• Para 901The CAG is an authority SUI GENERIS created by the Constitution, to audit the accounts of the Union, the States and the Union Territories. His functions come mainly from ARTICLES 149 TO 151, defined further by an Act of 1971.
  • The CAG's (Duties, Powers and Conditions of Service) Act, 1971 came into force on 15 DECEMBER 1971
  • Its amendment Act, 1976 came into force on 1 MARCH 1976
  His duties under these Acts are three.
  • (a) Audit all expenditure from the CONSOLIDATED FUNDS, checking money was legally available and the spending conforms to authority
  • (b) Audit all transactions relating to CONTINGENCY FUNDS and PUBLIC ACCOUNTS
  • (c) Audit all trading, manufacturing, profit and loss accounts and balance sheets of Government departments
• Paras 902 and 903He also audits all RECEIPTS payable into the Consolidated Funds, checking the rules secure proper assessment and collection. He may audit and report on the accounts of STORES AND STOCK in any department.
• Para 904He has authority to INSPECT any office of accounts, to CALL FOR books and documents, and to put QUESTIONS to the officer in charge. So the CAG's powers come from Articles 149 to 151 and the 1971 Act, and you should remember 15 December 1971.

• पैरा 902 और 903वह समेकित निधियों में देय सभी प्राप्तियों की भी लेखापरीक्षा करता है, यह जाँचते हुए कि नियम उचित निर्धारण और संग्रह सुनिश्चित करते हैं। वह किसी भी विभाग के भंडार और स्टॉक के लेखों की लेखापरीक्षा कर प्रतिवेदन दे सकता है।

  • The Act also covers bodies SUBSTANTIALLY FINANCED from Union or State revenues, and grants or loans to outside bodies
  • Audit of GOVERNMENT COMPANIES is defined in the Companies Act, 1956; statutory CORPORATIONS by their own Acts
  • Under ARTICLE 150, Union and State accounts are kept in the form the CAG prescribes with the PRESIDENT's approval
  • Under ARTICLE 279, the CAG certifies the 'NET PROCEEDS' of taxes assigned to States, such as taxes on passenger fares
• Para 907His oath requires him to uphold the Constitution and discharge his duties without fear or favour. The Constitution safeguards his independence in several ways.
  • Under ARTICLE 148, the PRESIDENT appoints him under his hand and seal
  • He is removed only like a JUDGE OF THE SUPREME COURT
  • He is NOT ELIGIBLE for any further office under the Union or a State
  • His office's expenses, salaries and pensions are CHARGED on the Consolidated Fund of India
• Para 908The SCOPE AND EXTENT of audit are determined by the CAG at his DISCRETION. So Article 148 secures his independence and Article 279 his certificate on net proceeds, and you should not mix the articles.
