THE IDENTITY OF THE ACTअधिनियम की पहचान
These are the plain identity facts of the Act. They look dry, but they are the easiest marks in the paper, so fix them once and keep them.
- ITS NUMBERThe Official Languages Act, 1963 is ACT NO. 19 OF 1963.
- THE DAY IT RECEIVED ASSENT10 MAY 1963. Note carefully that this is the day of assent, not the day the Act started working.
- HOW MANY SECTIONSNINE sections, as the Act stands after the 1967 amendment.
- THE NAME, EXACTLYOFFICIAL LANGUAGES ACT — plural. The rules made later are the OFFICIAL LANGUAGE RULES, 1976 — singular. This pair is asked, and it is a free mark once you have noticed it.
- WHICH SECTION MATTERS MOSTSECTION 3. It is the heart of the Act, and its name tells you why — CONTINUATION OF ENGLISH LANGUAGE. Read the title of the Act for the first time and you expect it to be about Hindi. Then you find its main section protecting English. Do not be surprised in the examination hall.
- इसकी संख्याराजभाषा अधिनियम, 1963 अर्थात् 1963 का अधिनियम संख्या 19।

THE FIVE DATES THAT GET MIXED UPवे पाँच तारीखें जो आपस में उलझ जाती हैं
You lose more marks here than anywhere else in this Act. Five different dates sit close together, and every one of them has been asked. Read them slowly, once, in this order.
- 10 MAY 1963 — ASSENTThe Act received assent on this day. The year in the Act's name comes from here.
- 26 JANUARY 1965 — SECTION 3 CAME INTO FORCEThis is the day the main section began to work, matching the end of the fifteen years in Article 343(2).
- 1967 — THE ACT WAS AMENDEDThe amendment reshaped Section 3 and added the condition in Section 3(5).
- 19 MAY 1969 — SECTION 6 CAME INTO FORCE
- 7 MARCH 1970 — SECTION 7 CAME INTO FORCENow see why the dates are spread out. Section 1(2) allowed the Central Government to appoint DIFFERENT DATES FOR DIFFERENT PROVISIONS. So the Act did not switch on all at once. Only Section 3 had its date fixed in the Act itself; the rest waited for notification. One more warning. Many books write loosely that "Section 3(3) came into force on 26 January 1965". What Section 1(2) actually fixes for that date is SECTION 3. Sub-section (3) in its present shape came with the 1967 amendment. If the question quotes the Act, answer SECTION 3.

THE 1967 AMENDMENT AND THE POLICY OF BILINGUALISM1967 का संशोधन और द्विभाषिकता की नीति
You have already seen what the 1967 amendment did to Section 3(5). Now see what it did to the country's policy, because the word BILINGUALISM comes from here and it is asked by name.
The amendment gave effect to an assurance. ENGLISH WOULD CONTINUE AS AN ASSOCIATE OFFICIAL LANGUAGE, for as long as the non-Hindi speaking States wished. Note the term ASSOCIATE OFFICIAL LANGUAGE. Hindi remains the official language under Article 343(1); English stands beside it as the associate.
That arrangement is what we call the POLICY OF BILINGUALISM. The Union works in TWO languages together, not in one replacing the other.
Here is the simplest way to hold it.
- HINDI is the OFFICIAL LANGUAGE.
- ENGLISH is the ASSOCIATE OFFICIAL LANGUAGE.
- Neither throws the other out.
- हिंदी राजभाषा है।
- अंग्रेजी सहभाषा है।
- कोई किसी को बाहर नहीं करती।

WHERE THE 1976 RULES COME FROM1976 के नियम कहाँ से आते हैं
The Act sets the policy. The day-to-day working comes from the RULES. Which letter goes in which language, who must learn Hindi, what a Notified Office is — all of that sits in the Rules. So you must be able to say exactly where the Rules stand.
The OFFICIAL LANGUAGE (USE FOR OFFICIAL PURPOSES OF THE UNION) RULES, 1976 were made under SECTION 8 READ WITH SUB-SECTION (4) OF SECTION 3.
Learn both halves and you can never be caught.
- SECTION 8 GIVES THE POWERIt is the section that lets the Central Government make rules at all.
- SECTION 3(4) SAYS WHAT THE RULES MAY COVERIt is the section that lets those rules fix the language of the Union's own work. Much study material shortens this and writes only "made under Section 3(4)". That is not wrong, but it is only half. If the question gives you room, write SECTION 8 READ WITH SECTION 3(4), and your answer will be complete.
- धारा 8 शक्ति देती हैयही वह धारा है जो केंद्र सरकार को नियम बनाने देती है।

TWO TERMS FROM THE RULES THAT ARE ALWAYS CONFUSEDनियमों के दो शब्द जिनमें हमेशा भ्रम होता है
These two look alike and mean different things. The paper knows you may confuse them, so it asks. Take thirty seconds here and save a mark later.
- PROFICIENCY IN HINDI — RULE 9The higher standard. An employee is treated as having proficiency in Hindi in the manner described in RULE 9.
- WORKING KNOWLEDGE OF HINDI — RULE 10The lower, working standard. It is described in RULE 10.
Now a trick to keep them straight. Take them in order of the rule number and they are also in order of difficulty.
- RULE 9 is PROFICIENCY, the bigger word and the harder standard.
- RULE 10 is WORKING KNOWLEDGE, the everyday standard.
- हिंदी में प्रवीणता — नियम 9ऊँचा स्तर। किसी कर्मचारी को हिंदी में प्रवीण उस रीति से माना जाता है जो नियम 9 में बताई गई है।
- हिंदी का कार्यसाधक ज्ञान — नियम 10नीचे वाला, काम चलाने का स्तर। यह नियम 10 में बताया गया है।

WHAT A NOTIFIED OFFICE ISअधिसूचित कार्यालय क्या होता है
You will meet this term again and again in the Rules, so settle it here.
A NOTIFIED OFFICE is an office notified under SUB-RULE (4) OF RULE 10 of the Official Language Rules, 1976.
Understand what is happening behind that dry sentence. Suppose 80 per cent or more of the staff of an office have acquired a WORKING KNOWLEDGE of Hindi. That office can then be notified in the Gazette. Once it is notified, more of its work is expected to be done in Hindi. The staff can actually do it now.
See the fairness in the design. The office is not ordered to work in Hindi first and taught afterwards. The staff learn first, and the obligation follows. That is the 1968 Resolution's idea of persuasion showing up in a rule.
For the examination, remember the citation exactly — RULE 10(4).नियमों में यह शब्द बार-बार मिलेगा, इसलिए यहीं तय कर लीजिए।
अधिसूचित कार्यालय वह कार्यालय है जो राजभाषा नियम, 1976 के नियम 10 की उपनियम (4) के अधीन अधिसूचित किया गया हो।
इस सूखे वाक्य के पीछे क्या हो रहा है, यह समझिए। मान लीजिए किसी कार्यालय के 80 प्रतिशत या अधिक कर्मचारी हिंदी का कार्यसाधक ज्ञान प्राप्त कर लेते हैं। तब वह कार्यालय राजपत्र में अधिसूचित किया जा सकता है। अधिसूचित हो जाने पर उससे अधिक काम हिंदी में होने की अपेक्षा की जाती है। अब कर्मचारी वास्तव में कर सकते हैं।
इस रचना में निहित न्याय देखिए। कार्यालय को पहले हिंदी में काम करने का आदेश देकर बाद में सिखाया नहीं जाता। पहले कर्मचारी सीखते हैं, फिर दायित्व आता है। यह 1968 के संकल्प वाली समझाने की भावना का एक नियम में दिखाई देना है।
