THE RULES AS A WHOLEसंपूर्ण नियम
TWELVE RULES, AND WHERE THEY COME FROMबारह नियम, और वे आए कहाँ से
Before the rules themselves, fix five things about the instrument. Each one is asked on its own.
  • WHERE THEY COME FROMThey were made under SECTION 8 READ WITH SUB-SECTION (4) OF SECTION 3 of the Official Languages Act, 1963. You met that pairing on the Act pages. Section 8 gives the power to make rules, and Section 3(4) says what those rules may cover.
  • THEIR NUMBER AND DATEG.S.R. 1052, published on 17 JULY 1976.
  • HOW FAR THEY REACHThey extend to THE WHOLE OF INDIA EXCEPT THE STATE OF TAMIL NADU. This exception is asked very often, so mark it now.
  • HOW MANY RULESTWELVE. The Act has nine sections, the Rules have twelve rules. You may swap the two numbers, so say them together once — ACT NINE, RULES TWELVE.
  • HOW MANY TIMES THEY HAVE BEEN AMENDEDTHREE TIMES — in 1987, 2007 and 2011. Learn what the last two did, because both changed a list you have to know. The 2007 amendment (G.S.R. 162 of 3 August 2007) SUBSTITUTED CLAUSE (f), the definition of REGION A. The 2011 amendment (G.S.R. 145 of 4 May 2011) SUBSTITUTED CLAUSE (g), the definition of REGION B. The 1987 amendment is G.S.R. 790 of 24 October 1987. So an old list of Region A or Region B States will mislead you, and that is exactly why the amendments are asked. The twelve fall into groups by the work they do. This grouping is only a study aid and is not written in the Rules, so never answer as if it were.

THE OPENING (RULES 1 AND 2)शुरुआत (नियम 1 और 2)
Rule 1SHORT TITLE, EXTENT AND COMMENCEMENTनियम 1 — संक्षिप्त नाम, विस्तार और प्रारंभ
A short rule, but its three sub-rules carry three separate questions for you.
  • 1(i)THE NAME, AND A WARNING ABOUT ITThe full name given by the rule itself is the OFFICIAL LANGUAGES (USE FOR OFFICIAL PURPOSES OF THE UNION) RULES, 1976. Look at the word LANGUAGES. It is plural here, exactly as in the Act. In everyday use, and on the Department's own page, they are called the OFFICIAL LANGUAGE RULES, 1976, with LANGUAGE singular. Both names refer to the same instrument. If the paper asks for the full title, give the long one from this rule.
  • 1(ii)WHERE THEY EXTENDThey extend to THE WHOLE OF INDIA EXCEPT THE STATE OF TAMIL NADU. Note what kind of exception this is. It is written into the rule itself, so it is not a relaxation granted case by case. The Rules simply do not run there.
  • 1(iii)WHEN THEY CAME INTO FORCEOn the date of their PUBLICATION IN THE OFFICIAL GAZETTE. That date is 17 JULY 1976, the day G.S.R. 1052 was published. So the Rules do not carry a commencement date of their own inside the text. They start when the Gazette says so. A NOTE ON THAT DATE. Two official documents give it differently. The note appended to the 2011 amendment says the principal rules were published as G.S.R. 1052 OF 17 JULY 1976. The 9th Report of the Committee of Parliament says they were published in the Gazette on 28 JUNE 1976. Answer 17 JULY 1976, because that is the date the Rules themselves carry. But do not be thrown if a question paper follows the other document.

  • 1(iii) — ये कब लागू हुएराजपत्र में इनके प्रकाशन की तारीख को। वह तारीख है 17 जुलाई 1976, जिस दिन जी.एस.आर. 1052 प्रकाशित हुआ। अर्थात् नियमों के पाठ में अपनी कोई प्रारंभ तिथि नहीं दी गई है। राजपत्र जब कहे, तब से ये शुरू होते हैं। इस तारीख पर एक टिप्पणी। दो सरकारी दस्तावेज इसे अलग-अलग देते हैं। 2011 के संशोधन के साथ लगी टिप्पणी कहती है कि मूल नियम जी.एस.आर. 1052, दिनांक 17 जुलाई 1976 द्वारा प्रकाशित हुए। संसदीय समिति का नौवाँ प्रतिवेदन कहता है कि वे 28 जून 1976 को राजपत्र में प्रकाशित हुए। उत्तर 17 जुलाई 1976 दीजिए, क्योंकि यह तारीख स्वयं नियम रखते हैं। किंतु यदि कोई प्रश्नपत्र दूसरे दस्तावेज का अनुसरण करे तो चौंकिए मत।

Rule 2DEFINITIONSनियम 2 — परिभाषाएँ
Rule 2 defines nine expressions. Read them slowly. Three of them decide who the Rules apply to at all. Three more are the Regions that the whole of correspondence turns on.
  • 2(a)ACT"Act" means the OFFICIAL LANGUAGES ACT, 1963 (19 of 1963). So wherever the Rules say "the Act", they mean that one.
  • 2(b)CENTRAL GOVERNMENT OFFICEThis definition is DELIBERATELY WIDE, and it is the reason you are studying these Rules at all. It includes three things. (i) Any Ministry, Department or office of the Central Government. (ii) Any office of a Commission, Committee or Tribunal appointed by the Central Government. (iii) Any office of a CORPORATION OR COMPANY OWNED OR CONTROLLED by the Central Government. Now see limb (iii). That is how a public sector undertaking comes inside the Rules, and it is how INDIAN RAILWAYS is covered.
  • 2(c)EMPLOYEE"Employee" means ANY PERSON EMPLOYED IN A CENTRAL GOVERNMENT OFFICE. The Rules do not grade this. A Group D employee and a Head of Department are equally employees here.
  • 2(d)NOTIFIED OFFICEAn office notified under SUB-RULE (4) OF RULE 10. Learn the citation exactly, because the paper asks for the rule number and not for a description.
  • 2(e) AND 2(i)THE TWO STANDARDS
    • "Proficiency in Hindi" means proficiency as described in RULE 9.
    • "Working knowledge of Hindi" means working knowledge as described in RULE 10.
    Rule 2 only points; the substance is in Rules 9 and 10.
  • 2(f), 2(g) AND 2(h)THE THREE REGIONSRegion A and Region B are named lists of States and Union Territories. Region C is defined by EXCLUSION, as everything not in clauses (f) and (g). The lists are long and are asked by name, so they are set out separately. Learn them there.

  • 2(ख) — केंद्रीय सरकार का कार्यालययह परिभाषा जान-बूझकर चौड़ी रखी गई है, और आप ये नियम पढ़ ही इसीलिए रहे हैं। इसमें तीन बातें आती हैं। (i) केंद्र सरकार का कोई मंत्रालय, विभाग या कार्यालय। (ii) केंद्र सरकार द्वारा नियुक्त किसी आयोग, समिति या अधिकरण का कोई कार्यालय। (iii) केंद्र सरकार के स्वामित्व या नियंत्रण वाले किसी निगम या कंपनी का कोई कार्यालय। अब तीसरे अंग को देखिए। इसी से कोई सार्वजनिक उपक्रम नियमों के भीतर आता है, और इसी से भारतीय रेल इनके दायरे में है।
  • 2(ग) — कर्मचारी"कर्मचारी" से तात्पर्य है केंद्रीय सरकार के कार्यालय में नियोजित कोई भी व्यक्ति। नियम इसमें कोई श्रेणी-भेद नहीं करते। समूह घ का कर्मचारी और विभागाध्यक्ष, दोनों यहाँ समान रूप से कर्मचारी हैं।
  • 2(घ) — अधिसूचित कार्यालयवह कार्यालय जो नियम 10 की उपनियम (4) के अधीन अधिसूचित किया गया हो। उद्धरण ठीक-ठीक याद कीजिए, क्योंकि परीक्षा नियम संख्या पूछती है, विवरण नहीं।
  • 2(ङ) और 2(झ) — दो स्तर
    • "हिंदी में प्रवीणता" से तात्पर्य नियम 9 में वर्णित प्रवीणता है।
    • "हिंदी का कार्यसाधक ज्ञान" से तात्पर्य नियम 10 में वर्णित कार्यसाधक ज्ञान है।
    नियम 2 केवल संकेत करता है; असली बात नियम 9 और 10 में है।
  • 2(च), 2(छ) और 2(ज) — तीन क्षेत्रक्षेत्र "क" और क्षेत्र "ख" राज्यों तथा संघ राज्यक्षेत्रों की नामित सूचियाँ हैं। क्षेत्र "ग" अपवर्जन से परिभाषित है, अर्थात् वह सब जो खंड (च) और (छ) में नहीं है। सूचियाँ लंबी हैं और नाम लेकर पूछी जाती हैं, इसलिए वे अलग से दी गई हैं। उन्हें वहीं सीखिए।

CORRESPONDENCE (RULES 3 TO 5)पत्राचार (नियम 3 से 5)
Rule 3WRITING OUTSIDE THE CENTRAL GOVERNMENTनियम 3 — केंद्रीय सरकार के बाहर पत्राचार
This rule covers letters going OUTSIDE the Central Government. That means to a State, a Union Territory, an office that is not a Central Government office, or a person. Rule 4 will cover letters inside. Keep that division clear, because most mistakes here are made by applying the wrong rule. In the Rules itself the heading of this Rule reads — COMMUNICATIONS TO STATES AND OTHERS, NOT BEING CENTRAL GOVERNMENT OFFICES. The short heading above is ours, so you can find the Rule at a glance. If the paper asks for the heading, write these words.
  • 3(1)TO REGION ACommunications SHALL, SAVE IN EXCEPTIONAL CASES, BE IN HINDI. And if any communication is issued in English, it SHALL BE ACCOMPANIED BY A HINDI TRANSLATION. Note the two halves. Hindi is the rule, English is allowed only exceptionally, and even then it does not travel alone.
  • 3(2)(a)TO A STATE OR OFFICE IN REGION BCommunications shall ORDINARILY BE IN HINDI, and an English communication must again carry a Hindi translation. The word here is ORDINARILY, softer than the SHALL of Region A.
  • THE PROVISO TO 3(2)(a)THE STATE MAY ASK FOR SOMETHING ELSEA Region B State or Union Territory may ask for something different. It may ask for communications of a particular class or category, or those meant for any of its offices. Those are then to be sent IN ENGLISH, or in Hindi with a translation. It names the period for which this is to apply. Such communications SHALL THEN BE SENT IN THAT MANNER. So the receiving State can override the ordinary rule for a stated period. This proviso is easy to miss and worth marking.
  • 3(2)(b)TO A PERSON IN REGION BMay be EITHER IN HINDI OR IN ENGLISH. See the difference from 3(2)(a). To the STATE or an OFFICE it is ordinarily Hindi, but to a PERSON there is a free choice.
  • 3(3)TO REGION CCommunications to the State, the Union Territory, an office there or a person there SHALL BE IN ENGLISH.
  • 3(4)THE EXCEPTION FOR AN OFFICE SITTING IN REGION CThis sub-rule overrides sub-rules (1) and (2). It applies where the Central Government office is ITSELF IN REGION C. Take such an office writing to a State or Union Territory of Region A or Region B, or to an office or person there. That communication MAY BE EITHER IN HINDI OR IN ENGLISH. A proviso adds that Hindi shall be used in such proportion as the Central Government determines from time to time. It fixes that proportion on three considerations. The number of persons having a working knowledge of Hindi, the facilities available for sending communications in Hindi, and matters incidental to them. Now hold the ladder in your head. Region A Hindi, Region B ordinarily Hindi, Region C English. Then remember that 3(4) bends the first two for an office that itself sits in Region C.

  • 3(1) — क्षेत्र "क" कोपत्राचार अपवादस्वरूप दशाओं को छोड़कर हिंदी में होगा। और यदि कोई पत्र अंग्रेजी में जारी किया जाता है, तो उसके साथ हिंदी अनुवाद होगा। दोनों भाग देखिए। हिंदी नियम है, अंग्रेजी केवल अपवाद में चलती है, और तब भी अकेली नहीं जाती।
  • 3(2)(क) — क्षेत्र "ख" के राज्य या कार्यालय कोपत्राचार साधारणतया हिंदी में होगा, और अंग्रेजी पत्र के साथ फिर हिंदी अनुवाद होना चाहिए। यहाँ शब्द है "साधारणतया", जो क्षेत्र "क" के "होगा" से नरम है।
  • 3(2)(क) का परंतुक — राज्य कुछ और भी माँग सकता हैक्षेत्र "ख" का कोई राज्य या संघ राज्यक्षेत्र कुछ और भी माँग सकता है। वह माँग सकता है कि किसी विशेष वर्ग या प्रवर्ग के पत्र, अथवा उसके किन्हीं कार्यालयों के लिए भेजे जाने वाले पत्र, अंग्रेजी में या हिंदी में अनुवाद सहित भेजे जाएँ। वह सरकार यह अवधि भी नियत करती है। ऐसे पत्र तब उसी रीति से भेजे जाएँगे। अर्थात् पाने वाला राज्य नियत अवधि के लिए साधारण नियम को बदल सकता है। यह परंतुक आसानी से छूट जाता है, इसे निशान लगाइए।
  • 3(2)(ख) — क्षेत्र "ख" के किसी व्यक्ति कोहिंदी या अंग्रेजी, दोनों में से कोई भी। 3(2)(क) से अंतर देखिए। राज्य या कार्यालय को साधारणतया हिंदी, किंतु व्यक्ति को स्वतंत्र विकल्प।
  • 3(3) — क्षेत्र "ग" कोवहाँ के राज्य, संघ राज्यक्षेत्र, कार्यालय या व्यक्ति को पत्राचार अंग्रेजी में होगा।
  • 3(4) — क्षेत्र "ग" में बैठे कार्यालय के लिए अपवादयह उपनियम, उपनियम (1) और (2) पर भारी पड़ता है। यह वहाँ लागू होता है जहाँ केंद्रीय सरकार का कार्यालय स्वयं क्षेत्र "ग" में है। ऐसा कार्यालय जब क्षेत्र "क" या "ख" के किसी राज्य या संघ राज्यक्षेत्र को, या वहाँ के किसी कार्यालय या व्यक्ति को लिखता है, तब पत्र हिंदी या अंग्रेजी, दोनों में से किसी में भी हो सकता है। परंतुक जोड़ता है कि हिंदी का प्रयोग उस अनुपात में होगा जो केंद्र सरकार समय-समय पर नियत करे। वह यह अनुपात तीन बातों को देखकर तय करती है। हिंदी का कार्यसाधक ज्ञान रखने वाले व्यक्तियों की संख्या, हिंदी में पत्र भेजने की उपलब्ध सुविधाएँ, तथा उनसे संबंधित बातें। अब सीढ़ी मन में रखिए। क्षेत्र "क" हिंदी, क्षेत्र "ख" साधारणतया हिंदी, क्षेत्र "ग" अंग्रेजी। फिर याद रखिए कि 3(4) पहले दोनों को उस कार्यालय के लिए मोड़ देता है जो स्वयं क्षेत्र "ग" में बैठा है।

Rule 4WRITING BETWEEN CENTRAL OFFICESनियम 4 — केंद्रीय कार्यालयों के बीच पत्राचार
Rule 3 was about writing outward. This one is about writing INSIDE the Central Government, and it has five clauses. Read them as a ladder from the top of the Government downwards. In the Rules itself the heading of this Rule reads — COMMUNICATIONS BETWEEN CENTRAL GOVERNMENT OFFICES. The short heading above is ours, so you can find the Rule at a glance. If the paper asks for the heading, write these words.
  • 4(a)MINISTRY TO MINISTRYBetween one Ministry or Department of the Central Government and another, communications MAY BE IN HINDI OR IN ENGLISH. Free choice at the top.
  • 4(b)MINISTRY TO ITS OWN OFFICES IN REGION ABetween a Ministry or Department and its ATTACHED OR SUBORDINATE OFFICES SITUATED IN REGION A, communications SHALL BE IN HINDI. They are to be in Hindi in such proportion as the Central Government determines from time to time. It fixes that proportion on the same three considerations as in Rule 3(4).
  • 4(c)BETWEEN CENTRAL GOVERNMENT OFFICES INSIDE REGION ABetween Central Government offices situated in Region A, other than those covered by clause (a) or clause (b), communications SHALL BE IN HINDI. Inside Region A there is no choice.
  • 4(d)REGION A OFFICE TO A REGION B OR C OFFICEMay be IN HINDI OR IN ENGLISH. A proviso adds that Hindi shall be used in such proportion as the Central Government determines, on the same considerations.
  • 4(e)BETWEEN OFFICES IN REGION B OR REGION CMay be IN HINDI OR IN ENGLISH, again with the proportion proviso.
  • THE TRANSLATION RULE THAT SITS UNDER 4(e)Where a translation in the other language is needed, WHO PROVIDES IT DEPENDS ON WHERE THE LETTER IS GOING. If it is addressed to an office in REGION A OR REGION B, the translation is provided, IF NECESSARY, AT THE RECEIVING END. If it is addressed to an office in REGION C, the translation must be provided ALONG WITH the communication. And a further proviso says NO TRANSLATION AT ALL is required if the communication is addressed to a NOTIFIED OFFICE. Think about why that last one is fair. A notified office is one where the staff already have a working knowledge of Hindi. To send a translation there would be work done for nobody.

  • 4(ग) — क्षेत्र "क" के भीतर केंद्रीय सरकार के कार्यालयों के बीचक्षेत्र "क" में स्थित केंद्रीय सरकार के कार्यालयों के बीच, खंड (क) या (ख) में आने वालों को छोड़कर, पत्राचार हिंदी में होगा। क्षेत्र "क" के भीतर कोई विकल्प नहीं है।

  • WHY THE WORD NOTWITHSTANDING MATTERSIt puts Rule 5 above Rules 3 and 4. Take a Central Government office sitting in REGION C. Under Rule 3(3) it would otherwise write in English. It must still reply in HINDI to a letter received in Hindi. The region does not save it. This is the point the paper tests.

This rule is the Rules' way of enforcing Section 3(3) of the Act. Read it beside that sub-section, because the two work as a pair.
  • WHAT MUST BE BILINGUALBOTH HINDI AND ENGLISH shall be used for ALL DOCUMENTS REFERRED TO IN SUB-SECTION (3) OF SECTION 3 OF THE ACT. The Rule does not repeat the list. It points at the Act, so the fourteen items you learn on the Section 3(3) page are exactly the items covered here.
  • BOTH, NOT ONE WITH A TRANSLATIONThe words are BOTH HINDI AND ENGLISH. Neither version is the original and neither is a translation. Both are the document. A paper issued only in Hindi breaks this rule exactly as much as one issued only in English. Your mind says Hindi alone must be safe. It is not.
  • WHO ANSWERS FOR ITIt is the RESPONSIBILITY OF THE PERSONS SIGNING such documents to ensure they are MADE, EXECUTED OR ISSUED in both languages. The duty attaches to the ACT OF SIGNING. So the officer cannot discharge it by telling somebody else to arrange the Hindi version. To sign a document that is not bilingual is itself the breach. And see why the law puts the duty there. The person who signs is the last person who could have stopped the document going out in one language. Compliance is expected at 100 PER CENT, because the rule is mandatory.

  • 7(1)THE EMPLOYEE MAY CHOOSEAn employee MAY SUBMIT AN APPLICATION, APPEAL OR REPRESENTATION IN HINDI OR IN ENGLISH. The office cannot insist on one language.
  • 7(2) — A HINDI APPLICATION GETS A HINDI REPLYWhere such an application, appeal or representation is MADE OR SIGNED IN HINDI, it SHALL BE REPLIED TO IN HINDI. Read the words MADE OR SIGNED. Even a paper drafted in English but SIGNED in Hindi attracts a Hindi reply. The office cannot answer in English merely because the file happens to be in English.
  • 7(3)SERVICE MATTERS, INCLUDING DISCIPLINARY PROCEEDINGSAn employee may DESIRE that an order or notice relating to service matters be served on him in Hindi, or in English. Service matters here INCLUDE DISCIPLINARY PROCEEDINGS. It SHALL THEN BE GIVEN TO HIM IN THAT LANGUAGE WITHOUT UNDUE DELAY. The words WITHOUT UNDUE DELAY are doing real work. A right to receive your chargesheet in the language you understand is worth nothing if supplying it can take months. And notice how far this reaches. Disciplinary proceedings are named in the rule itself. So this is not a courtesy. It is a right, in the most serious papers an employee will ever receive.

NOTING (RULE 8)टिप्पणी (नियम 8)
Rule 8NOTING IN CENTRAL GOVERNMENT OFFICESनियम 8 — केंद्रीय सरकार के कार्यालयों में टिप्पणी
This is the rule that makes noting in Hindi practical. Read its four sub-rules together and its design becomes obvious.
  • 8(1)NOTE IN EITHER LANGUAGE, AND DO NOT TRANSLATEAn employee may record a NOTE OR MINUTE ON A FILE IN HINDI OR IN ENGLISH. He is NOT HIMSELF REQUIRED TO FURNISH A TRANSLATION in the other language. Rule 8 protects the person who WRITES, not the person who reads. The employee who notes in Hindi is relieved of any duty to translate.
  • 8(2)AND YOU MAY NOT DEMAND ONE EITHERNo Central Government employee POSSESSING A WORKING KNOWLEDGE OF HINDI may ask for an English translation of a document in Hindi. The one EXCEPTION is a document of a LEGAL OR TECHNICAL NATURE. Now put 8(1) and 8(2) side by side and the whole design appears. Suppose a Hindi note could be met with a demand for translation. Noting in Hindi would then only create work for the writer, and nobody would do it.
  • 8(3)WHO SETTLES A DISPUTE ABOUT THATA question may arise whether a particular document is of a legal or technical nature. It SHALL BE DECIDED BY THE HEAD OF THE DEPARTMENT OR OFFICE. The rule provides no appeal from that decision. It is meant to be settled quickly inside the office. The exception is narrow, and it has to be, because read widely it would swallow the rule.
  • 8(4)WHERE HINDI ALONE IS USEDThis sub-rule overrides sub-rule (1). The Central Government MAY BY ORDER SPECIFY THE NOTIFIED OFFICES where HINDI ALONE shall be used. It covers NOTING, DRAFTING and such other official purposes as the order specifies. And it applies only to EMPLOYEES WHO POSSESS PROFICIENCY IN HINDI. Mark two limits in that sub-rule. It applies only in a NOTIFIED OFFICE, and only to employees who possess PROFICIENCY — the higher standard of Rule 9, not the working knowledge of Rule 10. This is where noting stops being a choice and becomes a duty. Hindi is compulsory elsewhere in the Rules too. A reply under Rule 5 must be in Hindi, and so must a letter to Region A under Rule 3(2)(a). What is special here is that the compulsion reaches NOTING.
  • THE TARGETUnder the Annual Programme the target for noting done in Hindi is 30 PER CENT. Do not confuse it with the 100 per cent of Rule 5 and Rule 6.

  • 8(2) — और आप अनुवाद माँग भी नहीं सकतेहिंदी का कार्यसाधक ज्ञान रखने वाला कोई केंद्रीय सरकार कर्मचारी हिंदी के किसी दस्तावेज का अंग्रेजी अनुवाद नहीं माँग सकता, सिवाय विधिक या तकनीकी प्रकृति के दस्तावेजों के। अब 8(1) और 8(2) को साथ रखिए, पूरी रचना दिख जाएगी। यदि हिंदी टिप्पणी के बदले अनुवाद माँगा जा सकता, तो हिंदी में टिप्पणी लिखना केवल लिखने वाले के लिए काम बढ़ाता, और फिर कोई लिखता ही नहीं।
  • 8(3) — इस पर विवाद कौन तय करेगायदि यह प्रश्न उठे कि कोई दस्तावेज विधिक या तकनीकी प्रकृति का है या नहीं, तो उसे विभागाध्यक्ष या कार्यालयाध्यक्ष तय करेगा। नियम उस निर्णय के विरुद्ध कोई अपील नहीं देता। इसे कार्यालय के भीतर ही जल्दी निपटाया जाना है। यह अपवाद संकीर्ण है, और होना भी चाहिए, क्योंकि चौड़ा पढ़ा जाए तो यह पूरे नियम को निगल जाएगा।
  • 8(4) — जहाँ केवल हिंदी चलेगीयह उपनियम, उपनियम (1) पर भारी पड़ता है। केंद्र सरकार आदेश द्वारा ऐसे अधिसूचित कार्यालय विनिर्दिष्ट कर सकती है जहाँ केवल हिंदी का प्रयोग होगा। इसमें टिप्पणी, प्रारूपण तथा आदेश में विनिर्दिष्ट अन्य राजकीय प्रयोजन आते हैं। और यह केवल उन कर्मचारियों पर लागू है जिन्हें हिंदी में प्रवीणता प्राप्त है। इस उपनियम की दो सीमाएँ निशान लगाइए। यह केवल अधिसूचित कार्यालय में लागू है, और केवल उन कर्मचारियों पर जिन्हें प्रवीणता प्राप्त है — नियम 9 वाला ऊँचा स्तर, नियम 10 वाला कार्यसाधक ज्ञान नहीं। यहीं टिप्पण चुनाव नहीं रह जाता, कर्तव्य बन जाता है। नियमों में हिंदी और जगह भी अनिवार्य है। नियम 5 का उत्तर हिंदी में होना चाहिए, और नियम 3(2)(क) के अधीन क्षेत्र "क" को पत्र भी। यहाँ खास बात यह है कि अनिवार्यता टिप्पण तक पहुँचती है।

Rules 9 and 10 are the pair you will confuse most often in this whole subject. Rule 9 is the HIGHER standard. Learn it first, then read Rule 10 against it. An employee is DEEMED TO POSSESS PROFICIENCY IN HINDI in any one of three ways.
  • 9(a)HINDI AS THE MEDIUMHe has passed the MATRICULATION or any equivalent or higher examination WITH HINDI AS THE MEDIUM OF EXAMINATION.
  • 9(b)HINDI AS AN ELECTIVE AT DEGREE LEVELHe has taken HINDI AS AN ELECTIVE SUBJECT in the degree examination, or in any other examination equivalent to or higher than the degree examination.
  • 9(c)HE DECLARES HIMSELFHe DECLARES HIMSELF to possess proficiency in Hindi IN THE FORM ANNEXED TO THESE RULES. Notice the third route, because you will forget it exists. A declaration in the prescribed form is enough by itself. No examination and no certificate is needed. And fix the one word that separates this rule from the next.
    • Here Hindi is the MEDIUM of the examination.
    • In Rule 10 Hindi is only one of the SUBJECTS.

Rule 10WORKING KNOWLEDGE OF HINDIनियम 10 — हिंदी का कार्यसाधक ज्ञान
This is the LOWER of the two standards, and you will meet it far more often, because it carries most of the legal effect. Section 3(2) of the Act and Rule 4's translation provisions both turn on working knowledge, not on proficiency.
  • 10(1)(a)BY PASSING AN EXAMINATIONAn employee is deemed to have acquired a working knowledge of Hindi if he has passed any one of three things. (i) The MATRICULATION or an equivalent or higher examination WITH HINDI AS ONE OF THE SUBJECTS. (ii) The PRAGYA examination conducted under the HINDI TEACHING SCHEME of the Central Government. Or, where that Government so specifies for a particular category of posts, any LOWER examination under that Scheme. (iii) Any other examination specified in that behalf by the Central Government.
  • 10(1)(b)BY DECLARING HIMSELFOr if he DECLARES HIMSELF to have acquired such knowledge IN THE FORM ANNEXED to these Rules. Same third route as in Rule 9.
  • 10(2)WHEN A WHOLE OFFICE IS DEEMED TO HAVE ITThe staff of a Central Government office are ORDINARILY DEEMED to have acquired a working knowledge of Hindi. The test is that EIGHTY PER CENT of the staff working there have acquired such knowledge. Fix that figure. Eighty, not seventy-five and not ninety.
  • 10(3)WHO DECIDES THE QUESTIONThe CENTRAL GOVERNMENT MAY DETERMINE whether the staff of a Central Government office has acquired a working knowledge of Hindi. So may any officer specified in that behalf by it.
  • 10(4)NOTIFICATION, AND LOSING THE STATUSThe names of such offices SHALL BE NOTIFIED IN THE OFFICIAL GAZETTE. This is where the term NOTIFIED OFFICE in Rule 2(d) comes from. A proviso covers what happens if the office slips. The Central Government may form the opinion that the percentage in a notified office HAS GONE BELOW eighty from a particular date. It may then, by notification, declare that the office CEASES TO BE A NOTIFIED OFFICE from that date. So notified status is not permanent. It is earned by the staff and it can be lost when the staff change.

  • 10(1)(क) — परीक्षा उत्तीर्ण करकेकर्मचारी को हिंदी का कार्यसाधक ज्ञान प्राप्त माना जाता है यदि उसने तीन में से कोई एक उत्तीर्ण की हो। (i) मैट्रिक या उसके समकक्ष अथवा उससे ऊँची परीक्षा, जिसमें हिंदी विषयों में से एक रही हो। (ii) केंद्र सरकार की हिंदी शिक्षण योजना के अंतर्गत आयोजित प्राज्ञ परीक्षा, अथवा जहाँ वह सरकार किसी विशेष प्रवर्ग के पदों के लिए ऐसा विनिर्दिष्ट करे, उस योजना के अंतर्गत कोई निम्नतर परीक्षा। (iii) इस निमित्त केंद्र सरकार द्वारा विनिर्दिष्ट कोई अन्य परीक्षा।
  • 10(1)(ख) — स्वयं घोषणा करकेअथवा यदि वह इन नियमों के साथ संलग्न प्रपत्र में स्वयं को ऐसा ज्ञान प्राप्त घोषित करे। वही तीसरा रास्ता जो नियम 9 में था।
  • 10(2) — पूरा कार्यालय कब ऐसा माना जाता हैकेंद्रीय सरकार के किसी कार्यालय के कर्मचारियों को साधारणतया हिंदी का कार्यसाधक ज्ञान प्राप्त तब माना जाता है जब वहाँ काम करने वाले अस्सी प्रतिशत कर्मचारी ऐसा ज्ञान प्राप्त कर लें। यह आँकड़ा बैठा लीजिए। अस्सी, न पचहत्तर और न नब्बे।
  • 10(3) — यह प्रश्न कौन तय करेगाकेंद्र सरकार, या उसके द्वारा इस निमित्त विनिर्दिष्ट कोई अधिकारी, यह अवधारित कर सकता है कि किसी केंद्रीय सरकार कार्यालय के कर्मचारियों ने हिंदी का कार्यसाधक ज्ञान प्राप्त कर लिया है या नहीं।
  • 10(4) — अधिसूचना, और यह दर्जा खोनाऐसे कार्यालयों के नाम राजपत्र में अधिसूचित किए जाएँगे। नियम 2(घ) का "अधिसूचित कार्यालय" शब्द यहीं से आता है। परंतुक यह बताता है कि कार्यालय पिछड़ जाए तो क्या होगा। केंद्र सरकार की यह राय हो सकती है कि किसी अधिसूचित कार्यालय में यह प्रतिशत किसी तारीख से अस्सी से नीचे चला गया है। तब वह अधिसूचना द्वारा घोषित कर सकती है कि वह कार्यालय उस तारीख से अधिसूचित कार्यालय नहीं रहेगा। अर्थात् अधिसूचित होने का दर्जा स्थायी नहीं है। यह कर्मचारी कमाते हैं, और कर्मचारी बदलने पर यह जा भी सकता है।

Rule 11PRINTED MATTER AND STATIONERYनियम 11 — मुद्रित सामग्री और लेखन सामग्री
The rule that decides what the office LOOKS like. Its three sub-rules move from the thickest book down to the envelope. In the Rules itself the heading of this Rule reads — MANUALS, CODES, PROCEDURAL LITERATURE AND STATIONERY. The short heading above is ours, so you can find the Rule at a glance. If the paper asks for the heading, write these words.
  • 11(1)MANUALS AND CODES, IN DIGLOT FORMAll MANUALS, CODES AND OTHER PROCEDURAL LITERATURE relating to Central Government offices shall be PRINTED OR CYCLOSTYLED. They shall be published BOTH IN HINDI AND ENGLISH IN DIGLOT FORM. Learn the word DIGLOT, because it is asked by name. Diglot means the two languages appear TOGETHER IN ONE VOLUME, not as two separate books. So a Hindi edition on one shelf and an English edition on another does not satisfy this sub-rule.
  • 11(2)FORMS AND REGISTERSThe FORMS and the HEADINGS OF REGISTERS used in any Central Government office shall be in HINDI AND IN ENGLISH. Read it carefully. It is the HEADINGS of registers, not everything written inside them.
  • 11(3)NAME-PLATES AND STATIONERYTake all NAME-PLATES, SIGN-BOARDS, LETTER-HEADS and INSCRIPTIONS ON ENVELOPES, and other items of stationery written, printed or inscribed for use in any Central Government office. They shall be in HINDI AND IN ENGLISH.
  • THE PROVISO TO 11(3)EXEMPTIONThe Central Government MAY EXEMPT any Central Government office from ALL OR ANY of the provisions of this rule. It does so BY GENERAL OR SPECIAL ORDER, if it considers it necessary. Note that the exemption power covers the whole rule, not only sub-rule (3).
यह वह नियम है जो तय करता है कि कार्यालय दिखता कैसा है। इसकी तीनों उपनियमें सबसे मोटी पुस्तक से चलकर लिफाफे तक आती हैं। नियमों में इस नियम का शीर्षक इस प्रकार है — नियम-पुस्तिकाएँ, संहिताएँ, प्रक्रिया साहित्य और लेखन सामग्री। ऊपर दिया छोटा शीर्षक हमारा है, ताकि आप नियम को एक नजर में पहचान सकें। अगर प्रश्न-पत्र शीर्षक पूछे तो ये शब्द लिखिए।
  • 11(1) — नियम-पुस्तिकाएँ और संहिताएँ, द्विभाषी रूप मेंकेंद्रीय सरकार के कार्यालयों से संबंधित सभी नियम-पुस्तिकाएँ, संहिताएँ और अन्य प्रक्रिया साहित्य मुद्रित या साइक्लोस्टाइल किए जाएँगे और हिंदी तथा अंग्रेजी दोनों में द्विभाषी (डाइग्लॉट) रूप में प्रकाशित किए जाएँगे। "डाइग्लॉट" शब्द याद कीजिए, क्योंकि यह नाम लेकर पूछा जाता है। डाइग्लॉट का अर्थ है दोनों भाषाएँ एक ही जिल्द में साथ-साथ आएँ, दो अलग पुस्तकों के रूप में नहीं। अर्थात् एक ताक पर हिंदी संस्करण और दूसरी पर अंग्रेजी संस्करण रख देने से यह उपनियम पूरा नहीं होता।
  • 11(2) — प्रपत्र और रजिस्टरकेंद्रीय सरकार के किसी कार्यालय में प्रयुक्त प्रपत्र तथा रजिस्टरों के शीर्षक हिंदी और अंग्रेजी में होंगे। इसे ध्यान से पढ़िए। बात रजिस्टरों के शीर्षकों की है, उनके भीतर लिखी हर बात की नहीं।
  • 11(3) — नामपट्ट और लेखन सामग्रीकेंद्रीय सरकार के किसी कार्यालय में प्रयोग के लिए लिखे, मुद्रित या उत्कीर्ण सभी नामपट्ट, सूचना-पट्ट, पत्र-शीर्ष तथा लिफाफों और अन्य लेखन सामग्री पर के उत्कीर्णन हिंदी और अंग्रेजी में होंगे।
  • 11(3) का परंतुक — छूटकेंद्र सरकार, यदि वह आवश्यक समझे, साधारण या विशेष आदेश द्वारा किसी केंद्रीय सरकार कार्यालय को इस नियम के सभी या किन्हीं उपबंधों से छूट दे सकती है। ध्यान दीजिए, छूट की यह शक्ति पूरे नियम पर है, केवल उपनियम (3) पर नहीं।

Rule 12RESPONSIBILITY FOR COMPLIANCEनियम 12 — अनुपालन की जिम्मेदारी
The last rule, and the one that says who answers if the rest are not followed.
  • 12(1)THE ADMINISTRATIVE HEADIt shall be the responsibility of the ADMINISTRATIVE HEAD OF EACH CENTRAL GOVERNMENT OFFICE to do two things. (i) To ENSURE that the provisions of the Act, these Rules and the directions issued are properly complied with. (ii) To DEVISE SUITABLE AND EFFECTIVE CHECK-POINTS for this purpose. The second limb is the one that gets left out. It is not enough to intend compliance. The head must build the check-points that make compliance visible.
  • 12(2)THE CENTRAL GOVERNMENT'S POWER TO DIRECTThe Central Government MAY FROM TIME TO TIME ISSUE SUCH DIRECTIONS to its employees and offices. They may be whatever is necessary for the due compliance of the Act and these Rules. This is the source of the annual programmes and the circulars you actually work with in the office.
  • DO NOT MIX THE TWO RESPONSIBILITIESHere is the comparison the paper wants. Under RULE 6 the person SIGNING a document answers for that document being bilingual. Under RULE 12 the ADMINISTRATIVE HEAD answers for overall compliance in the office. One is per document, the other is for the office as a whole.

  • 12(1) — प्रशासनिक प्रधानप्रत्येक केंद्रीय सरकार कार्यालय के प्रशासनिक प्रधान की जिम्मेदारी होगी कि वह दो काम करे। (i) यह सुनिश्चित करना कि अधिनियम, इन नियमों तथा जारी किए गए निदेशों का ठीक-ठीक पालन हो। (ii) इस प्रयोजन के लिए उपयुक्त और प्रभावी जाँच-बिंदु बनाना। दूसरा अंग वही है जो छूट जाता है। केवल पालन की मंशा रखना पर्याप्त नहीं है। प्रधान को वे जाँच-बिंदु भी बनाने होंगे जिनसे पालन दिखाई दे।
  • 12(2) — केंद्र सरकार की निदेश देने की शक्तिकेंद्र सरकार अधिनियम तथा इन नियमों के सम्यक् अनुपालन के लिए, जैसा आवश्यक हो, अपने कर्मचारियों और कार्यालयों को समय-समय पर निदेश जारी कर सकती है। कार्यालय में आप जिन वार्षिक कार्यक्रमों और परिपत्रों के साथ वास्तव में काम करते हैं, उनका स्रोत यही है।
  • दोनों जिम्मेदारियाँ आपस में मत मिलाइएयही वह तुलना है जो परीक्षा चाहती है। नियम 6 के अधीन दस्तावेज पर हस्ताक्षर करने वाला उस दस्तावेज के द्विभाषी होने का जवाब देता है। नियम 12 के अधीन प्रशासनिक प्रधान कार्यालय में समग्र अनुपालन का जवाब देता है। एक हर दस्तावेज के लिए है, दूसरा पूरे कार्यालय के लिए।
