं अपनाई है, उसे हिंदी का प्रयोग करने से कोई नहीं रोकता। वह संघ के साथ, किसी हिंदी राज्य के साथ, या करार द्वारा किसी अन्य राज्य के साथ हिंदी चला सकता है। और ऐसी दशा में अंग्रेजी का प्रयोग अनिवार्य नहीं होगा। अब तीनों को साथ रखकर उनके पीछे का विचार देखिए। हिंदी किसी पर थोपी नहीं जाती, और अपनी इच्छा से हिंदी अपनाने से किसी को रोका नहीं जाता। संरक्षण, बाध्यता नहीं।
- 3(2) — जब तक कर्मचारी हिंदी न सीख लें, तब तक अनुवादउपधारा (1) बाहर की ओर देख रही थी — संघ और राज्य। यह भीतर की ओर देखती है, संघ के अपने तंत्र की ओर, और इसमें तीन स्थितियाँ आती हैं। (i) केंद्र सरकार के एक मंत्रालय, विभाग या कार्यालय और दूसरे के बीच। (ii) ऐसे कार्यालय और केंद्र सरकार के स्वामित्व या नियंत्रण वाले किसी निगम या कंपनी के बीच। (iii) ऐसे एक निगम या कंपनी और दूसरे के बीच। तीनों में, जहाँ हिंदी या अंग्रेजी का प्रयोग होता है, वहाँ दूसरी भाषा में अनुवाद भी दिया जाएगा। यह केवल तब तक है जब तक संबंधित कर्मचारी हिंदी का कार्यसाधक ज्ञान प्राप्त न कर लें। यह सहायता देने वाला उपबंध है, दंड देने वाला नहीं। कर्मचारी को सीखने का समय मिलता है, और सीखते रहने के दौरान उसे दोषी नहीं ठहराया जाता।
- 3(3) — वे दस्तावेज जो दोनों भाषाओं में होने ही चाहिएनाम लेकर गिनाए गए दस्तावेज हिंदी और अंग्रेजी, दोनों में एक साथ जारी होने चाहिए। पूरे राजभाषा पाठ्यक्रम में सबसे अधिक पूछा जाने वाला उपबंध यही है। इसकी सूची चौदह मदों तक जाती है, और वे अलग से दी गई हैं। उसे वहीं, समूह दर समूह, सीखिए।
- 3(4) — संघ के कामकाज की भाषा नियत करने की शक्तिकेंद्र सरकार धारा 8 के अधीन नियम बनाकर संघ के राजकीय प्रयोजनों के लिए प्रयोग की जाने वाली भाषा या भाषाएँ नियत कर सकती है। इसमें किसी मंत्रालय, विभाग, अनुभाग या कार्यालय का कामकाज भी आता है। ऐसे नियम बनाते समय सरकारी काम के शीघ्र और कुशल निपटान तथा जनसाधारण के हित पर सम्यक् ध्यान देना होगा। यह उपधारा कर्मचारी की रक्षा भी करती है, और परीक्षा इसी आधे भाग को पूछती है। नियम यह सुनिश्चित करेंगे कि जिस व्यक्ति को हिंदी या अंग्रेजी में से किसी एक में प्रवीणता है, वह प्रभावी ढंग से काम कर सके, और दोनों में प्रवीणता न होने के आधार पर उसे हानि की स्थिति में न रखा जाए। अर्थात् जिसे केवल हिंदी आती है वह सुरक्षित है, और जिसे केवल अंग्रेजी आती है वह भी उतना ही सुरक्षित है। राजभाषा नियम, 1976 इसी उपधारा पर, धारा 8 के साथ, टिके हुए हैं।
- 3(5) — ये उपबंध कब तक चलेंगे3(1) का खंड (क), तथा पूरी 3(2), 3(3) और 3(4) तब तक लागू रहेंगी जब तक क्रम से दो बातें न हो जाएँ। पहली, जिन राज्यों ने हिंदी नहीं अपनाई है, उन सभी के विधानमंडल अंग्रेजी बंद करने के संकल्प पारित कर दें। दूसरी, उन संकल्पों पर विचार करने के बाद संसद का प्रत्येक सदन भी ऐसा संकल्प पारित कर दे। इस सूची को एक बार फिर देखिए। यह 3(1) का केवल खंड (क) है। खंड (ख), अर्थात् संसद का कार्य, इसमें नहीं है। आप "पूरी 3(1)" लिखेंगे तो अंक गँवा देंगे। और देखिए इस शर्त का वास्तविक अर्थ क्या है। यदि एक भी अहिंदीभाषी राज्य मना कर दे, तो अंग्रेजी चलती रहेगी। इसीलिए आज भी हमारे दफ्तरों में अंग्रेजी है।

THE MACHINERY (SECTION 4)तंत्र (धारा 4)
Section 4 — COMMITTEE ON OFFICIAL LANGUAGEधारा 4 — राजभाषा संबंधी समिति
A law that gives orders but never checks the result is a weak law. Section 4 is the checking arrangement of this Act. This is where most people slip, so go slowly.
- 4(1) — WHEN IT IS CONSTITUTED, AND HOWThe Committee comes only AFTER THE EXPIRATION OF TEN YEARS from the date on which SECTION 3 came into force. Do the arithmetic yourself, because this is where the mistake happens. Section 3 came into force on 26 JANUARY 1965, so the ten years ran out on 26 JANUARY 1975, and the Committee became possible only from 1975. It was actually constituted in 1976. Count from the day SECTION 3 started, never from 1963, or your answer will be two years out. It is not constituted automatically either. A resolution must be MOVED in EITHER HOUSE of Parliament, WITH THE PREVIOUS SANCTION OF THE PRESIDENT, and PASSED BY BOTH HOUSES. The word PREVIOUS is doing real work there, because the sanction comes before the moving. Hold the pattern as a phrase. Either House may begin, both Houses must agree.
- 4(2) — THIRTY MEMBERS, AND HOW THEY COMEThe Committee has THIRTY members. TWENTY from the HOUSE OF THE PEOPLE (Lok Sabha) and TEN from the COUNCIL OF STATES (Rajya Sabha). They are elected by the members of their own House by the system of PROPORTIONAL REPRESENTATION by means of the SINGLE TRANSFERABLE VOTE. Write it as 20 plus 10, in that order. If you write 10 and 20 the answer is wrong, and here is how to be sure without memorising. The Lok Sabha is the bigger House, so it sends the bigger share. Do not shorten the method in your answer either. "Proportional representation" alone is only half the name.
- DO NOT CONFUSE THIS WITH ARTICLE 344(4)This is the mistake the paper is waiting for. Article 344(4) also speaks of a Committee of thirty, with the same 20 and 10 split. But that one is a committee of Parliament. Its job is to examine the recommendations of the Official Language Commission, appointed by the President under ARTICLE 344(1). The Committee here in Section 4 is created by an Act, and its job is to review progress on the ground. Keep the source clear. 344 is the Constitution, Section 4 is the Act. So read that one word before you answer. If the question says ARTICLE it is the Constitution, and if it says SECTION it is this Act.
- 4(3) — WHAT THE COMMITTEE HAS TO DOIt is the DUTY of the Committee to review the progress made in the use of Hindi for the official purposes of the Union. It must then submit a REPORT TO THE PRESIDENT with its recommendations. The President causes that report to be laid before EACH HOUSE of Parliament, and sends it to ALL the State Governments. Follow that path once more. Committee to President, President to both Houses, President to every State Government. And ask why the States get a copy at all. Because the next sub-section lets the President act on the report, and the States must have had their chance to say what they think first.
- 4(4) — THE PRESIDENT'S DIRECTIONS, AND THE LIMIT ON THEMThe President considers the report AND the views of the State Governments. Then he may issue directions in accordance with the WHOLE OR ANY PART of that report. Note that he is not bound to take all of it. But the proviso puts a fence around the power. The direction issued SHALL NOT BE INCONSISTENT WITH SECTION 3. See what that fence protects. Section 3 is the guarantee that English continues, and without the proviso a direction could undo by order what Parliament had promised by law. This proviso was put in by ACT 1 OF 1968, the same period as the Official Language Resolution. The whole settlement was being locked down at once.
- 4(1) — कब और कैसे गठित होती हैसमिति उसी दिन से दस वर्ष बीतने के बाद बनती है जिस दिन धारा 3 लागू हुई। गणित स्वयं कीजिए, क्योंकि गलती यहीं होती है। धारा 3, 26 जनवरी 1965 को लागू हुई, इसलिए दस वर्ष 26 जनवरी 1975 को पूरे हुए और समिति 1975 से ही संभव हुई। वह वास्तव में 1976 में गठित हुई। गिनती धारा 3 के लागू होने के दिन से कीजिए, 1963 से कभी नहीं, वरना उत्तर दो वर्ष चूक जाएगा। यह अपने आप भी गठित नहीं होती। संसद के किसी भी सदन में, राष्ट्रपति की पूर्व मंजूरी से, संकल्प रखा जाना चाहिए और दोनों सदनों द्वारा पारित होना चाहिए। "पूर्व" शब्द यहाँ वास्तविक काम कर रहा है, क्योंकि मंजूरी संकल्प रखे जाने से पहले आती है। इस ढाँचे को एक वाक्य के रूप में पकड़िए। शुरू कोई भी सदन कर सकता है, सहमत दोनों सदनों को होना है।
- 4(2) — तीस सदस्य, और वे आते कैसे हैंसमिति में तीस सदस्य होते हैं। बीस लोक सभा से और दस राज्य सभा से। इन्हें अपने-अपने सदन के सदस्य आनुपातिक प्रतिनिधित्व पद्धति से, एकल संक्रमणीय मत द्वारा चुनते हैं। इसे 20 और फिर 10 के क्रम में लिखिए। यदि आपने 10 और 20 लिख दिया तो उत्तर गलत है, और बिना रटे निश्चित होने का तरीका यह है। लोक सभा बड़ा सदन है, इसलिए वह बड़ा हिस्सा भेजता है। उत्तर में पद्धति का नाम भी छोटा मत कीजिए। अकेला "आनुपातिक प्रतिनिधित्व" नाम का आधा भाग ही है।
- इसे अनुच्छेद 344(4) से मत मिलाइएयही वह गलती है जिसकी परीक्षा प्रतीक्षा कर रही है। अनुच्छेद 344(4) में भी तीस सदस्यों की समिति आती है, वही 20 और 10 का बँटवारा। किंतु वह संसद की समिति है। उसका काम है अनुच्छेद 344(1) के अधीन राष्ट्रपति द्वारा नियुक्त राजभाषा आयोग की सिफारिशों की जाँच करना। धारा 4 वाली समिति एक अधिनियम से बनी है, और उसका काम जमीन पर हुई प्रगति की समीक्षा करना है। स्रोत साफ रखिए। 344 संविधान है, धारा 4 अधिनियम है। इसलिए उत्तर देने से पहले वह एक शब्द पढ़ लीजिए। प्रश्न में "अनुच्छेद" लिखा हो तो संविधान है, और "धारा" लिखा हो तो यही अधिनियम है।
- 4(3) — समिति को करना क्या हैसंघ के राजकीय प्रयोजनों में हिंदी के प्रयोग में हुई प्रगति की समीक्षा करना समिति का कर्तव्य होगा। उसके बाद उसे, अपनी सिफारिशों सहित, राष्ट्रपति को प्रतिवेदन देना होगा। राष्ट्रपति उस प्रतिवेदन को संसद के प्रत्येक सदन के समक्ष रखवाते हैं और सभी राज्य सरकारों को भेजते हैं। यह रास्ता एक बार फिर दोहराइए। समिति से राष्ट्रपति, राष्ट्रपति से दोनों सदन, राष्ट्रपति से हर राज्य सरकार। और यह भी पूछिए कि राज्यों को प्रति मिलती ही क्यों है। क्योंकि अगली उपधारा राष्ट्रपति को उस प्रतिवेदन पर कार्रवाई करने देती है, और उससे पहले राज्यों को अपनी बात कहने का अवसर मिल जाना चाहिए।

- 5(1) — WHICH HINDI TEXT IS THE REAL ONETake a Hindi translation published under the AUTHORITY OF THE PRESIDENT in the Official Gazette, on or after the appointed day. It is DEEMED TO BE THE AUTHORITATIVE TEXT in Hindi. This covers a Central Act and an Ordinance promulgated by the President. It also covers any order, rule, regulation or bye-law issued under the Constitution or under any Central Act. Hold on to the two conditions, because both are asked. It must be published by the authority of the PRESIDENT, and it must be published in the OFFICIAL GAZETTE. A Hindi translation printed by anyone else, however good, is not the authoritative text.
- 5(2) — BILLS AND AMENDMENTS IN PARLIAMENTFrom the appointed day, the rule covers every Bill to be introduced in either House of Parliament, and every amendment to be moved. The authoritative English text must be accompanied by a Hindi translation. That translation must be authorised in the manner prescribed by rules made under this Act. See what this does. Hindi comes in at the drafting stage itself, not after the law is passed. That is why the Hindi text of a new law is ready on the day it is enacted.

- WHEN SECTION 6 APPLIESOnly where the Legislature of a State has prescribed some language OTHER THAN HINDI for its Acts, or for Ordinances promulgated by the Governor. If a State already works in Hindi, this section has nothing to do. That is what "in certain cases" means.
- WHAT MAY THEN BE PUBLISHEDIn such a State, a Hindi translation may be published under the authority of the GOVERNOR. It goes in the OFFICIAL GAZETTE OF THE STATE, on or after the appointed day. That Hindi translation is then deemed to be the AUTHORITATIVE TEXT in Hindi.
Compare with Section 5 and the pattern becomes easy.

- THE ENGLISH TRANSLATION IS STILL COMPULSORYThe Hindi translation is IN ADDITION TO the English translation already required by Article 348(3) of the Constitution. Hindi does not replace English here. You may be tempted to answer that Hindi comes instead of English. It does not.

- WHO PERMITS IT, AND WITH WHOSE CONSENTThe GOVERNOR of a State may authorise the use of Hindi, or the official language of that State, IN ADDITION TO English. This is for a judgment, decree or order of the High Court of that State. But the Governor cannot do it alone. He needs the PREVIOUS CONSENT OF THE PRESIDENT. Learn this pair together — Governor acts, President consents, and the consent comes first.
- THE TRANSLATION THAT MUST FOLLOWSuppose a judgment, decree or order is passed in such a language. It MUST then be accompanied by an English translation, issued under the authority of the HIGH COURT. So English never disappears from the record. That is the safeguard, and it is a favourite question.
- WHERE IT DOES NOT REACHSection 7 covers a judgment, decree or order only. It says nothing about pleadings or arguments. And under Article 348(1) the language of the High Court's proceedings is still English unless Parliament provides otherwise. Do not stretch this section further than it goes.

POWER TO MAKE RULES (SECTION 8)नियम बनाने की शक्ति (धारा 8)
Section 8 — POWER TO MAKE RULESधारा 8 — नियम बनाने की शक्ति
This is a short section, and you will want to skip it. Do not. Every rule you study in the Official Language Rules, 1976 stands on this section. If the base falls, the whole building falls.
- 8(1) — WHO MAKES THE RULESThe CENTRAL GOVERNMENT may, by notification in the Official Gazette, make rules for carrying out the purposes of this Act. Now join it to what you read in Section 3. The OFFICIAL LANGUAGE RULES, 1976 were made under SECTION 8 READ WITH SECTION 3(4). Write both together. Section 8 gives the power to make rules, and Section 3(4) says what those rules may cover.
- 8(2) — LAYING BEFORE PARLIAMENTEvery rule made must be laid before EACH HOUSE of Parliament. It goes as soon as may be after it is made, while the House is in session, for a total of THIRTY DAYS. Those thirty days may be in one session, or spread over two successive sessions. If both Houses agree to modify the rule, it has effect only in that modified form. If both Houses agree that the rule should not be made, it has no effect at all. But whatever was already done under that rule before the change stays valid. Think about why the law protects past action. An officer who followed a rule in good faith should not be punished later because Parliament changed its mind. That is a fair rule, and it is easy to remember once you see the fairness in it.
- 8(1) — नियम कौन बनाता हैकेंद्र सरकार, राजपत्र में अधिसूचना द्वारा, इस अधिनियम के प्रयोजनों को पूरा करने के लिए नियम बना सकती है। अब इसे धारा 3 में पढ़ी बात से जोड़िए। राजभाषा नियम, 1976 धारा 8 के साथ धारा 3(4) पढ़कर बनाए गए थे। दोनों साथ लिखिए। धारा 8 नियम बनाने की शक्ति देती है, और धारा 3(4) बताती है कि वे नियम किन बातों पर हो सकते हैं।

- WHICH TWO SECTIONS ARE EXCLUDEDThe provisions of SECTION 6 and SECTION 7 shall not apply to the State of Jammu and Kashmir. Only these two.
- Section 6 is the Hindi translation of State Acts.
- Section 7 is the use of Hindi in High Court judgments.
- WHAT IS NOT EXCLUDEDSection 3 applies there. So does Section 4, and Section 5, and Section 8. You may remember only that "something was excluded for Jammu and Kashmir", and then guess Section 3. That is wrong, and it is the commonest error from this Act. Say the numbers to yourself — SIX and SEVEN.
- A NOTE ON THE PRESENT POSITIONThis section was written when Jammu and Kashmir was a State with a special constitutional position. That position was changed in 2019 and the area is now organised as Union Territories. The words of Section 9 are given above as the Act carries them. In the examination, answer from the text of the Act unless the question itself asks about the present position.
