Article 120 — LANGUAGE TO BE USED IN PARLIAMENTअनुच्छेद 120 — संसद में प्रयोग की जाने वाली भाषा
Before we come to the Rajbhasha part of the Constitution, understand two articles that sit outside it. This is the first one.
First fix the whole range in your mind, because it is asked directly. The Official Language provisions are ARTICLES 120(1), 210(1) AND 343 TO 351. That is TWO articles outside Part XVII, and NINE inside it.
- 120(1) — LANGUAGE FOR BUSINESS IN PARLIAMENTIn Parliament, a member may speak in HINDI or in ENGLISH. Now think about a member who is not comfortable in either. Has the Constitution left him out? No. He may ask the Chair, and the Chair may allow him to speak in his MOTHER TONGUE. Notice what the rule is doing. It is making sure that no member has to stay silent only because of language.
- 120(2) — THE FIFTEEN-YEAR LIMIT, AND HOW IT WAS EXTENDEDThe English part was to stop after FIFTEEN YEARS. But the article itself said Parliament may make a law and keep it. Parliament did make that law. So English continues today. Keep this pattern in mind. You will meet it again in Article 343.

This is the second article outside Part XVII. Read it next to Article 120 and one difference will stand out.

- 210(1) — LANGUAGE FOR BUSINESS IN A STATE LEGISLATUREThe work is done in the OFFICIAL LANGUAGE of that State, or in HINDI, or in ENGLISH. Count them. THREE choices. In Parliament there were only two. Why the extra one? Because a State has its own language, and its own House must be able to use it. That is the whole difference, and it is a favourite question.
- 210(2) — THE SAME FIFTEEN-YEAR LIMITHere also English was to stop after fifteen years, unless the State Legislature made a law to keep it. Same pattern as Article 120, so you have to remember it only once.

Article 343 — OFFICIAL LANGUAGE OF THE UNIONअनुच्छेद 343 — संघ की राजभाषा
This is the most important article of the whole subject. Take it slowly, one sub-clause at a time.
- 343(1) — HINDI IN DEVANAGARI, AND THE NUMERALSThe official language of the Union is HINDI IN DEVANAGARI SCRIPT. Two words there decide many questions. It is not just "Hindi". The SCRIPT is also fixed. And for numbers we use the INTERNATIONAL FORM OF INDIAN NUMERALS, that is 1, 2, 3, not the Devanagari figures. This mark is lost every year.
- 343(2) — FIFTEEN YEARS FOR ENGLISHOur leaders knew the country could not change over in one day. So they gave FIFTEEN YEARS from the start of the Constitution, in which ENGLISH would continue for all the official work it was already doing. Understand it as a breathing period, not as a permission for ever.
- 343(3) — PARLIAMENT MAY KEEP ENGLISH EVEN AFTER THATNow here is the sub-clause that changed everything. It says PARLIAMENT CAN MAKE A LAW and keep English even AFTER those fifteen years. Parliament used this power and passed the Official Languages Act 1963. So whenever you are asked where that Act came from, the answer is 343(3). This one sub-clause is the root of the whole Act.

- 343(2) — अंग्रेजी के लिए पंद्रह सालहमारे नेता जानते थे कि देश एक दिन में नहीं बदल सकता। इसलिए उन्होंने संविधान लागू होने से पंद्रह साल दिए, जिनमें अंग्रेजी अपना पूरा सरकारी काम करती रहती। इसे साँस लेने का समय समझिए, हमेशा के लिए दी गई छूट नहीं।
- 343(3) — संसद उसके बाद भी अंग्रेजी रख सकती हैअब वह उपखंड जिसने सब कुछ बदल दिया। यह कहता है कि संसद कानून बनाकर उन पंद्रह साल के बाद भी अंग्रेजी रख सकती है। संसद ने इसी शक्ति से राजभाषा अधिनियम 1963 पारित किया। इसलिए जब भी पूछा जाए कि वह अधिनियम कहाँ से आया, उत्तर है 343(3)। यही एक उपखंड पूरे अधिनियम की जड़ है।

Article 344 — THE COMMISSION AND THE COMMITTEEअनुच्छेद 344 — आयोग और संसदीय समिति
Article 343 fixed the language. But who will watch whether Hindi is actually growing? That is the work of Article 344. It builds a review machinery in three steps.

- 344(1) — WHEN THE COMMISSION IS MADEThe PRESIDENT makes a COMMISSION AFTER FIVE YEARS from the start of the Constitution, and again AFTER TEN YEARS. Note both numbers. Questions often give you one and ask for the other.
- 344(2) — WHAT THE COMMISSION ADVISES ONThe Commission advises the President on THREE things.
- First, how to increase the use of HINDI in Union work.
- Second, what LIMITS to put on ENGLISH.
- Third, which language to use between the Union and a State, and between two States.
- 344(4) — THE COMMITTEE THAT EXAMINES THAT ADVICEThe Commission only advises. Who examines that advice? A COMMITTEE OF PARLIAMENT of THIRTY members — TWENTY from the LOK SABHA and TEN from the RAJYA SABHA. Remember it as 30 = 20 + 10. That twenty-and-ten split has stayed the same from 1957 till today.

Chapter I told us about the Centre. Now the Constitution turns to the States, and it does not force one language on them.
A State Legislature can make a law and choose its own official language. But see the limit carefully. It may choose ONE OR MORE languages ALREADY IN USE IN THAT STATE, or it may choose HINDI. Those are the only two kinds of choice. It cannot pick some third language that nobody there speaks.
And till the State makes such a law? ENGLISH simply continues for the work it was already doing. The Constitution never leaves a gap.

Article 346 — LANGUAGE FOR WRITING BETWEEN STATESअनुच्छेद 346 — राज्यों के बीच पत्राचार की भाषा
Every State has chosen its own language. So when Tamil Nadu writes to Punjab, which language will they use? Article 346 answers this.
The rule is simple. Whatever language is allowed at that time for UNION work becomes the language for letters between two States, and between a State and the Union.
But there is a PROVISO, and this is the part to hold on to. If two or more States AGREE among themselves, they may use HINDI between them. Notice who decides — the States agree; the Union does not order them.

Article 347 — A LANGUAGE SPOKEN BY PART OF A STATEअनुच्छेद 347 — किसी वर्ग की बोली जाने वाली भाषा
Think of a State where a large group speaks some other language. Their language is not the State language. Are they simply left out? Article 347 is the answer.
The people can make a DEMAND. If the PRESIDENT is satisfied that a LARGE PART of that State’s people want their language recognised, he can pass an order. It may cover the whole State or only some part of it.
Now hold on to one word — ALSO. The order says the language will ALSO be recognised. It ADDS a language. It never removes the State’s own official language. You may be tempted to answer that the State language is replaced. That is wrong.

अब एक शब्द पकड़ लीजिए — "भी"। आदेश कहता है कि उस भाषा को भी मान्यता मिलेगी। यह एक भाषा जोड़ता है। राज्य की अपनी राजभाषा को कभी नहीं हटाता। आपका मन कहेगा कि राज्य भाषा बदल जाती है। यह गलत है।

Article 348 — LANGUAGE OF THE COURTS AND OF LAWSअनुच्छेद 348 — न्यायालयों और कानूनों की भाषा

- 348(1) — ENGLISH IN THE COURTS, AND IN THE TEXT OF THE LAWTill Parliament makes another law, ALL WORK in the SUPREME COURT and in EVERY HIGH COURT is in ENGLISH. The AUTHORITATIVE TEXT of every Bill, Act, Ordinance, order, rule, regulation and bye-law is also in ENGLISH. Why so strict? Because a law must mean exactly one thing everywhere in the country, and one fixed language is the safest way to make sure of that.
- 348(2) — WHEN A GOVERNOR MAY ALLOW HINDIThere is some relief. The GOVERNOR of a State may allow HINDI, or the State’s own official language, in the work of that State’s HIGH COURT. For this he must first take the PRESIDENT’S CONSENT.
- THE LIMIT ON THAT RELIEF — THE EXAMINER’S FAVOURITEThat relief does NOT cover any JUDGMENT, DECREE OR ORDER. Those still have to be in English. So a lawyer may argue in Hindi, but the order that comes out will be in English.
- 348(1) — अदालतों में और कानून के पाठ में अंग्रेजीजब तक संसद कोई दूसरा कानून न बनाए, उच्चतम न्यायालय और हर उच्च न्यायालय का सारा काम अंग्रेजी में होगा। हर विधेयक, अधिनियम, अध्यादेश, आदेश, नियम, विनियम और उपविधि का प्राधिकृत पाठ भी अंग्रेजी में होगा। इतनी सख्ती क्यों? क्योंकि कानून का अर्थ पूरे देश में एक ही होना चाहिए, और एक तय भाषा इसे पक्का करने का सबसे सुरक्षित तरीका है।
- 348(2) — राज्यपाल कब हिंदी की अनुमति दे सकते हैंकुछ छूट भी है। राज्य के राज्यपाल उस राज्य के उच्च न्यायालय के काम में हिंदी, या राज्य की अपनी राजभाषा, चलाने की अनुमति दे सकते हैं। इसके लिए उन्हें पहले राष्ट्रपति की सहमति लेनी होगी।
- उस छूट की सीमा — परीक्षक की सबसे प्रिय बातयह छूट किसी निर्णय, डिक्री या आदेश पर लागू नहीं होती। वे आज भी अंग्रेजी में ही रहेंगे। यानी वकील हिंदी में बहस कर सकता है, पर जो आदेश निकलेगा वह अंग्रेजी में होगा।

Article 349 — THE EXTRA STEP FOR THE FIRST 15 YEARSअनुच्छेद 349 — पहले 15 वर्ष का अतिरिक्त कदम
Article 348 fixed the court language. Article 349 then put a lock on it, so that it could not be changed easily.
Take the FIFTEEN YEARS from the start of the Constitution. In that time no Bill or amendment about the language used for the purposes in ARTICLE 348(1) could even be brought in either House. Not WITHOUT THE PRESIDENT’S PREVIOUS SANCTION.
And the President could not give that sanction lightly either. He first had to see the COMMISSION’S ADVICE under 344(1) and the COMMITTEE’S REPORT under 344(4). See how the articles are joined together.
- 344 built the machinery.
- 348 fixed the court language.
- And 349 says you may change it only by passing through that machinery.
- 344 ने तंत्र बनाया।

Articles 350, 350A and 350B — LINGUISTIC MINORITIESअनुच्छेद 350, 350क और 350ख — भाषाई अल्पसंख्यक
Till now every article was about the Government — the Centre, the States, the courts. This last chapter turns to the COMMON MAN and to the SMALL LANGUAGE GROUP. Read these three together.
- Article 350 — LANGUAGE FOR AN APPLICATION ABOUT A GRIEVANCESuppose you have a complaint against a government office. Must you write it in Hindi or English? No. You may give your application to any officer of the Union or of a State. And you may give it IN ANY LANGUAGE USED IN THE UNION OR IN THAT STATE. Understand whose right this is. It belongs to the person complaining, not to the office receiving it.
- Article 350A — MOTHER TONGUE AT THE PRIMARY STAGEEvery State and every local body must TRY to give enough facility for teaching in the MOTHER TONGUE at the PRIMARY STAGE. This is for children of LINGUISTIC MINORITY GROUPS. The President may give directions to a State for this. Two limits to note, and both are asked. Only the PRIMARY stage, and the duty is to TRY, not to guarantee.
- Article 350B — SPECIAL OFFICER FOR LINGUISTIC MINORITIESAnd who will watch whether all this is really happening? A Special Officer, appointed BY THE PRESIDENT. He looks into all matters about the protection given to linguistic minorities and reports to the President. Those reports are PLACED BEFORE BOTH HOUSES OF PARLIAMENT and SENT TO THE STATES concerned. Remember that 350A and 350B were both added later, by the SEVENTH AMENDMENT, 1956.
- अनुच्छेद 350 — शिकायत के आवेदन की भाषामान लीजिए किसी सरकारी दफ्तर के खिलाफ आपकी शिकायत है। क्या आपको हिंदी या अंग्रेजी में ही लिखना पड़ेगा? नहीं। आप संघ या राज्य के किसी भी अधिकारी को अपना आवेदन संघ या उस राज्य में चल रही किसी भी भाषा में दे सकते हैं। समझिए यह अधिकार किसका है। शिकायत करने वाले का, आवेदन लेने वाले दफ्तर का नहीं।
- अनुच्छेद 350क — प्राथमिक स्तर पर मातृभाषाहर राज्य और हर स्थानीय निकाय को कोशिश करनी होगी कि भाषाई अल्पसंख्यक वर्ग के बच्चों को प्राथमिक स्तर पर मातृभाषा में पढ़ाई की पर्याप्त सुविधा मिले। राष्ट्रपति इसके लिए राज्य को निर्देश दे सकते हैं। दो सीमाएँ ध्यान रखिए, दोनों पूछी जाती हैं। सिर्फ प्राथमिक स्तर, और कर्तव्य कोशिश करने का है, गारंटी का नहीं।
- अनुच्छेद 350ख — भाषाई अल्पसंख्यकों के लिए विशेष अधिकारीऔर यह कौन देखेगा कि यह सब सचमुच हो रहा है? एक विशेष अधिकारी, जिसे राष्ट्रपति नियुक्त करते हैं। वह भाषाई अल्पसंख्यकों को मिले संरक्षण के सब मामले देखता है और राष्ट्रपति को रिपोर्ट देता है। वे रिपोर्ट संसद के दोनों सदनों के सामने रखी जाती हैं और संबंधित राज्यों को भेजी जाती हैं। याद रखिए कि 350क और 350ख दोनों बाद में, 1956 के सातवें संशोधन से जोड़े गए।

Article 351 — DEVELOPING THE HINDI LANGUAGEअनुच्छेद 351 — हिंदी भाषा का विकास
The last article, and a beautiful one. It does not order anybody. It gives the UNION a duty. That duty is to spread HINDI and to develop it. It must become the language of expression for every part of India’s MIXED CULTURE. The article then shows two ways to make Hindi rich. Both are asked, so learn them as a pair.
The Constitution's own heading reads — DIRECTIVE FOR DEVELOPMENT OF THE HINDI LANGUAGE. The short heading above is ours, so you can find the Article at a glance. If the paper asks for the heading, write these words.
- FIRST WAY — TAKE IN FROM HINDUSTANI AND THE EIGHTH SCHEDULETake in the FORMS, STYLE AND WORDS used in HINDUSTANI and in the other languages listed in the EIGHTH SCHEDULE. But do it without spoiling Hindi’s own nature.
- SECOND WAY — DRAW VOCABULARY MAINLY FROM SANSKRITFor new words, draw MAINLY FROM SANSKRIT, and after that from other languages. Now underline that word MAINLY. Write only "from Sanskrit" and you lose the mark. The article clearly says primarily from Sanskrit, and secondarily from others.
- पहला रास्ता — हिंदुस्तानी और आठवीं अनुसूची से लीजिएहिंदुस्तानी और आठवीं अनुसूची में दी गई दूसरी भाषाओं के रूप, शैली और शब्द अपनाइए। पर हिंदी की अपनी प्रकृति बिगाड़े बिना।
- दूसरा रास्ता — शब्द मुख्य रूप से संस्कृत से लीजिएनए शब्दों के लिए मुख्य रूप से संस्कृत से लीजिए, और उसके बाद दूसरी भाषाओं से। अब "मुख्य रूप से" शब्द रेखांकित कर लीजिए। सिर्फ "संस्कृत से" लिखेंगे तो अंक खो देंगे। अनुच्छेद साफ कहता है — मुख्यतः संस्कृत से और गौणतः अन्य भाषाओं से।
